BEING A BY-LAW to dedicate certain
lands as public highway on Registered
Plans 65M-3497 forming part of
Dovercourt Lane, Watkins Glen
Crescent, Kirkva/ley Crescent,
Birkshire Drive, Turnbridge Road,
Valemount Way, Haverhill Terrace,
Chippingwood Manor, and Bridgenorth
Drive.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) authorizes the Council of a local municipality to pass by-laws to establish and
lay out lands as public highways;
AND WHEREAS it is now deemed expedient to enact a new By-law to dedicate certain
lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora
ENACTS AS FOLLOWS:
1. THAT the lands described as Blocks 258 and 291, Plan 65M-3497, Town of
Aurora, Regional Municipality of York, be and are hereby dedicated as a public
highway forming a part of Dovercourt Lane in the Town of Aurora.
2. THAT the lands described as Blocks 259,260 and 305, Plan 65M-3497, Town of
Aurora, Regional Municipality of York, be and are hereby dedicated as a public
highway forming a part of Watkins Glen Crescent in the Town of Aurora.
3. THA Tthe lands described as Blocks 262, 263, 265, 280, 303, 304 and 309, Plan
65M-3497, Town of Aurora, Regional Municipality of York, be and are hereby
dedicated as a public highway forming a part of Kirkvalley Crescent in the Town
of Aurora.
4. THAT the lands described as Blocks 279 and 298, Plan 65M-3497, Town of
Aurora, Regional Municipality of York, be and are hereby dedicated as a public
highway forming a part of Birkshire Drive in the Town of Aurora.
5. THAT the land described as Block 283, Plan 65M-3497, Town of Aurora,
Regional Municipality of York, be and is hereby dedicated as a public highway
forming a part of Turn bridge Road in the Town of Aurora.
6. THAT the land described as Block 284, Plan 65M-3497, Town of Aurora,
Regional Municipality of York, be and is hereby dedicated as a public highway
forming a part of Valemount Way in the Town of Aurora.
7. THAT the land described as Block 287, Plan 65M-3497, Town of Aurora,
Regional Municipality of York, be and is hereby dedicated as a public highway
·forming a part of Haverhill Terrace in the Town of Aurora.
8. THAT the land described as Block 288, Plan 65M-3497, Town of Aurora,
Regional Municipality of York, be and is hereby dedicated as a public highway
forming a part of Chippingwood Manor in the Town of Aurora.

RECOMMENDATIONS
THAT By-law 4403-03.T, being a by-law to dedicate certain lands as public highway
on Registered Plan 65M-3497 forming part of Dovercourt Lane, Watkins Glen
Crescent, Kirkvalley Crescent, Birkshire Drive, Turnbridge Road, Valemount Way,
Haverhill Terrace, Chippingwood Manor, and Bridgenorth Drive in the Town of
Aurora, be provided three readings.
BACKGROUND
The subject lands are located within the Phase 1 development of the Bayview-Wellington
subdivision located north of Hollandview Trail that .is now completed. On December 17,
2002, the Town received a request from Bayview-Wellington Management Inc. to dedicate
as public highway certain 0.3 metre reserves located within Phase 1 (Pian.65M-3497) that
were conveyed to the Town through the subdivision process in order to control the future
development of certain blocks as well as the extension of certain roads within the
development.
COMMENTS
The Public Works Department confirmed that Blocks 271 and 274 on Plan 65M-3497,
which are located along Gateway Drive within Phase 3 of the subdivision, should not be
dedicated as public highway until registration of the Phase 3 subdivision plan is completed.
The Public Works Department have no concerns with dedicating the remainder of the
reserves as public highway that were requested by Bayview-Wellington Management Inc.

OPTIONS
Council may choose not to dedicate the lands identified as public highway even though
they are currently being used as municipal roads.
CONCLUSIONS
Staff recommend that Council enact By-law 4403-03.T, to formally dedicate the subject
lands as public highway since they are currently being. used as part of municipal roads.
FINANCIAL IMPLICATIONS
The Town is responsible for the costs associated with the registration of the By-law.

Further to your December 23, 2002 memo and our recent conservation on this matter, the two reserves on Gateway Drive
(Blocks 271 and 274) should not be lifted until the Phase Ill plan has been registered. The other reserves, which surround

Further to your December 23, 2002 memo and our recent conservation on this matter, the two reserves on Gateway
Drive (Blocks 271 and 274) should not be lifted until the Phase Ill plan has been registered. The other reserves, which
surround the blocks of Phase II lands that are located inside Phase I, can all be lifted at this time.

Blocks 264,266 and 267, Plan 65M-3573
The above-noted blocks are zoned R6-46 and the zoning does not provide for the exterior side
yard setback to include the 0.3m reserve. Accordingly, the survey submitted for Block 264 by
Arista Homes identifies setbacks for the end units that do not comply with the Town of Aurora's
Zoning By-law #2213-78. Please note that the survey submitted for Block 265 complies.
There are two reserves on each of the end units being Blocks 259 & 286 abutting Watkins Glen
Crescent and Blocks 182 and 291 abutting Dovercourt Lane. Our office has checked with the
Public Work's Department and has been advised that these reserves are not required. By lifting
these reserves and adding the lands to Block 264, it would bring the property into compliance
with the zoning by-law.
Please contact Janet Van Scheyndel of Legal Services to initiate the process for lifting the
reserves. If you do not wish to pursue the above recommendation; minor variances are required
for both end units on Block 264.
The same predicament may also apply to Blocks 266 and 267, however Bayview-Wellington
Homes has not yet provided the Town with the surveys.
