BYLAW - Rezoning 15059 Leslie St - 20060711 - 481006DTown of Aurora The Corporation of the Town of Aurora By-law Number 4810-06.0 BEING A BY-LAWtoamend By-law No. 2213-78, as amended, being the Zoning By-law of the Town of Aurora. (15059 Leslie Street, 014-05-04) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended provides that the Council of a local Municipality may pass a Zoning By-law; AND WHEREAS the Council of the Corporation of the Town of Aurora enacted by-law 2213-78 being the Zoning By-law, as amended; AND WHEREAS the Council of the Corporation of the Town of Aurora deems it advisable to further amend By-law 2213-78, as amended; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Rural General (RU) Zone" and "Rural General (RU-ORM) Zone" to "Business Park Holding (H)(BP) Zone", "Business Park Holding (H)(BP-4(i)) Exception Zone -Specific to By-law 481 0-06.0", "Major Open Space(O) Zone" and "Major Open Space (0-9) Exception Zone." 2. THAT the following be added as the "Business Park Holding (H)BP-4(i) Exception Zone-Specific to By-law 481 0-06.0" as Section 27.0.8.3: SECTION 27.D.8.3 BUSINESS PARK (BP-4(i)) EXCEPTION ZONE - SPECIFIC TO BY-LAW 4810-0G.D The following provisions shall only apply to the lands zoned "Business Park Holding (H)BP-4(i) Exception Zone-Specific to By-law 481 0-06.0" as shown on Schedule "A" By-law No. 4810-06.0: In accordance with Section 27.0.8 with the exception that the maximum permitted Floor Area Ratio for Office Use may be increased from a maximum of 17% to a maximum of 50% provided all of the following provisions have been satisfied: (a) It can be demonstrated that the increase in Floor Area Ratio for Office Use can be supported by the existing and proposed road network. (b) It can be demonstrated that the increase in Floor Area Ratio for Office Use will not have an undue impact on any existing or proposed intersection operations. 3. Holding Prefix Not withstanding any provision to the contrary, while the Holding "(H)" prefix is in place, no person shall within the lands zoned (H)BP and (H)BP-4(i) on Schedule "A" attached hereto, use any lot or erect, alter or use any buildings or structures for any purpose except those uses which existed on the date of passing of this by-law. 4. Removal of Holding Prefix Prior to the passing of a by-law to remove the Holding "(H)" prefix from the lands zoned (H)BP and (H)BP-4(i) or any part thereof, the Town of Aurora shall be satisfied that: i) there is adequate water, sanitary, storm and/or transportation services and facilities available to accommodate the draft plan of subdivision or any phase thereof; ii) all required agreements have been executed between the Owner and the Town of Aurora and can be registered on title; iii) all necessary approvals have been received from all other relevant agencies and/or government bodies; iv) the removal of the "H" represents a logical and orderly progression of development; v) all the relevant policies of Official Plan Amendment 30 have been complied with; and vi) any other such matters as may be deemed appropriate by the Council of the Town of Aurora. Upon removal of the Holding "(H)" prefix from the lands zoned (H)BP and (H)BP- 4(i) pursuant to Section 36 of the Planning Act, RSO 1990, or a successor thereto, the provisions applicable to the said lands shall be as set out in By-law No. 2213-78 and By-law No. 4810-06.0 THAT no part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Explanatory Note Re: Zoning By-law No. 4810-06.0 By-law Number 4810-06.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands from "Rural General (RU) Zone" and "Rural General (RU-ORM) Zone" to "Business Park Holding (H)(BP) Zone" , "Business Park Holding (H)(BP-4(i)) Exception Zone-Specific to By-law 4810-06.0", "Major Open Space (0) Zone" and "Major Open Space (0-9) Exception Zone." The purpose ofthe amendment is to permit for the division of the subject lands in order to allow them to be used for employment and ancillary uses, stormwater management and possible recreational uses. The by-law also contains provisions, which allow for an increase in the maximum permitted Floor Area Ratio for Office Use, subject to conditions. Furthermore, conditions for the removal of the Holding (H) prefix include the confirmation of adequate servicing, the execution of any required agreements and compliance with the policies of the Official Plan.
