BEING A BY-LAW to
amend By-Jaw No. 2213-78,
as amended, being the
Zoning By-Jaw of the Town
of Aurora.

WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended
provides that the Council of a local Municipality may pass a Zoning By-law;
AND WHEREAS the Council of the Corporation of the Town of Aurora enacted by-
law 2213-78 being the Zoning By-law, as amended;
AND WHEREAS the Council of the Corporation of the Town of Aurora deems it
advisable to further amend By-law 2213-78, as amended;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA HEREBY ENACTS AS FOLLOWS:
1. THAT the zoning category applying to the lands shown in hatching in
Schedule "A" attached hereto and forming part of this By-law is hereby
amended from "Row Dwelling Residential (R6-32) Exception Zone" to "Row
Dwelling Residential (R6-32) Exception Zone"
2. THAT the zoning category applying to the lands shown in hatching in
Schedule "A" attached hereto and forming part of this By-law is hereby
amended from "Major Open Space (0)" is changed to "Row Dwelling
Residential (R6-32) Exception Zone"
3. THAT the following delete and replace Section 15.36 "Row Dwelling
Residential (R6-32) Exception Zone"

Notwithstanding the above, this requirement shall not apply to
the following units:
-Block 1-Unit 5, Block 2-Unit 6, shall provide a minimum
distance separation of 12.6 metres between the front of a
building and the side of another building.
-Block 3-Unit 14, Block 4-Unit 15, Block 7-Unit 32, Block 8-
Unit 39. These units shall provide a minimum distance
separation of 13.6 metres between the front of a building and
. the side of another building.

On a corner lot where a daylighting triangle has been conveyed
to a public authority, the minimum required setback from the
daylighting triangle shall equal the required setback from the
front or flankage lot line, whichever is the lesser requirement.

Notwithstanding the provisions of Section 15.3.1.3, a screen wall
and/or fence with a minimum height of 1.83 metres and a
maximum height of 2.0 metres, shall be provided on either side
of the private outdoor living area to a minimum depth of 3.6
metres. All other provisions of Section 15.3 shall apply.
General
In accordance with the provisions of Section 15.4 hereof.
Yard and Setback Encroachments
Notwithstanding the provisions of Section 6.48.1, open-sided one
and two storey roofed porches and balconies, with or without
foundation, may project 2.0 metres into the required distance
separation for the main building from any public street or private
right-of-way provided that the steps of the porches be setback a
minimum of 1.0 metres from the public street or private right-of-
way.
Steps may encroach a maximum of 0.9 metres into the required
distance separation for the main building from any public street
or private right-of-way.
Notwithstanding the provisions of Section 6.48.1, a rear deck
and/or balcony shall be permitted to project a maximum of 3.0
metres and the privacy screen as required by Section 6.48.1
shall only be required for second floor balconies. All other
provisions of Section 6.48.1 shall apply.
3. THAT no part of this By-law will come into force until the provisions of the
Planning Act have been complied with, but subject to such provisions the By-
law will take effect from the day of passing thereof.

Explanatory Note
Re: Zoning By-law No.4813.06.D
By-law Number 4813.06.0 has the following purpose and effect:
To amend Town of Aurora By-law 2213-78, as amended, to change the zoning of the
subject lands from "Row Dwelling Residential (R6-32) (H) Exception Zone" to
"Row Dwelling Residential (R6-32) Exception Zone" and "Major Open Space
(0)" to "Row Dwelling Residential (R6-32) Exception Zone." The effect of this by-
law amendment is to amend the development standards of the (R6-32) and (0) zone
to permit the development of the subject lands for a total of 48 residential town homes
that will have Common Elements Condominium tenure. This by-law amendment also
has the effect of removing the hold provision previously applicable to these lands.
