BYLAW - Confirming Council May 24 - 20050412 - 467505DKylemore Homes/ Priestly Holding Corporation The Corporation of the Town of Aurora By-law Number 4675-0S.D BEING A BY-LAW to amend By-law No. 2213-78, as amended, being the Zoning By-law of the Town of Aurora. (File: 014-01-05, 623 Wellington Street East) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended provides that the Council of a local Municipality may pass a Zoning By-law; AND WHEREAS the Council of The Corporation of the Town of Aurora enacted by- law 2213-78 being the Zoning By-law, as amended; AND WHEREAS the. Council of The Corporation of the Town of Aurora deems it advisable to further amend By-law 2213-78, as amended; AND WHEREAS Section 39 of the Planning Act, R.S.O. 1990, c.P.13, provides that the Council of a local municipality may in a zoning By-law authorize the temporary use of land, buildings or structures for any purpose set out therein that is otherwise prohibited by the zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law, is hereby amended. 2. THAT the following shall delete and replace Sections 23.A.10.1 and 23.A.1 0.2.3 of the "Industrial Commercial (H)C5-5 Exception Zone." 23.A.10.1 Uses Permitted In addition to the uses permitted within Section 23.A.1, the lands delineated as (H)C5-5 on Schedule "A" of this by-law may be used for a Temporary Sales Trailer/Office provided that such sales office shall be permitted for a period of time not exceeding April 12, 2008. 23.A.1 0.2.3 Building Specifications Height (maximum) Floor Area Ratio (maximum) Coverage (maximum) 15.0 metres 100.0 percent 35.0 percent 3. THAT the following be added as Section 23.A.10.2.4 to the "Industrial Commercial (H)C5-5 Exception Zone." By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By- law will take effect from the day of passing thereof. Explanatory Note Re: Zoning By-law No. 4675-05.0 By"law Number 4675-05.0 has the following purpose and effect: To amend Town of Aurora By-law 2213-78, as amended, to rezone the subject lands to permit an additional use and associated development standards to the existing "Industrial Commercial (H)C5-5 Exception Zone." The rezoning will permit the use of the lands for a sales trailer for a temporary period not exceeding three years from the date of the passing of the by-law. The Holding provisions of the by-law will continue to apply for the development of the. lands for all other permitted uses and zone standards as prescribed within the "Industrial Commercial C5-5 Exception" zone.
