TOWN OF AURORA ZONING BY-LAW AMENDMENT REGARDING THE : OAK RIDGES MORAINE CONSERVATION PLAN CORPORATION OF THE TOWN OF AURORA By-Law Number 4469-03.0 BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law Number 2213-78, to rezone those lands within the Town of Aurora, which are located within the Oak Ridges Moraine Conservation Plan Area, in order to implement the provisions of that Plan; NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. THAT Schedule "A" is hereby amended by changing the zoning categories applying to those lands within the Oak Ridges Moraine Conservation Plan Area, shown in shading on Schedule "A-1" attached hereto and forming part of this By- law from: Rural Residential (RR) Zone, including the following exceptions thereto being RR-3, RR-5, RR-6, RR-10, and RR(3774-96) Zones contained within Section 8; Estate Residential (ER) Zone, including the following exception thereto being ER-1 Zone contained within Section 9; Restricted Industrial (M1-4) Zone contained within Section 25; Rural (RU) Zone, including the following exceptions thereto being RU-3, RU-4, RU-9, RU-10, RU(2401-80), RU(2441-81)and RU(2583-83)Zones contained within Section 29; Environmental Protection (EP) Zone, including.any applicable Exceptions thereto contained within Section 30; Major Open Space (0) Zone, including the following exceptions thereto being (0-8), and (0-13) Zones contained within Section 31; and substituting therefore the following: Rural (RU-ORM) Zone; Rural (RU-3-0RM) Zone; Rural (RU-4-0RM) Zone; Rural (RU-9-0RM) Zone; Rural (RU-10-0RM) Zone; Rural (RU-ORM)(2401-80) Zone; Rural (RU-ORM)(2441-81) Zone; Rural (RU-ORM)(2583-83) Zone; Rural Residential (RR-ORM) Zone; Rural Residential (RR-3-0RM) Zone; October 22, 2003 Rural Residential (RR-5-0RM) Zone; Rural Residential (RR-6-0RM) Zone; Rural Residential (RR-10-0RM) Zone; Rural Residential (RR-ORM)(3774-96) Zone; Estate Residential (ER-ORM) Zone; Estate Residential (ER-1-0RM) Zone; Restricted Industrial (M1-4-0RM) Zone; Major Open Space (0-0RM) Zone; Major Open Space (0-13-0RM) Zone; Oak Ridges Moraine Environmental Protection (EP-ORM) Zone; Oak Ridges Moraine Natural Core Area (NC-ORM) Zone; as outlined on Maps 2, 4, 5, 6, 7, 8, 9, and 10 of Schedule "A" attached hereto, and forming part of this By-law. 2. THAT "SECTION 3 DEFINITIONS" is hereby amended by inserting the following paragraph and title immediately following the title of "SECTION 3: DEFINITIONS": "Part A of this section contains terms and definitions which shall apply throughout the defined area of the By-law. Part B of this section contains additional terms and definitions which shall also apply within the area designated as Oak Ridges Moraine Conservation Plan Area on the maps comprising Schedules "A", "B", "C", "D", and, "E", attached hereto and forming part of this By-law. Where there is any conflict between the definitions in Part B, and those in Part A, the definitions in Part B shall prevaiL PART 3A-GENERAL DEFINITIONS" 3. THAT "SECTION 3 DEFINITIONS" is hereby amended by adding the following new Part B -OAK RIDGES MORAINE CONSERVATION PLAN AREA DEFINITIONS to SECTION 3: DEFINITIONS: "PART 38 -OAK RIDGES MORAINE CONSERVATION PLAN AREA DEFINITIONS 38.1 Agricultural-Related Uses: means commercial and industrial uses that are, (1) small-scale, (2) directly related to a farm operation, and (3) required in close proximity to the farm operation. 38.2 Aguifer Vulnerability: means an aquifer's intrinsic susceptibility, as a function of the thickness and permeability of overlying layers, to contamination from both human and natural impact on water quality. October 22, 2003 38.3 38.4 Bulk Storage Tank: means a tank or container for the bulk storage of petroleum, gasoline, diesel or other fuels, oil, gas, propane, or flammable liquid or fluid, but does not include a container for flammable liquid, gas or fluid legally and properly kept in a retail store or a tank for storage incidental to some other use of the premises where the such tank or container is located. Development: means the creation of a new lot, a change in land use, or the construction of buildings and structures, any of which require approval under the Planning Act, the Environmental Assessment Act, or the Drainage Act, but does not include, (1) the construction by a public body, of facilities for transportation, infrastructure and utilities uses, as described in Section 41, of the Oak Ridges Moraine Conservation Plan, or (2) the reconstruction, repair or maintenance of a drain approved under the Drainage Act and in existence on November 15, 2001, or (3) the carrying out of agriculture practices on land that was being used for agricultural uses on November 15, 2001. 38.5 Existing: means lawfully in existence on November 15, 2001, and for greater certainty does not include a use, building or structure that is in existence on that date without being lawful. 38.6 Forest Management: means the management of woodlands, including accessory uses such as the construction and maintenance of forest access roads and maple syrup production facilities, (1) for the production of wood and wood products, including maple syrup, (2) to provide outdoor recreation opportunities, (3) to maintain, and where possible improve or restore, conditions for wildlife, and (4) to protect water supplies. 38.7 Hazardous Waste: has the same meaning as in Regulation 347 of the Revised Regulations of Ontario, 1990. 38.8 Hydrologically Sensitive Feature: means land that includes permanent and intermittent streams; wetlands; kettle lakes; or seepage areas and springs. October 22, 2003 38.9 Impervious Surface: means a surface that does not permit the infiltration of water, such as a rooftop, sidewalk, paved roadway, driveway or parking lot. 38.10 Institutional Use: includes, without limitation, a long-term care facility, hospital, school, university or college. 38.11 Key Natural Heritage Feature: means land that includes wetlands; significant portions of the habitat of endangered, rare and threatened species; fish habitat; areas of natural and scientific interest (life science); significant valleylands; significant woodlands; significant wildlife habitat; or sand barrens, savannahs and tallgrass prairies. 38.12 Landform Features: means distinctive physical attributes of land such as slope, shape, elevation and relief. 