BYLAW - Rezoning 15320 Bayview Ave - 20070626 - 491907DTHE CORPORATION OF THE TOWN OF AURORA By-Jaw Number 4919-07.0 BEING A BY-LAW to amend Bylaw 2213-78, as amended, being the Zoning By-Jaw of the Town of Aurora (15320 Bayview Avenue Holdings Limited) WHEREAS Section 34 of the Planning Act, R.S.O, as amended provides that the Council of a local Municipality may pass a Zoning By-law; AND WHEREAS it is deemed advisable to amend By-law 2213-78; AND WHEREAS the municipal Council of The Corporation of the Town of Aurora deems it necessary and expedient to amend By-law 2213-78, as amended; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law, is hereby amended from "Office Commercial ((H)C6-2) Exception Zone" and "Major Open Space (0-9) Exception Zone" to "Community Commercial Centre (C8-1) Exception Zone" and "Major Open Space (0-9) Exception Zone". 2. THAT the following be added as Section 23.0.4 "Community Commercial Centre (C8-1) Exception Zone". 23.0.4.1 Uses Permitted Banks and/or other financial institutions excluding drive-thru Business and professional offices Clinics Commercial schools Community uses, public institutional uses catering to the needs of the community Fitness centres Dry Cleaner's Distribution Depots Drug Stores Libraries, post offices and government administrative offices Medical and dental laboratories Places of entertainment Religious institutions Restaurants Restaurants, take out Retail stores, excluding building supply outlets and garden centres -Studios -Service shops, light -Service shops, personal -Supermarkets 23.0.4.1.1 Notwithstanding any prov1s1ons to the contrary, Outside Storage and/or Outdoor Display and Sales Areas shall not be permitted. 23.0.4.1.2 Definitions Notwithstanding any provisions to the contrary, for the purposes of the C8-1 Zone the following definitions shall apply: Building Supply Outlet: Means a premises in which building, construction and/or home improvement materials are offered for sale to the public, and may include, as an accessory use, the outdoor storage of such materials along with an outdoor display and sales area, as well as an accessory garden centre. By-law 4919-07.0 Fitness Centre: Means a premises in which facilities are provided for recreational or athletic activities such as body-building, exercise classes, martial arts classes, gymnastics, and may include associated facilities such as a sauna, a swimming pool, a solarium, accessory restaurant, and accessory retail uses, however does not include a body rub parlour. Floor Area, Gross Leasable: Means the gross floor area measured between interior faces of any exterior or interior walls of the building or structure, exclusive of the following areas: i) any service room, or enclosed area that is used exclusively for the accommodation of heating, cooling, ventilation, electrical, mechanical or telecommunications equipment, or maintenance facilities that services the building or structure; ii) any part of the building or structure that is used as loading or parking area; iii) any part of the building or structure used exclusively as common areas, for the purpose of pedestrian circulation between stores or other commercial occupancies. Garden Centre: Means a premises where plant material such as seed fertilizer, bulbs, trees, shrubs and accessory items such as lawn furniture, lawn and garden equipment, furnishings and supplies are sold, and may include as an accessory use, an outdoor display and sales area. Outdoor Display and Sales Area: Means an area of land, used in conjunction with a business located within a building or structure on the same lot, for the display or sale of produce, merchandise or supply of services, however does not include a motor vehicle sales or rental establishment. Outdoor Storage: Means an area of land used in conjunction with a business located within a building or structure on the same lot, for the storage of goods and materials. School, Commercial: Means a premises used for instructing or training in art, business, dance, driving, golf, hairdressing, language, modelling, music, tutoring or like activities for the purposes of remuneration, however does not include a public, private or trade school. 23.0.4.2 Lot Specifications Lot area (minimum) Lot frontage (minimum) 23.0.4.2.1 Siting Specifications Front Yard Bayview Avenue (minimum) Exterior Side Yard from Wellington Street (minimum) Rear Yard (minimum) 3.60 ha 125.0 metres 6.0 metres 5.7 metres 4.5 metres Interior Side Yard (minimum) -as shown on Schedule "AA" to By-law 4919-07.0 attached and in accordance with the following: Building A1 -Building A2 -Building A3 -Building B 0.6 metres 6.0 metres 16.0 metres 17.0 metres 23.0.4.3 Building Specifications Height (maximum) Coverage (maximum): 23.0.4.4 Parking By-law 4919-07.0 13.5 metres 35% Notwithstanding the prov1s1ons of Section 6.26, the parking requirements for the shopping centre shall be a minimum of 5.4 spaces per 100 square metres of gross leasable floor area with the exception that no additional parking shall be required for accessory outdoor restaurant patios. 23.0.4.5 Loading All loading doors shall be appropriately screened and in accordance with the provisions of Section 19.2. 23.0.4.6 Landscaping A strip of land shall be provided adjacent to the entire length of all lot lines which shall be used for no other purpose than landscaping. Notwithstanding the above and the provisions of Section 3.64, for the purposes of this section, such landscaping may include retaining walls, curbs and sidewalks. Access ramps or driveways shall be permitted to cross such landscaping strips, provided they are more or less perpendicular to the street line. The width of the required landscaping strips shall be a minimum of 6.0 metres abutting Bayview Avenue and 3.0 metres abutting all other lot lines. Except for Building A 1 where the minimum landscaping strip abutting the interior side lot line shall be 0.6 metres. 4. THAT no part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof.
