Call to Order The meeting was called to order at 6:04 p.m. 2. Procedural Notes This meeting was held electronically as per Section 19. i) of the Town's Procedure By-law No. 6228-19, as amended, due to the COVID-19 situation. 3. Approval of the Agenda Moved by Linda Duringer Seconded by Steven D'Angeli That the agenda circulated by Legislative Services be approved. Carried 2 4. Declarations of Pecuniary Interest and General Nature Thereof There were no declarations of pecuniary interest under the Municipal Conflict of Interest Act, R.S.O. 1990, c. M.50. 5. Appeals for Consideration 5.1 22 Devlin Place – Muzzle Order – Animal Services By-law No. 6197-19 The Chair called the meeting to order and provided an overview of the Hearing. The Town requested that the Notice to Muzzle for the Appellant's dog Remy be confirmed as written. The Appellant requested that the Order be rescinded. Kayla Recker, the Town's Case Presenter, presented exhibits supporting the alleged dog bite caused by Remy on March 5, 2021, including witness statements and photographs. Kayla stated that the alleged attack occurred at an off-leash dog park. The Appellant provided photos, videos, and testimonials to support Remy's good temperament and behavior and noted that she was unaware of any injuries at the time of the alleged incident. The Tribunal discussed the incident and inquired about the exhibits entered into evidence. The Tribunal recessed the Hearing to deliberate at 7:56 p.m. and reconvened the Hearing at 8:45 p.m. The Tribunal issued a decision noting that while there is no dispute over whether an interaction between the dogs happened, the evidence submitted by the Town fails to support the alleged dog-on-dog bite resulting in a puncture of the skin.