38.13 Landform Conservation Area: means a landform conservation area as described in Section 30 of the Oak Ridges Moraine Conservation Plan. 38.14 Liquid Industrial Waste: has the same meaning as in Regulation 347 of the Revised Regulations of Ontario, 1990. 38.15 Major Development: means development consisting of, (1) the creation of four or more lots, (2) the construction of a building or buildings with a ground floor area of 500 square metres or more, or (3) the establishment of a major recreational use as described in Section 38 of the Oak Ridges Moraine Conservation Plan. 38.16 Net Developable Area: means the area of a lot or site, less any area that is within a key natural heritage feature or a hydrologically sensitive feature. 38.17 Oak Ridges Moraine Conservation Plan Area: means the designated area on Schedules "A", "B", "C" , "D", and "E" Zoning Maps, to this By-law, in accordance with the Oak Ridges Moraine Conservation Plan and Provincial Mapping. October 22, 2003 38.18 Partial Service: means connections linking a building to, (1) a communal sewage or water service or a full municipal sewage or water service, and (2) an individual on-site sewage or water system. 38.19 Rapid Infiltration Basin: means a basin or system of basins at or below surface grade that is constructed in porous soil and punctures through a relatively impermeable layer to gain access to a more permeable sand or gravel layer, so as to rapidly infiltrate into the ground, at a single point or area of concentration, surface runoff collected from impervious surfaces. 38.20 Rapid Infiltration Column: 38.21 Site: means a column or system of columns at or below surface grade that is constructed in porous soil and punctures through a relatively impermeable layer to gain access to a more permeable sand or gravel layer, so as to rapidly infiltrate into the ground, at a single point or area of concentration, surface runoff collected from impervious surfaces. means the land subject to an application. 38.22 Site Alteration: means activities such as filling, grading and excavation that would change the landform and natural vegetative characteristics of land, but does not include, (1) the construction by a public body, of facilities for transportation, infrastructure and utilities uses, as described in Section 41, of the Oak Ridges Moraine Conservation Plan, or (2) for greater certainty, i) the reconstruction, repair or maintenance of a drain approved under the Drainage Act and in existence on November 15, 2001, or ii) the carrying out of agricultural practices on land that was being used for agricultural uses on November 15,2001. . 38.23 Stormwater Management Pond: means a detention basin that temporarily stores or treats collected stormwater runoff and releases it at a controlled rate. 38.24 Time of Travel: means the time that is needed for groundwater to travel a specified horizontal distance in the saturated zone. October 22, 2003 38.25 Wellhead Protection Area: means the surface and subsurface area surrounding a water well or well field that supplies a public water system and through which contaminants are reasonable likely to move so as eventually to reach the water well or well field." 4. By adding the following to the end of the list of zones in Section 4.1: "Oak Ridges Moraine Zones Oak Ridges Moraine Environmental Protection ......... (EP-ORM) Oak Ridges Moraine Natural Core Area. . . . . . . . . . . . . (NC-ORM)" 5. THAT Section "5.3 ZONES DEFINED", is hereby amended by adding a new Subsection (c) as follows: "(c) Notwithstanding the provisions above, the boundary of the Oak Ridges Moraine Conservation Plan Area shall be scaled from the attached Schedules." 6. THAT Section "6.1 Application of By-law" is hereby amended by adding the following new paragraph at the end of Section 6.1: "Furthermore, the provisions of this By-law shall not prevent the erection or use of a building or structure in the Oak Ridges Moraine Conservation Plan Area for which a permit was issued under Subsection 8(2) of the Building Code Act, 1992 on or before November 15, 2001, if, a) the permit has not been revoked under Subsection 8(1 0) of the Building Code Act, 1992, and b) the building or structure when erected is used and continues to be used for the purpose for which it was erected." 7. THAT Section "6.32 Public Services Permitted" is hereby amended by adding the following new paragraph immediately at the beginning of Section 6.32: 8. "The following provisions shall not apply to lands which include "Oak Ridges Moraine" in the title of the zone, or where the zone symbol is followed by the letters "ORM"." THAT "SECTION 34 ADMINISTRATION" is hereby amended by renumbering SECTION 34 -ADMINISTRATION to SECTION 37, by changing any other references in By-law Number 2213-78 from SECTION 34 to SECTION 37 accordingly, and by adding the following new SECTION 34 GENERAL PROVISIONS FOR THE OAK RIDGES MORAINE CONSERVATION PLAN AREA, and SECTION 35 OAK RIDGES MORAINE ENVIRONMENTAL PROTECTION (EP-ORM) ZONE; and SECTION 36 OAK RIDGES MORAINE NATURAL CORE AREA (NC-ORM) ZONE: "SECTION 34 GENERAL PROVISIONS FOR THE OAK RIDGES MORAINE CONSERVATION PLAN AREA The following general provisions shall apply to all lands within the Oak Ridges Moraine Conservation Plan Area as shown on Schedule "A", to this By-law. October 22, 2003 34.1 Permitted Uses Notwithstanding any other provisions of this By-law to the contrary, where a Zone symbol is followed by the letters "ORM", no person shall use the land, (including expanding, enlarging or otherwise altering an existing use, building or structure), for any use other than a use existing as of November 15, 2001, without an amendment to this By-law in accordance with the policies of the Official Plan, the Oak Ridges Moraine Conservation Plan, the Oak Ridges Moraine Conservation Act, 2001, and the Planning Act, as amended. 