The Corporation of the Town of Aurora By-law Number 4691-05.D BEING A BY-LAW to amend By-law No. 2213-78, as amended, being the Zoning By-law of the Town of Aurora. (289 Wellington Street East D14- 03-05) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended provides that the Council of a local Municipality may pass a Zoning By-law; AND WHEREAS the Council of the Corporation of the Town of Aurora enacted by-law 2213-78 being the Zoning By-law, as amended; AND WHEREAS the Council of the Corporation of the Town of Aurora deems it advisable to further amend By-law 2213-78, as amended; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law, is hereby amended from “Service Commercial (C3) Zone (Urban)” to “Service Commercial (C3-13) Exception Zone (Urban).” 2. THAT the following be added as Section 22.13 “Service Commercial (C3-13) Exception Zone (Urban).” . Section 22.13 SERVICE COMMERCIAL (C3-13) EXCEPTION ZONE (URBAN) (4691-05.D) 22.13.1 Uses Permitted In accordance with Section 22.1 herein, with the addition of a Building Supply Outlet use, including limited outdoor storage. 23.13.2 Zone Requirements 23.13.2.1 Lot Specifications In accordance with Section 22.2.1 herein. 23.13.2.2 Sitting Specifications In accordance with Section 22.2.2. Notwithstanding any provision to the contrary, outdoor storage shall be setback a minimum of 20.0 metres from the southern lot line, 3.0 metres from the western lot line, and be wholly contained behind and to the limit of the width of the main building. All other By-law provisions and requirements respecting outdoor storage shall apply, including appropriate screening and fencing. THAT no part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Explanatory Note Re: Zoning By-law No. 4691-05.D By-law Number 4691-05.D has the following purpose and effect: To amend By-law 2213-78, as amended, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands from “Service Commercial (C3) Zone (Urban)” to “Service Commercial (C3-13) Exception Zone (Urban).” The purpose of this Amendment is to permit a building supply outlet use, including limited outdoor storage, as an additional permitted use within the “Service Commercial Centre” zone solely for the subject lands that are municipally known as 289 Wellington Street East. The By-law will also restrict the location of permitted outdoor building material storage.
