BEING A BY-LAW to amend the
Property Standards By-law 4044-99.P
Related to the Trespass of Light
onto Residential Properties.
WHEREAS Section 15.1 of the Building Code Act, R.S.O. 1997, as amended,
authorizes the passing of a by-law for prescribing standards for the maintenance
and occupancy of property within the municipality;
AND WHEREAS the Council of the Corporation of the Town of Aurora deems it
expedient to amend By-law 4044-99.P to prohibit the trespass of light onto
residential properties within the Town of Aurora;
AND WHEREAS the Town of Aurora has adopted an approved Official Plan, which
includes provisions relating to conditions of maintenance and occupancy of property;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
1. THAT Section 1.2 be amended by the insertion of the following:
1.2.23 (1) "Light Trespass" means the shining of light produced by a lumen
beyond the boundaries of the property on which it is located.
1.2.23 (2) "Luminaire" means a complete lighting system, including a lamp or
lamps and a fixture
2. THAT Section 5.4.2. be deleted in its entirety and that the following be
inserted:
5.4.2. No person shall keep any exterior lighting in a yard, or that part of the yard
that he, she or it occupies or controls, where it is installed and maintained in
such a manner as to allow lighting to trespass in excess of 1.5 foot candles
onto an abutting residential property or into any dwelling unit windows.