34.1.1 Notwithstanding any other provisiqns of this By-law to the contrary, where lands are considered an existing lot created prior to November 15, 2001, and are located within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-law, and said lot or a portion of said lot is located within one or more of the natural heritage and/or hydrologically sensitive features identified and shown on Schedule "B", to this By-law, then the following provisions shall apply: i) the only uses permitted shall be uses legally existing as of November 15, 2001, and conservation uses; and ii) no development, including the creation of new lots, or a change in land use, or the construction of buildings or structures which require approval under the Planning Act, the Environmental Assessment Act or the Drainage Act; or any site alteration, including filling, grading and excavation, shall occur on lands within the zones shown on Schedule "B", to this By-law, without an amendment to, or relief from this By-law, in accordance with the provisions of the Planning Act. 34.1.2 Notwithstanding the provisions of Subsection 34.1.1 above, where lands are considered an existing lot created prior to November 15, 2001, and are located within the "Oak Ridges Moraine Settlement Area" as shown on Schedule "A" -Map 1, and said lot or a portion of said lot is located within a significant woodland as shown on Schedule "B", to this By-law, an accessory use, structural addition and/or site alteration including filling, grading and excavation shall be permitted on said lot subject to compliance with the following provisions: i) the use, erection, location or expansion would have been permitted by the applicable Zoning By-law on November 15, 2001 and complies with Sections 28, 29, 45(7) and (8), and Section 47 of the Oak Ridges Moraine Conservation Plan; ii) the use, erection location or expansion is within 7.5 metres of an existing primary use on the lot; iii) 75% of the lot area is preserved in a natural state and such preserved area shall not include any area devoted to a swimming pool, accessory building or structure, paved driveway, patio or other area of impervious material; and iv) any tree removal shall only occur within the actual area required for the use, erection or expansion and that no other tree removal shall occur within the significant woodland or its minimum vegetation protection zone. October 22, 2003 34.2 Areas of High Aquifer Vulnerability Notwithstanding any other provisions of this By-law to the contrary, the following uses are prohibited within an Area of High Aquifer Vulnerability as indicated by the zone shown on Schedule "C" attached hereto and forming part of this By-law: i) generation or storage of hazardous or liquid industrial waste; ii) waste disposal sites and facilities, organic soil conditioning sites, and snow storage and disposal facilities; iii) underground or above-ground storage tanks that are not equipped with an approved secondary containment device; and iv) the use, creation, handling or storage of alfatoxin, tetrachlorodibenzo-p-dioxin, pentachlorodibenzo-p-dioxin, hexachlorodibenzo-p-dioxin, or tetrachlorodibenzo furan, or other contaminants listed in Schedule 3 (Severely Toxic Contaminants) to Regulation 34 7 of the Revised Regulations of Ontario, 1990. 34.3 Wellhead Protection Areas Notwithstanding any other provisions of this By-law to the contrary, the following uses are prohibited within a Wellhead Protection Area as indicated by the corresponding zone shown on Schedule "D" attached hereto, and forming part of this By-law: i) storage, except by an individual for personal or family use of: petroleum fuels; petroleum solvents and chlorinated solvents; pesticides, herbicides, and fungicides; construction equipment; inorganic fertilizers; and road salt. ii) use, creation, handling or storage of alfatoxin, tetrachlorodibenzo- p-dioxin, pentachlorodibenzo-p-dioxin, hexachlorodibenzo-p-dioxin, or tetrachlorodibenzo furan, or other contaminants listed in Schedule 3 (Severely Toxic Contaminants) to Regulation 347 of the Revised Regulations of Ontario, 1990. iii) generation or storage of hazardous or liquid industrial waste; and iv) waste disposal sites and facilities, organic soil conditioning sites, and snow storage and disposal facilities. 34.4 Landform Conservation Areas 34.4.1 Notwithstanding any other provisions of this By-law to the contrary, the following provisions shall apply within a Landform Conservation Area (Category 1) as indicated by cross-hatching on Schedule "E" attached hereto and forming part of this By-law: i) the net developable area of the site that is disturbed shall not exceed 25 per cent of the total site area; and ii) the net developable area of the site that has impervious surfaces shall not exceed 15 per cent of the total site area. October 22, 2003 "'~"·-' 34.4.2 Notwithstanding any other provisions of this By-law to the contrary, the following provisions shall apply within a Landform Conservation Area (Category 2) as indicated by a dotted pattern shown on Schedule "E" attached hereto and forming part of this By-law: i) The net developable area of the site that is disturbed shall not exceed 50 per cent of the total site area; and ii) The net developable area of the site that has impervious surfaces shall not exceed 20 per cent of the total site area. 34.5 Rapid Infiltration Basins and Columns New rapid infiltration basins and new rapid infiltration columns as defined in Section 3B, of this By-law are prohibited on lands within the Oak Ridges Moraine Plan Area, as shown on Schedule "A" to this By- law. 34.6 Transportation Infrastructure And Utilities 34.6.1 Notwithstanding any other provisions of this By-law to the contrary, all new transportation, infrastructure and utilities uses listed below, and all upgrading or extension of existing transportation, infrastructure and utilities uses, including the opening of a road within an unopened road allowance, are prohibited on lands within a key natural heritage feature or hydrologically sensitive feature as shown on Schedule "B" to this By-law: (a) public highways; (b) transit lines, railways and related facilities; (c) gas and oil pipelines; (d) sewage and water service systems and lines and stormwater management facilities; (e) power transmission lines; (f) telecommunications lines and facilities, including broadcasting towers; (g) bridges, interchanges, stations, and other structures, above and below ground, that are required for the construction, operation or use of the facilities listed in Clauses a) to f) above; and (h) rights of way required for the facilities listed in Clauses a) to g) above. 