BEING A BY-LAW to
amend By-law No. 2213-78,
as amended, being the
Zoning By-law of the Town
of Aurora.

WHEREAS Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended
provides that the Council of a local Municipality may pass a Zoning By-law;
AND WHEREAS the Council of the Corporation of the Town of Aurora enacted by-
law 2213-78 being the Zoning By-law, as amended;
AND WHEREAS the Council of the Corporation of the Town of Aurora deems it
advisable to further amend By-law 2213-78, as amended;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA HEREBY ENACTS AS FOLLOWS:
1. THAT the zoning category applying to the lands shown in hatching on
Schedule "A" attached hereto and forming part of this By-law, is hereby
amended from "Service Commercial (C3) Zone (Urban)" and a portion of the
"Open Space (0) Zone" to "Central Commercial Residential (C2-14) Exception
Zone."
2. THAT the following be added as Section 21.16 "Central Commercial
Residential (C2-14) Exception Zone."
Section 21.16. Central Commercial Residential (C2-14) Exception
Zone
The lands shown zoned C2-14 on Schedule "A" shall be used in accordance
with the provisions of Section 21.16 provided the following:
21.16.1 Uses Permitted
The following uses shall be permitted:
-banks or financial establishments;
business and professional offices, excluding medical;
-dry cleaner's distribution depots;
personal service shops;
-travel agencies;
retail stores excluding supermarkets and warehouse drugstores;
-data processing centres;
-studios; and,
-dwellings units above the first storey to a maximum of 61 units.
The floor area of the above commercial uses shall not exceed 500 square
metres.

Zone Requirements
Siting Specifications
Notwithstanding the provisions of Section 6.40, the following
setbacks shall apply:
Side Yard:
Front Yard (minimum):
Rear Yard (minimum):
0 metres
3 metres
20 metres
Nothwithstanding any provisions to the contrary, the front lot line
shall be the lot line abutting Yonge Street.
Building Specifications
Height (maximum): 5 storeys
Nothwitstanding the provisions of this section, the requirement
for the fourth and fifth storeys to be setback a minimum of 3
metres from the main front and exterior side walls of the third
storey shall not apply.
Landscaping Requirements
A minimum 1.5 metre wide landscape buffer shall be provided
along the front and rear property lines, except at approved
access locations.
Parking
A minimum of 118 parking spaces shall be provided.
Notwithstanding the provisions of section 6.26, manoeuvring
space for the parking spaces provided shall be 6.4 metres.
Loading
Shall be provided in accordance with section 19.2.
21.16.2.5 Yard Encroachments
The second level parking deck associated with the structure on
this property will be permitted to encroach a maximum of
14 metres into the required rear yard setback.
3. THAT no part of this By-law will come into force until the provisions of the
Planning Act have been complied with, but subject to such provisions the By-
law will take effect from the day of passing thereof.

Re: Zoning By-law No. 4676-05.0
By-law Number 4676-05.0 has the following purpose and effect:
To amend Town of Aurora By-law 2213-78, as amended, to rezone the subject lands
from "Service Commercial (C3) Zone Urban" and "Open Space (0) Zone" to "Central
Commercial Residential (C2-14) Exception Zone." The rezoning will permit the use
of the lands for a five-storey building containing commercial uses on the first floor and
residential uses above.
