BYLAW - Amend Zoning McGrath Hunter - 20040430 - 452204D(McGrath-Hunter) THE CORPORATION OF THE TOWN OF AURORA By-law Number 4522-04.0 BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78, as amended. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. THAT the zoning category applying to the lands known as Part of Lot 17, R.P. 68 and Lot 164 & Part of Lots 163 & 165, R.P. 246 (15,085 Yonge Street) as shown in shading on Schedule "A" attached hereto and forming part of this By-law No. 4522-04.0 is hereby amended from "Central Commercial (C2-6) Exception Zone" and "Environmental Protection (EP-5) Exception Zone" to "Second Density Apartment Residential (RA2-3) Exception Zone" and "Environmental Protection (EP-5) Exception Zone", more particularly described on Schedule "A" attached hereto and forming· part of this by-law. 2. THAT Section 17 is hereby amended by adding the following as Section 17.5 "Second Density Apartment Residential (RA2-3) Exception Zone". Zone 17.5 Second Density Apartment Residential (RA2-3) Exception 17.5.1 17.5.2 Notwithstanding any other provisions of By-law No. 2213-78 as amended, the following special provisions shall apply to the lands known as Part of Lot 17, R.P. 68 and Lot 164 & Part of Lots 163 & 165, R.P. 246 (15,085 Yonge Street) as shown in shading on Schedule "A" attached hereto and forming part of this By-law No. 4522-04.D: Uses Permitted The lands shown zoned RA2-3 on Schedule "A" shall be used· in accordance with the following provisions: -one apartment building Zone Requirements For the purposes of the RA2-3 Zone, the following development standards shall apply: 17 .5.2.1 Lot Specifications Lot Area (minimum) Lot Frontage (minimum) 3300 square metres 55 metres 17.5.2.2 ,_,_. 17.5.2.3 17.5.2.4 17.5.2.5 ', ·----- 17.5.3 -2- Siting Specifications Front Yard (minimum) 0.0 metres Interior Side Yard (minimum) South Yard 6.0 metres North Yard 7.0 metres Rear Yard (minimum) 15.0 metres Notwithstanding the above, the third storey shall be set back a minimum of 1.5 metres from the main front wall of the ground floor and the fourth and fifth storeys shall be set back a minimum of 3 metres from the main front wall of the third storey. Building Specifications Floor Area (maximum) 4200 square metres Lot Coverage (maximum) 36% Height (maximum): 5 storeys Density i) Apartment Dwelling-42 units maximum Amenity Area Notwithstanding the provisions of Section 7.2, a minimum of 18.0 square metres per dwelling unit of amenity area shall be located either exterior or interior to the building. General Buffer Strip Notwithstanding the provisions of Section 6.31, the required planting strip shall be nil along the southern property line. Parking Notwithstanding the provisions of 6.26.1.2, a minimum of 1.47 parking spaces per dwelling unit shall be provided. A minimum of 20 percent of the spaces provided shall be set aside for and visually identified as visitors' parking. Notwithstanding the provisions of 6.26, the minimum required maneuvering area shall be 6.2 metres. Notwithstanding the provisions of 6.27.6, there shall be no minimum distance requirement between any wall of a building and a parking space maneuvering area· and/or driveway located within a side yard or rear yard. -3- 3. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. READ A THIRD TIME AND FINALLY PASSED THIS 30TH DAY OF APRIL, 2004. ~------- Explanatory Note Re: Zoning By-law No. 4522-04.0 By-law Number 4522-04.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands being Part of Lot 17, R.P. 68, and Lot 164, and Part of Lots 163 & 165, Plan 246, municipally known as 15,085 Yonge Street from "Central Commercial (C2-6) Exception Zone" and "Environmental Protection (EP- 5) Exception Zone" to "Second Density Apartment Residential (RA2-3) Exception Zone" and "Environmental Protection (EP-5) Exception Zone". The subject lands are zoned for a five storey mixed use building incorporating commercial uses on the ground floor and 30 residential apartment units above. By-law 4522-04.0 would no longer require any commercial floor space to be located within the building and would permit a maximum of 42 residential apartment units. By-law 4522-04.0 also incorporates a site specific parking ratio of 1.47 spaces per dwelling unit, whereas the current by-law requires 1.5 spaces per unit. In addition, there are site specific development standards including a minimum amenity area per unit and a minimum maneuvering space for the parking area. There are no changes to the "Environmental Protection (EP-5) Exception Zone" applicable to the lands. P.13, as amended. I also certify that the 20 day appeal period expired on the 25th day of May, 2004, and to this date no notice of appeal of the By-law has been filed by any person in the office of the Clerk.
