BYLAW - Removal of Holding Prefix (H) Home Depot - 20030304 - 440703D\ THE CORPORATION OFTHE TOWN OF AURORA By-law Number 4407-03.0 BEING A BY-LAW to amend By-law 2213-78 (Home Depot) WHEREAS the lands affect by this By-law are subject to a Holding (H) prefix in conjunction with a zoning category, as permitted under Section 34 and 36 of the Planning Act, R.S.O. 1990; AND WHEREAS Council is satisfied that the conditions for the removal of the Holding "(H)" prefix have been met in respect of the subject lands; AND WHEREAS the municipal Council of the Corporation of the Town of Aurora deems it necessary and expedient to amend By-law 2213-78, as amended; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT the "(H)" prefix preceding the "Enclosed Shopping Centre Commercial (CB) Zone", applying to the lands shown on Schedule "A" attached hereto and forming part of this By-law, is hereby removed. 2. THAT the provisions of this By-law shall come into force and be effective upon final passage thereof. READ A FIRST, SECOND AND THIRD TIME THIS 4th DAY OF MARCH 2003. RU [8] Holding Protection [Q] Mojor Ope11 Space SCHEDULE "A" TO BY-LAW NO. 4407-03.0 Explanatory Note Re: Zoning By-law No. 4407-03.0 By-law Number 4407-03.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora "Enclosed Shopping Centre Commercial (C8) Zone", by removing the Holding provision to facilitate the development of a building supply outlet and garden center, being Part of Lot 81, Concession 1 EYS, more particularly described as Part 1, 65R-22010. WELLINGTON STREET EAST Town of Aurora 100 John West Way Box No. 1000 Ayrora, Ontario L4G 6)1 Tel: (905) 727-1375 PASSAGE OF AMENDING BY-LAW UNDER SECTION 36 OF THE PLANNING ACT I, Bob Panizza, hereby certify that the notice of Council's intention to consider passing an amending by-law under section 36 of the Planning Act to remove the holding prefix was given on the 11th day of February, 2003, in the manner and form and to the persons prescribed by Ontario Regulation 199/96, as amended, made by the Lieutenant Governor- in-Council under subsection 36(4) of The Planning Act. By-law # 4407-03.0 of the Corporation of the Town of Aurora, was passed by the Council of the Corporation on the 4th day of March, 2003.