34.6.2 Notwithstanding any other provisions of this By-law to the contrary, publicly initiated transportation, infrastructure, and utilities uses may be permitted to cross a key natural heritage feature or a hydrologically sensitive feature, as shown on Schedule "B" of this By-law, or may be permitted within the Oak Ridges Moraine Natural Core (NC-ORM) Zone as shown on Schedule "A" of this By-law, in accordance with all applicable policies of the Official Plan. October 22, 2003 34.7 Other General Provisions 34.7.1 Notwithstanding any other provisions of this By-law to the contrary, lands zoned NC-ORM, or EP-ORM, may be included in the calculation of any zone provisions for adjoining lands, provided that such lands used in the calculation are part of the same lot. 34.7.2 Notwithstanding any provision of this By-law to the contrary, all development shall comply with all applicable Official Plan policies related to the Oak Ridges Moraine Conservation Plan Area. 34.7.3 Where there is a conflict between this By-law and the Oak Ridges Moraine Conservation Act, or the Oak Ridges Moraine Conservation Plan, the more restrictive provisions shall prevail. SECTION 35 OAK RIDGES MORAINE ENVIRONMENTAL PROTECTION (EP- ORM)ZONE The following provisions shall apply to all Oak Ridges Moraine Environmental Protection (EP-ORM) Zones. 35.1 Uses Permitted No person shall hereafter within an Oak Ridges Moraine Environmental Protection (EP-ORM) Zone, use any land or erect, alter or use any building or structure for any purpose except one or more of the following uses: (1) uses legally existing as of November 15, 2001; (2) fish, wildlife and forest management; (3) conservation projects including flood and erosion control projects; (4) non-motorized trails; (5) publicly initiated transportation, infrastructure and utilities uses in accordance with Section 34.6 of this By-law and the applicable policies of the Official Plan; (6) natural heritage appreciation; and (7) accessory uses. Notwithstanding any other provisions of this By-law to the contrary, new stormwater management ponds and new agricultural uses, new agriculture related uses or accessory uses thereto, are prohibited on lands within the Oak Ridges Moraine Plan Area, which are identified as a key natural heritage feature and/or a hydrologically sensitive feature, as defined in Section 3B, and shown on Schedule "B" to this By-law. SECTION 36 OAK RIDGES MORAINE NATURAL CORE AREA (NC-ORM) ZONE The following provisions shall apply to all Oak Ridges Moraine Natural Core Area (NC-ORM) Zones. 36.1 Permitted Uses No person shall hereafter within an Oak Ridges Moraine Natural Core Area (NC-ORM) Zone, use any land or erect, alter or use any building or structure for any purpose except one or more of the following uses: (1) uses legally existing as of November 15, 2001; (2) fish, wildlife and forest management; (3) conservation projects including flood and erosion control projects; October 22, 2003 (4) non-motorized trails; (5) publicly initiated transportation, infrastructure and utilities uses in accordance with Section 34.6 of this By-law and the applicable policies of the Official Plan; (6) natural heritage appreciation; and (7) accessory uses. Notwithstanding any other provisions of this By-law to the contrary, new stormwater management ponds, new agricultural uses, new agriculture related uses and accessory uses thereto, are prohibited on lands within the Oak Ridges Moraine Plan Area, which are identified as a key natural heritage feature and/or a hydrologically sensitive feature, as defined in Section 3B, and shown on Schedule "B" to this By-law." 9. All other provisions of By-law Number 2213-78, as amended, shall continue to apply to the lands subject to this By-law. 10. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions, the By-law will take effect from the day of passing thereof. A non-decision is also being made to a site specific property in the Town (See Minister's Decision Page). Purpose and Effect of the Zoning By-law Amendment By-law 4469-03.0 has the effect of bringing the Town of Aurora's Zoning By-law (#2213-78) into conformity with the Oak Ridges Moraine Conservation Plan and Official Plan Amendment No.48. The amendment does the following: • Introduces new land use zones and development restrictions consistent with those under the Oak Ridges Moraine Conservation Plan and the Town of Aurora's Official Plan Amendment No. 48 (OPA 8); . A copy of the decision is attached. When the Decision is Final The decision of the Minister of Municipal Affairs and Housing is fihal and there is no opportunity to appeal. Requests for Hearings Officer Section 8(b) of the Oak Ridges Moraine Conservation Act, 2001 allows the Minister to appoint a hearing officer to conduct a hearing and .Provide written recommendations. For ZBL 4469-03.D, 3 requests have been received. None of these requests have been granted. I hereby approve Zoning By-law amendment #4469-03.0 passed by the Town of Aurora on October 22, 2003, subject to the following modifications: 1. In the first paragraph of the Preamble (p.1 ), add the words "boundary of the" before the words "Oak Ridges Moraine Conservation Plan Area". 2. Item 1, (p. 1) is hereby modified by the following: a) In the first paragraph, add the words "boundary of the" before the words "Oak Ridges Moraine Conservation Plan Area", and delete "Schedule "A-1 '"' and replace with "Schedule "A-Map 1 ""; b) In the second paragraph, add "RR-7, RR-8, RR-9" after "RR-6"; c) In the fifth paragraph, delete "RU(2441·81)" and replace with "RU(2444-81 )"; d) ·After "Oak Ridges Moraine Natural Core Area (NC-ORM) Zone", add the new zone classifications: "Oak Ridges Moraine Natural Linkage Area (NL-ORM) Zone; and Oak Ridges Moraine Countryside Area(C-ORM) Zone". 3. Item 3, Section 3 Definitions (p. 2), is modified by adding a new definition after part 3B.3 Bulk Storage Tank as follows: "38.4 Conservation Uses: means uses undertaken solely for the purpose of preserving, maintaining and/or enhancing the natural environment. Permitted activities shall be limited to stream bank protection works, fish, wildlife, forestry and conservation management practices, and approved trails." All other sections are also renumbered. 