BYLAW - Rezoning Andy Theresa Smith - 20030422 - 440203D(Andy and Theresa Smith) THE CORPORATION OF THE TOWN OF AURORA By-law Number 4402-03.0 BEING A BY-LAW to amend By-law 2213-78 WHEREAS it is deemed advisable to amend By-law 2213-78; AND WHEREAS the municipal Council of the Corporation of the Town of Aurora deems it necessary and expedient to amend By-law 2213-78, as amended; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT the zoning category applying to the lands shown in hatching on Schedule "A" and Schedule "AF" attached hereto and forming part of this By-law is hereby amended from "Holding (H) Zone" to "Detached Dwelling First Density Residential (R1-35) Exception Zone", "Detached Dwelling First Density Residential (R1-36) Exception Zone" and "Detached Dwelling First Density Residential (R1-37) Exception Zone". 2. THAT the following be added as Section 10.37 "Detached Dwelling First Density Residential (R1-35) Exception Zone". Section 10.37 Detached Dwelling First Density Residential (R1-35) Exception Zone 10.37.1 10.37.2 Notwithstanding the provisions of Section 1 0.2.2 respecting the interior side yard for the lands zoned R1-35, the minimum interior side yard setback for the frame shed existing as of the date of the passing of this by-law, shall be a minimum of 0. 7 metres from the southern lot line. THAT the following be added as Section 10.38 "Detached Dwelling First Density Residential (R1-36) Exception Zone". Section 10.38 Detached Dwelling First Density Residential (R1-36) Exception Zone 10.38.1 10.38.2 Notwithstanding the provisions of Section 1 0.2.2 respecting the interior side yard for the lands zoned R1-36, the minimum interior side yard setback for the attached garage existing as of the date of the passing of this by-law, shall be a minimum of 0.8 metres from the southern lot line. Notwithstanding any provisions to the contrary, the minimum exterior side yard setback from the northern boundary of Part 4, 65R-2581 0, shall be 6.0 metres as shown on Schedule "AF". 10.38.3 Lot Specifications Lot Area (minimum) Lot Fronage (minimum) (Andy and Theresa Smith) 1660.0 metres square 22.0 metres 4. THAT the following be added as Section 10.39 "Detached Dwelling First Density Residential (R1-37) Exception Zone". Section 10.39 Detached Dwelling First Density Residential (R1-37) Exception Zone 10.39.1 10.39.2 Notwithstanding any provision to the contrary, for the purposes of the R1-37 Zone, Aurora Heights Drive or a reserve abutting Aurora Heights Drive, shall be deemed to be the front lot line. Notwithstanding the provisions of Section 10.2.3 respecting height and floor area for the lands zoned R1-37, the maximum height for the main building shall be 8.0 metres and the minimum floor area of a one (1) storey building shall be 180.0 square metres and a two (2) storey building shall be 200.0 square metres 5. THAT no part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof.
