RECOMMENDATIONS
THAT Council approve the request for a site specific variance to the fence by-
law to permit a wood fence in the front yard at 15516 Leslie Street and
THAT Council direct staff to bring back an amendment to fence by-law 4368
02.h for three readings at the December 14, 2004 Council meeting.
BACKGROUND
The owner of 15516 Leslie Street had contacted the Town regarding general fence
construction in the Town of Aurora. While fences are generally constructed of wood there
are exceptions that require fences in front yards in Rural areas to be either wrought iron or
chain link. In addition fence heights in the front yard are permitted to be 2.0 metres in
height in Estate Residential, Rural General and Rural Residential although on your typical
resident properties fence heights are restricted to 1.0 metre in height in a front yard.
The fence at 15516 Leslie Street complies with the height requirements but does not meet
the material requirements.
COMMENTS
Staff were alerted to the construction of the fence through a complaint and although the
complainant has since agreed to withdraw the complaint staff had already had discussions
regarding the violation with the property owner at 15516 Leslie Street
Staff have subsequently met with the owner of 15516 Leslie Street in an attempt to resolve
the matter. As noted earlier the owner had contacted the Town regarding general fencing
and was under the impression that wood was a satisfactory material. Asa great deal ofthe
fencing is already in place there the owner would incur great expense in having to replace
what is already in place.

In addition the posts have been installed for approximately 20 metres along the side of the
front yard and the owner has cooperated by discontinuing construction until some
resolution of the matter was forthcoming.
The property is immediately to the west of the W hitwell/State Farm site and the owner has
constructed the fence so as to minimize noise and dust onto the property. As the owner
indicated had it not been for this construction he would not be erecting a fence at all. The
owner also noted that the construction of a chain link or wrought iron would do little to
minimize the impact of noise and dust from a site that will be under construction for some
years.
Staff having met with the owner and the original complainant have no objection to the
owner completing construction of the fence. Privacy and seclusion will not pose a threat as
the majority of the property will remain unfenced. The property as noted is situated within a
rural setting and the fencing will have no impact on the adjacent properties.
OPTIONS
Council could deny the request and enforce the provisions of the by-law. This would result
in the owner having no relief from noise and dust associated with the long term
construction activity anticipated the Whitwell/State Farm property as well as causing great
expense to the owner in having to ensure the fence.
FINANCIAL IMPLICATIONS
CONCLUSIONS
That Council approve of the site specific variance to permit the owner of 15516 Leslie
Street to complete the construction of the fence in wood and that staff be directed to bring
back a site specific amendment to Section 2.1.10 of the present fence by-law for three
readings on December 14", 2004.