4. Item 3, Section 3 Definitions (p. 5), is modified by adding a new definition after part 3B.21 (formerly 3B.20) Rapid Infiltration Column as follows: "3B.22 Significant means identified as significant by the Ministry of Natural Resources, using evaluation procedures established by that Ministry, as amended from time to time." -1- 5. All other sections are also renumbered. Item 3, Section 3 Definitions (p. 6), is modified by adding a new definition after part 38.27 (formerly 38.25) Wellhead Protection Area as follows: "38.28 Woodland means a treed area, woodlot or forested area, other than a cultivated fruit or nut orchard or a plantation established for the purpose of producing Christmas trees." 6. Item 4, Section 4.1 (p. 6), is modified by adding the following two new sections under Oak Ridges Moraine Zones "Oak RidgesMoraine Natural Linkage Area ................. Item 6, (p.6), is modified by deleting the Preamble in its entirety and . replacing it with the following: ·"That Section "6.6 Building Permit issued" is hereby amended by adding the following new paragraph at the end of Section 6.6" Also, the words "Furthermore, the" is also deleted in the first paragraph and replaced with "The". 8. · Item 8, (p. 6), is modified by deleting "Section 37" and replacing it with "Section 40" throughout the section and by adding the following after "OAK RIDGES MORAINE NATURAL CORE AREA (NC-ORM) ZONE": ",SECTION 37 OAK RIDGES MORAINE NATURAL LINKAGE AREA (NL-ORM) ZONE, SECTION 38 OAK RIDGES MORAINE COUNTRYSIDE AREA (C-ORM) ZONE AND SECTION 39 OTHER GENERAL PROVISIONS." 9. Item 8, Section 34 General Provisions for the Oak Ridges Moraine Conservation Plan Area (p.7), is modified by deletjng subsections 34.1, 34.1.1 and 34.1.2 in their entirety and replacing them with the following new subsections: "34.0 Reconstruction The reconstruction within the same location and dimensions of an existing building or structure that is damaged or destroyed by causes beyond the owner's control is permitted on all lands within Oak Ridges Moraine Conservation Plan area as shown on Schedule "A", to this by-law and the reconstructed building or structure shall be deemed to be an existing building or structure if there is no change in use and no intensification of -2- --·--~·-------···------··--·-------------~~-----·--···--··-··---·- the uses. 34.1 Settlement Area (-ORMl Permitted uses in all Zones For lands within the Oak Ridges Moraine Conservation Plan Area Notwithstanding any other provisions of the By-law to the contrary, within the "Oak Ridges Moraine Settlement Area", as shown on Schedule ·"A" -Map 1 to this By-law where a Zone symbol is followed by the letters "ORM", no person shall use the land, including expanding, enlarging or otherwise altering an existing use, building or structure, for any use other than a use legally existing as of November 15, 2001, or a use for which a building permit has been issued in accordance with Section 6.6 of the By- law, without an amendment to this By-law or relief from this by-law in accordance with the policies of the Official Plan and the Planning Act. 34.1.A Notwithstanding the provisions of section 34.1, the following uses, buildings and structures may be permitted on legally existing residential lots with existing dwellings within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"- Map 1 to this By-law: i: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% on the ground floor, provided such uses are that they do not exceed 50 sq. m. provided such uses are located outside of hydrologically sensitive features. 34.1.8 Settlement Area Zoning Provisions i) Within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-law where a Zone symbol is followed by the letters "ORM" the following siting provisions shall apply: Siting Specifications: Front Yard (minimum) Rear Yard (minimum) Interior Side Year (minimum) -one side -other side Exterior Side Yard (minimum) Height (maximum) 15.0 metres 22.0 metres 9.0 metres 4.5 metres 15.0 metres 10.0 metres ii) Within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-law where a Zone symbol is not followed by the letters "ORM" the -3- zoning and siting provisions shall be in accordance with relevant zoning category provisions. 34.1.C Site Plan Control All zones designated as a site plan control area, within by-law 3604-95.D as amended, shall continue to be subject to site plan control under Section 41 of the Planning Act and all required site plans shall be in compliance with the policies of Official Plan Amendment 48. 34.1.1 Settlement Area Lands Outside Key Natural Heritage Features. Hydrologically Sensitive Features and Minimum Vegetation Protection Zones Despite any other provisions of the 13y-Jaw to the contrary, where lands are not located within one or more of the key natural heritage features, hydrologically sensitive features, and/or their associated minimum vegetation protection zone(s) as identified and shown on Schedule "B" to this By- law, and where the said lands are also located within the "Oak Ridges Moraine Settlement Area", as shown an Schedule "A" -Map 1 to this By-law, the only uses, buildings and structures permitted shall be uses which were lawfully permitted by the Zoning By-law as of November 15, 2001, together with conservation uses. Notwithstanding this, these lawfully permitted uses, building and structures shall not include those prohibited uses that are outlined in Section 34.2 and 34.3 of this By-law. The provisions of section 34.1 shall continue to apply to all lands located within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-Jaw, where a Zone symbol is followed by the letters "ORM". 