BYLAW - Building Numbering Reenactment - 20051213 - 474805PTHE CORPORATION OF THE TOWN OF AURORA By-law Number 4748-05.C BEING a BY-LAW to provide for the numbering of buildings and lots in the Town of Aurora. WHEREAS the provisions of Section 116 of the Municipal Act, R.S.O., 2001, as amended, authorizes the Town of Aurora to enact by-laws for the numbering buildings and lots that it considers necessary to number; NOW, THEREFORE, THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: PART I GENERAL PROVISIONS 1.1 Definitions For the purposes of this By-law the following definitions shall apply: i) "Building" means any structure used or intended to be used for supporting or sheltering any use or occupancy. ii) "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof, and for the purposes of this By-law includes a private street. iii) "Multi-unit property" means a building or property containing more than one occupancy, residential, mercantile, commercial, industrial or recreational in nature, and includes covered and open malls, high-rise and multi-level buildings, industrial malls and commercial parks. iv) "Occupant" means any person, firm, agent or corporation having control over and/or legal occupancy within any portion of the building or property under consideration, and for the purposes of this By-law includes tenants. v) "Owner" means any person, firm or corporation having legal ownership over any portion of the building or property under consideration. vi) "Property type" includes commercial, industrial, mercantile, and residential and means those types of property uses as referred to in the Ontario Building Code and Ontario Fire Code. vii) "Record" means the official Street Number Record for the Town of Aurora. viii) "Reflective plate" means a plate or sign on which is affixed numerals identifying the property street number, and which shall satisfy the requirements of this By-law. ix) "Rural" refers to those areas in the Town of Aurora as defined in Schedule "A" which shall form part of this By-law. x) "Street number" means the street number for a property as entered in the official Street Number Record for the Town of Aurora. xi) "Town" means the Corporation of the Town of Aurora. By-law Number 4748-0S.P Page 2 of6 xii) "Urban" refers to all other areas in the Town of Aurora that are not included in Schedule "A" to this By-law. PART II URBAN AREA 2.1 Part II respecting Urban Area shall apply to every property in the Town, except as provided for in Part Ill respecting Rural Areas of this By-law. 2.2 No street number for any property shall be posted other than the official street number appearing in the Record lodged at the municipal offices of the Town. 2.3 Every owner shall affix or cause to be affixed the street number for any property in accordance with the following General Criteria: (A) No owner shall affix or cause to be affixed the street number for any property solely onto a landscape feature (naturally or artificially placed), or any other decorative feature on the property that may be covered or obscured by weather or snowfall. (B) Every owner shall ensure that the numerals used to indicate the street number for any property is of sufficient and adequate clarity, font, and contrasting colour from the property to ensure legibility at all times from the highway. (C) Every owner and/or occupant shall ensure that the street number for any property is displayed in such a manner so as to ensure clear understanding for which building or occupancy said street number represents. (D) Every owner shall ensure that in cases whereby the street number for any property is displayed in a location where changing light conditions may restrict or reduce the visibility of the street number from the public street: (1) The street number shall be artificially illuminated from that time between thirty (30) minutes before sunset until thirty (30) minutes after sunrise, and during any other times when natural illumination is reduced; or (2) The street number characters are coated in or constructed of a reflective material or finish that adequately and deliberately reflects any light source beamed upon it. (E) No street number shall be affixed to any property of the Town or a Public Utility including a street lamp pole, telephone pole, or hydro pole. (F) Every owner of a building shall affix or cause to be affixed the street number in accordance with the provisions of this By-law prior to the initial occupancy of the building. 2.4 In addition to the criteria noted in Part I respecting General Provisions of this By- law, the following specific criteria shall apply to all residential properties including detached, semi-detached and row house buildings: (A) The dimensions of the numerals of a street number shall not be less than 15 centimetres (6 inches) in height. (B) The street number shall be affixed to the wall of a building that the main entrance faces in such a manner that it is visible and readable at all times from the highway. (C) Every property that is also accessible from a rear alleyway or service roadway or private roadway or street shall ensure that the official street number for such property is also affixed to either a rear wall of the building or to an equally suitable structure in order to ensure clear visibility of the street number at all times from that rear alleyway or service roadway or private roadway or street. BY"Iaw Number 47 48•05.P Page 3 of6 (D) Where a building is situated further than 30 metres (98 feet) from a highway, the owner shall display the street number in accordance with the following: (i) The street number shall be affixed to an appropriate fixture facing the highway placed within 6 metres (20 feet) of the highway in compliance with the specifications listed in the General Provisions of this By-law. (ii) The distance between the post supporting the plate and the centreline of the principal access driveway shall not exceed 6.0 metres (20 feet). (iii) The distance between the post supporting the plate and the right of way of the highway shall not exceed 5.0 metres (16 feet). (iv) The dimensions of the numerals of a street number shall be a minimum of 15 centimetres (6 inches) in height (v) The street number shall be posted at a minimum level of 1 metre (3 feet) above the grade of the adjoining highway or other applicable pedestrian traffic routes. 