BYLAW - Close and Sell Centre and Mills St - 20031216 - 448003TTHE CORPORATION OF THE TOWN OF AURORA By-law Number 4480-03. T BEING A BY-LAW to close and sell Mill Street and a portion of Centre Street lying east of Industrial Parkway North in the Town of Aurora. WHEREAS Sections 34 and 268 of the Municipal Act 2001, S.O. 2001, c.25, as amended authorize the Council of a local municipality to pass by-laws for the closure of highways and the sale of municipal land; AND WHEREAS the Municipal Council of The Corporation of the Town of Aurora enacted By-law 4255-01.A to provide procedures with respect to the sale of municipal land. AND WHEREAS the Municipal Council of the Corporation of the Town of Aurora deems it necessary and expedient to close Mill Street and a portion of Centre Street and convey same to the adjoining owners in exchange for the acquisition of lands from the adjoining owners approved through the enactment of By-law 4479-03.L; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. That the lands described in Schedule "A" attached hereto (hereinafter the "Roads") be closed to vehicle and pedestrian traffic. 2. That the Roads be declared surplus. 3. That the Roads be conveyed to the adjoining owners, reserving such easements for utilities and services as may be required and subject to the terms and conditions set out in Town of Aurora Reports ADM03-019 and ADM03-023. 3. THAT the Mayor and Clerk are hereby authorized to execute all documentation required in connection with the closure and sale of the Roads. 3. That Schedule "B" attached hereto, being a form of affidavit, be sworn by the Town Clerk setting out the procedures taken by the municipality to close and sell the Roads in accordance with the requirements of the Municipal Act 2001, S.O. 2001, c.25, as amended and the provisions of By-law 4255-03.A. 4. That the provisions of this By-law shall come into force and effect upon third reading thereof, and after a copy of this By-law has been registered in the Land Registry Office for the Land Registry Division of York Region (No. 65). That I am the Town Clerk of The Corporation of the Town of Aurora (the "Town") and as such have knowledge of the matters hereinafter deposed to. 2. That By-law No. 4480-03.T authorizing the closure and sale of the lands described in Schedule "A" thereto (hereinafter the "Roads") was enacted on the 16th day of December, 2003. 3. That The Corporation of the Town of Aurora provided the applicable public notice of the proposed closure and sale of the Roads by publishing notice in the Era Banner newspaper on November 25 and December 4, 2003. 4. That to the best of my knowledge and belief, the procedures required in accordance with the Municipal Act 2001, S.O. 2001, c.25, as amended and the provisions of By- law 4255-03.A respecting the closure and sale of the Roads were complied with.
