".· .-. · ... __ ,· THE CORPORATION OF THE TOWN OF AURORA By-law Number 4855-06.D BEING A BY-LAW TO AMEND BY-LAW 4804.06.D TO DESIGNATE AN AREA OF THE TOWN KNOWN AS NORTHEAST OLD AURORA AS A HERITAGE CONSERVATION DISTRICT WHEREAS on June 13, 2006, the Council of the Town of Aurora enacted By-law 4804.06.0 designating the area known as the "Northeast Old Aurora Heritage Conservation District" as a Heritage Conservation District under Part V of the Ontario Heritage Act; AND WHEREAS the Council of the Town of Aurora at its meeting of September 26, 2006 resolved to remove the property known as 120 Centre Street from the Northeast Old Aurora Heritage Conservation District. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the By-law 4804-06. D designating an area known as the "Northeast Old Aurora Heritage Conservation District" as illustrated on Schedule 'A' attached hereto, as a Heritage Conservation District, be amended to exclude the property known as 120 Centre Street; PURSUANT TO DECISION I ORDER NO. 3159 OF THE ONTARIO MUNICIPAL BOARD. SEABORN CALL HELD NOVEMBER 1, 2006 AND The matter before the Board is an appeal by Jacob Drost from a decision by Council for the Town of Aurora to include his property in the boundary of the Northeast Old Aurora Heritage District, as described in By-law 4804-06.D. The purpose of the telephone conference call was to confirm a settlement reached between Mr. Drost and the Town of Aurora (Town) with respect to the appeal. Ms. Pohjola, Counsel for the Town, explained that given the settlement Mr. Drost would not be participating in the call. The amending by-law agreed upon between the parties was included in the Affidavit of Mr. Seaman, a planner with the Town who explained the rationale for the settlement and the direction by Town Council to resolve the matter. The decision of the Board is to allow the appeal in part, and By-law 4804.06.0 of the Town of Aurora is amended in the manner set out in Attachment "1". This is the Order of the Board. ..