2.5 In addition to the criteria noted in Part I respecting General Provisions of this By- law, the following specific criteria shall apply to all multi-unit residential properties having a common or singular entrance: (A) The dimensions of the numerals of a street number shall not be less than 20 centimetres (8 inches) in height. (B) The street number shall be affixed to the wall of the building that is closest to the highway of the assigned street address number, at a minimum height of 3 metres (1 0 feet) and a maximum height of 15 metres (49 feet). The specific location of the street number shall be determined through the Site Plan Agreement process. (C) Every property that is accessible from a rear alleyway or service roadway or private roadway or street shall ensure that the official street number for such property is also affixed to either a rear wall of the building or to an equally suitable structure in order to ensure clear visibility of the street number at all times from that rear alleyway or service roadway or private roadway or street. (D) Multi-unit residential buildings having common points of access shall be assigned a single street number by the Planning Department. Sub-units within these structures shall be assigned a unit number by the Fire Department. (E) The street number for the property itself shall be displayed in such a manner so as to ensure clear visibility from the street in· accordance with section 2.3 of this By- law, and each sub-unit contained in or on that property shall be clearly identified with a separate unit number as approved by the Fire Department. 2.6 In addition to the criteria noted in Part I respecting General Provisions of this By- law, the following specific criteria shall apply to all commercial properties including industrial, institutional, and mercantile buildings: (A) The dimensions of the numerals of a street number shall not be less than 20 centimetres (8 inches) in height. (B) The street number shall be affixed to the wall of the building that is closest to the highway of the assigned street address number, at a minimum height of 3 metres (10 feet) and a maximum height of 15 metres (49 feet). The specific location of the street number shall be determined through the Site Plan Agreement process. (C) Every property that is accessible from a rear alleyway or service roadway or private roadway or street shall ensure that the official street number and unit numbers for such property is affixed to either a rear wall of the building or to an By•law Number 47 48-0S.P Page 4 df6 equally suitable structure in order to ensure clear visibility of the street number and unit numbers at all times from that rear alleyway or service roadway or private roadway or street. (D) Commercial, industrial, and institutional buildings shall have a street number assigned on a single detached building basis by the Planning Department. Sub-units within these structures shall be assigned a unit number by the Fire Department (E) The street number for the property itself shall be displayed in such a manner so as to ensure clear visibility from the street in accordance with section 2.3 of this By- law, and each sub-unit contained in or on that property shall be clearly identified with a separate unit number as approved by the Fire Department PART Ill RURAL AREAS 3.1 Part Ill respecting Rural Areas shall apply to every property in the Town that is listed in Schedule "A" of this By-law. 3.2 No street number for any property shall be posted other than the official street number appearing in the Record lodged at the municipal offices of the Town. 3.3 Every owner shall affix or cause to be affixed a reflective plate indicating the number assigned to the property in the Record of the Town .. 3.4 Every reflective plate shall be erected in accordance with the following standards: (A) The characteristics of the reflective plate shall conform to the following: (1) Numerals shall be a minimum of 10 centimetres (4 inches) and a maximum of 15 centimetres (6 inches) in height. (2) The reflective plate shall be of reflective material with white reflective numerals and such numerals shall contrast with the plate, so that the street numbers are clearly visible from the highway when illuminated by the headlights of a motor vehicle. (3) The street numbers shall be affixed to each side of the reflective plate. (4) The dimensions of the reflective plate shall be a minimum of 11 centimetres (4.5 inches) in height and a minimum of 16.5 centimetres (6.5 inches) in length. (B) The distance between the post supporting the reflective plate and the centreline of the principal access driveway shall not exceed 6.0 metres (20 feet). (C) There shall be a right angle alignment to the highway on which the street number has been assigned, and the view of the reflective plate shall not be obstructed by objects placed or planted on or adjacent to the highway. (D) The distance between the post supporting the plate and the right of way of the highway shall not exceed 5.0 metres (16 feet). (E) The reflective plate shall be posted on the same side of the highway as the property to which the street number has been assigned. (F) The reflective plate shall be erected not less than 1.4 metres (4.6 feet) below the average grade of the property directly in front of the reflective plate and the top of the reflective plate. 3.5 The owner shall ensure that in conditions of a high build up of either snowdrift or snow banking due to snow plowing, the street number sign shall be cleared to permit clear view of the street number sign from the highway within twelve (12) hours of the snowfall or snow banking. PART IV SCHEDULES By"/aw Number 47 48•05.P Page 5 of6 That Schedule "A" attached hereto shall form part of this By-law. PART V APPLICATION 4.1 For the purposes of this By-law those properties that were in existence prior to this By-law coming into full force and effect shall be regulated by By-law 3293-91. PART VI ENFORCEMENT 5.1 If the owner fails to install and maintain a street number on a property pursuant to the provisions of this By-law, the Town may affix numbers to the buildings and charge the owner or occupant with the expenses incident to the numbering of the lot or property. 5.2 Every person who contravenes any provision of this By-law is guilty of an offence and is liable upon conviction to a fine of not more than five thousand dollars ($5,000.00), exclusive of costs for each offence. Such fines are recoverable pursuant to the provisions of the Provincial Offences Act, R.S.O. 1990, Chap. P.33. PART VII REPEAL 6.1 THAT By-law 4004-98 is hereby repealed. PART VIII SHORT TITLE This By-law may be referred to as the "Street Numbering By-law". PART IX ENACTMENT 6.1 THAT the provisions of this By-law shall come into force and take effect upon third reading thereof. READ A FIRST AND SECOND TIME THIS 131h DAY OF DECEMBER 2005.