34.1.2 Settlement Area Lands Within Key Natural Heritage Features and/or Hydrologically Sensitive Features. Despite any other provisions of the By-law to the contrary, where a lot or portion of a lot is located within one or more of the key natural heritage features and/or hydrologically sensitive features identified and shown on Schedule "B", to this By-Jaw, and the said lands are also located within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-Jaw, then the following provisions shall apply: i) the only uses, building and structures permitted on that portion of said lot that is within the feature shall be uses,_buildings or structures legally existing as of November 15, 2001, or building or structures for which -4- 34.1.3 a building permit has been issued in accordance with Section 6.6 of the By-law, as amended, and conservation uses; ii) no development or site alteration including expanding, enlarging or otherwise altering an existing use, building or structure shall occur on that portion of said lot that is wiihin the feature, as shown on Schedule "B", to this By-law, without an amendment to, or relief from this By-law, in accordance with the policies of the Official Plan as amended by Official Plan Amendment Number 48 and the Planning Act. iii) on that portion of the said lot that is not located within the feature, the uses permitted shall be in accordance with Section 34.1.1 of this By-law. Settlement Area Lands Within Minimum Vegetation Protection Zones Despite any other provisions of .the By-law to the contrary, where a lot or a portion of a residential lot is located within one or more of the minimum vegetation protection zones identified and shown on Schedule "B:' to this By-Law, and the lands are also located within the "Oak Ridges Moraine Settlement Area", as shown on Schedule "A"-Map 1 to this By-law, then the following provisions shall apply: i) no development or site alteration shall occur on that portion of the lot that contains a minimum vegetation protection zorie as shown on Schedule "B" to this By- law, without an amendment to, or relief from the Zoning By-law in accordance. with the policies of the Official Plan as amended by Official Plan Amendment Number 48 and the Planning Act, with the exception for residential lots with existing dwellings in accordance with Section 34.1 .a. ii) on that portion of the said lot that is not located within the minimum vegetation protection zone, the uses permitted shall be in accordance with Section 34.1.1 of the By-law, or uses for which a building permit has been issued in accordance with Section 6.6 of the By-law, as amended, and conservation uses shall be permitted. Notwithstanding this, these lawfully permitted uses, building and structures shall not include those prohibited uses that are outlined in Section 34.2 and 34.3 of this By- law. -5- /··.-· 34.1.4 Settlement Area Containing a Significant Woodland Feature Despite the provisions of Subsection 34.1.2 above, where a residential lot or a portion of a residential lot existing as of November 15, 2001, is located within a significant woodland as shown on Schedule "B", to this By-law, and the said lot or a portion of the said lot is also located within the "Oak Ridges Moraine Settlement Area" as shown on Schedule "A" -Map 1, the following provisions· shall apply: i) no development or site alteration shall occur on that portion of the lot that contains a significant woodland as shown on Schedule "B" to this By-law, without an amendment to, or relief from the Zoning By-law in accordance with the policies of the Official Plan as amended by Official Plan.Amendment Number 48 and the Planning Act, with the exception of residential lots with existing dwellings in accordance with Section 34.1.a. ii) on that portion of the said lot that is not located within the significant-woodland, the uses permitted shall be in accordance with Section 34.1.1 of theBy-law, or uses for which a building permit has been issued in accordance with Section 6.6 of the By-law, as amended, and conservation uses shall be permitted. Notwithstanding this, these lawfully permitted uses, building and structures shall not include those prohibited uses that are outlined in Section 34.2 and 34.3 of this By-law. iii) any tree removal shall only occur within the actual area required for the use, erection or expansion or enlargement and that no other tree removal shall occur within the significant woodland. iv) Furthermore, if the said lot was not an existing residential lot as of November 15, 2001, or is a vacant residential lot, or if the primary use is removed and replaced with a new dwelling that is not on the original footprint, then the provisions of Section 34.1.2 shall apply.: 10. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.2 Areas of High Aquifer Vulnerability (p.B), is modified by adding the following sentence after the words "of this By- law" in the Preamble: "with the exception of those uses listed below which were lawfully existing on November 15, 2001, and which may continue until the use(s) ceases." -6- 11. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.3 Wellhead Protection Areas (p.8), is modified by adding the following' sentence after the words "of this By- Jaw" in the Preamble: "with the exception of those uses listed below which were lawfully existing on November 15, 2001, and which may continue until the use( s) ceases." 12. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.4.1 Landform Conservation Areas (p.8), is modified by deleting the Preamble in its entirety and replacing it with the following: 13. 14. "The following provisions shall apply for any application for development or site alteration within a Landform Conservation Area (Category 1) as indicated by cross. hatching on Schedule "E" attached hereto and forming part of this By-law:" Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.4.2 Landform Conservation Areas (p.9}, is modified by deleting the Preamble in its entirety and replacing it with the following: · "The following provisions shall apply for any application for development or site alteration within a Landform Conservation Area (Category 2) as indicated by dotted pattern shown on Schedule "E" attached hereto and forming part of this By-law:" A new subsection is added after lteni 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.4.2 Landform Conservation Areas (p. 9) as follows: "34.4.3 i) Notwithstanding subsection 34.4.1 and 34.4.2, no development or site alteration shall occur on those Category 1 and Category 2 lands identified in Schedule "E" to this By-law, without an amendment to, or relief from the Zoning By-law in accordance with the policies in the Official Plan. as amended by Official Plan Amendment Number 48 and the Planning Act. ii) Section 34.4.3 shall not apply to sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq.m. on the ground floor for .lots with existing residential dwellings." -7- 15. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.4 Landform Conservation Areas (p.9), is modified by adding a new subsection after subsection 34.4.3 (as amended) as follows: "34.4.4 Landform Conservation Areas in Settlement Areas i) Within the "Oak Ridges Moraine Settlement Area" as shown on Schedule "A" -Map 1, the provisions of Sections 34.4.1 and 34.4.2_shall only apply to lands zoned Rural (RU) Zone, Rural (RU-ORM) Zone, Rural Residential (RR) Zone, Rural Residential (RR-ORM) Zone, Estate Residential (ER) Zone, Estate Residential (ER-ORM) Zone, Major Open Space (0) Zone, Major Open Space Zone (0-0RM) Zone, Oak Ridges Moraine Environmental Protection (EP-ORM) Zone,-and Oak Ridges Moraine Natural Core Area (NC-ORM) Zone and including any exception zone to the foregoing. In addition within the "Settlement Area" within Landform Conservation (Category 1) and (Category 2) Areas new zoning applications will be considered in accordance with Section 3.13.4.f x of Official Plan Amendment No. 48. ii) Within the "Oak Ridges Moraine Settlement Area" as shown on Schedule "A"-Map 1, the provisions of 34.4.3 i) shall not apply for existing residential lots." 16. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.6.1 Transportation Infrastructure and Utilities (p.9), is modified by deleting the words-"Notwithstanding any other provisions of this By-law to the contrary, all" and replacing it with the word "All". 17. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.6.2 Transportation Infrastructure and Utilities (p.9), is deleted in its entirety and replaced with the following: "New transportation, infrastructure, and utilities uses may be permitted to cross a key natural heritage feature or a hydrologically sensitive feature, as shown on Schedule "B" of this By-law, despite the provisions of Section 34.6.1, or any other provisions of this By-law to the contrary, provided such use is in accordance with the policies of Section 3.13.1 0 of the Official Plan." -8- 18. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 34.6 Transportation Infrastructure and Utilities (p.9), is modified by adding a new subsection after subsection 34.6.2 as follows: 19. 20. 21. "34.6.3 New transportation, infrastructure, or utilities uses shall not be permitted in the Oak Ridges Moraine Natural Linkage Area (NL-ORM) Zone, Oak Ridges Moraine Environmental Protection (EP-ORM) Zone, or the Oak Ridges Moraine Natural Core Area (NC-ORM) Zone, unless in conformity with the policies of Section 3.13.1 0 of the Official Plan." Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 35 Oak Ridges Moraine Environmental Protection (EP-ORM) Zone (p;10), is modified by deleting the word "The" in the first line of the Preamble and replacing it with "Notwithstanding any other provision of the By-law to the contrary the". Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 35.1 Uses Permitted (p.10), is modified by deleting the words "publicly initiated" in part (5). Also, add the following sentence at the end of the second paragraph: "Furthermore, conservation projects including flood and erosion control projects and small scale structures accessory to trails shall only be permitted within key natural heritage features, hydrologically sensitive features and within 120 metres of such features if the requirements of OPA 48 pertaining to such uses has been met." Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 36.1 Uses Permitted (p.11), is modified by deleting the words "publicly initiated" in part {5). Also, add the following sentence at the end of the second paragraph: "Furthermore, conservation projects including flood and erosion control projects and smalr scale structures accessory to trails shall only be permitted within key natural heritage features, hydrologically sensitive features and within 120 metres of such features if the requirements of OPA 48 pertaining to such uses has been met." 24. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area, subsection 36 Oak Ridges Moraine Natural Core Area (NC- ORM) Zone (p.11), is modified by adding new subsections-after 36.1 Uses Permitted: "36.1.1 Siting Specifications Front Yard (minimum) Rear Yard (minimum) Interior Side Yard (minimum): one side other side Exterior Side Yard (minimum) Height (maximum) 15.0 metres 22.0 metres 9.0 metres 4.5 metres 15.0 metres 10.0 metres 36.1.2 Notwithstanding the provisions of section 36.1, the following uses, buildings and structures may be permitted on legally existing residential lots with existing dwellings: i: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor provided such uses are located outside of key natural features and hydrologically sensitive features. . " ·' ii: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25°io of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor within significant woodlands provided they are located within 7.5 metres of the existing primary building or structure and provided that 75% of the existing woodland area of the lot is preserved in a natural state. -10- 37.1.3 New single residential dwellings and related accessory uses on existing lots will only be permitted through a minor variance or rezoning to be completed to ensure compliance with Section 3.13.3 g of OPA 48." 25. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area (p. 11), is modified by adding a new Section after Section 36 as follows: "SECTION 37 OAK RIDGES MORAINE NATURAL LINKAGE AREA (NL-ORM) ZONE Notwithstanding any other provision of the By-law to the contrary, the following provisions shall apply to all Oak Ridges Moraine Natural Linkage Area (NL-ORM) Zone. - 37.1 Permitted Uses No person shall hereafter within an Oak Ridges Moraine Natural Linkage Area (NL-ORM) Zone, use any land or erect, alter or use any building or structure for any purpose except one or more of· the following uses: (1) uses legally existing as of November 15, 2001; (2) fish, wildlife and forest management; (3) conservation projects including flood and erosion control projects; (4) non-motorized trails; (5) agricultural uses; (6) transportation, infrastructure and ulilities uses in accordance with Section 34.6 of this By-law and the applicable policies of the official plan; (7) natural heritage appreciation; (8) accessory uses to the above Notwithstanding any other provisions of this