Call to Order The Chair reconvened the hearing at 6:02 p.m. noting that it is a continuance of the Aurora Appeal Tribunal hearing held on January 23, 2020, regarding 78 Timberline Trail – Notices to Muzzle – Animal Services By-law No. 6197-19. 2. Appeals for Consideration 1. 78 Timberline Trail – Notice to Muzzle – Animal Services By-law No. 6197-19 2. 78 Timberline Trail – Notice to Muzzle – Animal Services By-law No. 6197-19 The Chair noted that the subject appeals were first heard at the January 23, 2020, hearing that was recessed until this date to allow the Appellant to submit and present video evidence. The Town’s Case Presenter and the Appellant were reminded that they remain under oath. Aurora Appeal Tribunal Hearing Minutes Thursday, February 6, 2020 Page 2 of 3 The Appellant presented evidence in the form of six video clips depicting the incident in the case, as well as demonstrations of obedience training and nature of the two dogs, Chloe and Joey. The Town’s Case Presenter indicated that there were no objections to each of the six video clips being submitted into evidence. The Tribunal sought clarification on various aspects of the video clips, as well as the Appellant’s understanding of the Town’s Animal Services By-law, and the Appellant provided responses. The Town’s Case Presenter submitted that, in the interest of public safety, the Muzzle Orders should be upheld for the remaining years of the dogs’ lives. The Appellant requested that the muzzle restrictions be removed or reduced and provided assurances that a similar incident would not happen again, noting that the dogs are well trained, would be kept on-leash, and the rear yard would be fenced in by the summer of 2020. The Tribunal recessed the hearing to deliberate the matter at 7:03 p.m. and reconvened the hearing at 7:10 p.m. The Vice Chair stated that upon hearing the statements of the Appellant and Town staff on behalf of The Corporation of the Town of Aurora, and a review of all evidence submitted, it was the decision of the Aurora Appeal Tribunal: Moved by Clarence Lui Seconded by Daniel Lajeunesse 1. That the Notices to Muzzle dated November 19, 2019, for Chloe, Saint Bernard, bearing dog tag C06P98AL, and Joey, Saint Bernard, bearing dog tag C06YGBY0, be confirmed in their entirety with reasons for the decisions to follow pursuant to Rule 23 of Schedule A to By-law No. 5558-13. Carried The Chair advised the Appellant that the conditions of the Muzzle Orders remain in effect for both dogs, Chloe and Joey, and the Tribunal decisions and reasons would be provided to the Appellant in writing within fifteen days.
