BYLAW - Declare Surplus Sell Lands 12 Industrial Pkwy S - 20160712 - 586816THE CORPORATION OF THE TOWN OF AURORA By-law Number 5868-16 BEING A B Y-LA W to declare as surplus and sell municipal lands (12 Industrial Parkway South). WHEREAS section 5(3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended (the "Act") states that a municipal power, including a municipality's capacity, rights, powers and privileges under section 9 of the Act, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; AND WHEREAS The Corporation of the Town of Aurora (the "Town") is the owner of the lands described on Schedule "A" attached hereto and forming part of this By-law (the "Lands"); AND WHEREAS the Town does not require the Lands for municipal purposes and deems it necessary to declare as surplus and sell the Lands; AND WHEREAS on June 7, 2016, the Town entered into an Agreement of Purchase and Sale, as approved by Council on May 17, 2016, respecting the sale of the Lands (the "Agreement"), which Agreement is conditional on the enactment of this by-law; AND WHEREAS the Council of the Town enacted By-law Number4255-01.A on May 8, 2001, being a By-law to provide procedures with respect to the sale of municipal land, which provisions with respect to the sale of the Lands has been adhered to; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: THAT the Lands be and are hereby declared as surplus. 2. THAT the Lands be conveyed in accordance with the Agreement. 3. THAT this By-law shall come into full force and effect on the date of final passage hereof.