By-law to the contrary, new stormwater management ponds, new agricultural uses, new agriculture related uses and accessory uses thereto, are prohibited on lands within the Oak Ridges Moraine Plan Area, which are identified as a key natural heritage feature and/or a hydrologically sensitive feature, as defined in Section 3B, and shown on Schedule "B" to this By-law. Furthermore, conservation projects including flood and erosion control projects and small scale structures accessory to trails shall only be permitted within key natural heritage features, hydrologically sensitive features and within 120 metres of such features if the requirements of OPA 48 pertaining to such uses has been met. -11- 37.1.1 Siting Specifications: Front Yard (minimum) Rear Yard (minimum) 15.0 metres 22.0 metres Interior Side Yard (minimum): one side other.side Exterior Side Yard (minimum) Height (maximum) 9.0 metres 4.5 metres 15.0 metres 10.0 metres 37.1.2 Notwithstanding the provisions of section 37.1, the following uses, buildings and structures may be permitted on legally existing residential lots with existing dwellings: i: sheds 10 square metres or. less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor provided such uses are located outside of key natural features and hydrologically sensitive features. ii: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor within significant woodlands provided they are located within 7.5 metres of the existing primary building or structure and provided that 75% of the existing woodland area of the lot is preserved in a natural state. 37.1.3 Newsingle residential dwellings and related accessory uses on existing lots will only be permitted through a minor variance or rezoning to be completed to ensure compliance with Section 3.13.3 g of OPA 48." 26. Item 8, General Provisions for the Oak Ridges Moraine Conservation Plan Area (p.11}, is modified by adding a new Section after Section 37 as follows: "SECTION 38 OAK RIDGES MORAINE COUNTRYSIDE AREA (CO- ORM)ZONE Notwithstanding any other provision of the By-law to the contrary, the following provisions shall apply to all Oak Ridges Moraine Countryside Area (CO-ORM) Zone. -l2- 38.1 Permitted Uses No person shall hereafter within an Oak Ridges Moraine Countryside (CO-ORM) Zone, use any land or erect, alter or use any building or structure for any purpose except one or more of the following uses: (1) uses legally existing as of November 15, 2001; (2) fish, wildlife and forest management; (3) conservation projects including flood and erosion control projects; ( 4) non-motorized trails; (5) agricultural uses; (6) transportation, infrastructure and ulilities uses in accordance with Section 34.6 of this By-law and the applicable policies of the official plan; (7) natural heritage appreciation; (8) golf courses in accordance with the policies of the Official Plan as amended by Official Plan Amendment Number 48; (9) accessory uses to the above. 38.1.1 Siting Specifications: Front Yard (minimum) Rear Yard (minimum) Interior Side Yard (minimum): -one side -other side Exterior Side Yard (minimum) Height (maximum) 15.0 metres 22.0 metres 9.0 metres 4.5 metres 15.0 metres 10.0 metres 38.1.2 Notwithstanding the provisions of section 38.1, the following uses, buildings and structures may be permitted on legally existing residential lots with existing dwellings: i: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor provided such uses are located outside of key natural features and hydrologically sensitive features. ii: sheds 10 square metres or less, swimming pools, uncovered decks, balconies, patios and minor additions including open sided roof porches to a maximum of 25% of the ground floor area provided that they do not exceed 50 sq. m. on the ground floor within significant woodlands provided they are located within 7.5 metres of the existing primary building or structure and provided that 75% of the existing woodland area of the lot is preserved in a natural state. -13- /''' 38.1.3 New single residential dwellings and related accessory uses on existing lots will only be permitted through a minor variance or rezoning to be completed to ensure compliance with Section 3.13.3 g of OPA 48." 27. "39.0 Other General Provisions 39.1 Notwithstanding any other prov1s1ons of this By-law to the contrary, lands zoned NC-ORM, or EP-ORM, may be included in the calculation of any zone provisions for adjoining lands, provided that such lands used in the calculation are part of the same lot. 39.2 Notwithstanding any provision of this By-law to the contrary, all development shall comply with all applicable Official Plan policies related to the Oak Ridges Moraine Conservation Plan Area. 39.3 Where there i!l a conflict between this By-law and the Oak Ridges Moraine Conservation Act, or the Oak Ridges Moraine Conservation Plan, the more restrictive provisions shall prevail, with the exception of policies applicable to agricultural uses, mineral aggregate operations and wayside pits. 39.4 Except as otherwise provided for herein, where lands are shown on Schedule "A" -Map 1 to this By-law and an amendment to, or relief from this Zoning By-law is required, all applicable policies of the Official Plan, as amended, by Official Plan Amendment No. 48, shall apply to said lands. 39.5 Notwithstanding any other provisions of this By-law to the contrary, where a Zoning By-law is passed or a variance is approved resulting from a condition attached to a provisional consent, draft plan of subdivision or draft plan of condominium, and in accordance with the transitional provisions of the Oak Ridges Moraine Conservation Act, 2001, as amended, the zoning categories and provisions of said By-law or variance shall apply. Furthermore any by-law passed or variance granted, in accordance with the provisions of the Oak Ridges Moraine Conservation Act, 2001, subsequent to November 17, 2001, and prior to the approval of this specific by-law shall continue to apply." JJ. fiJJJ U PErZ Sue Seibert, MCIP, RPP Director of Planning • Page 1 Memo To: Mayor and Members of Council From: Sue Seibert, Director of Planning Date: October 28, 2003 Town of Aurora Planning Department Re: Oak Ridges Moraine Compliance Exercise (OPA 48 and ZBA 4469-03.0) Town staff met today to deal with a number of implementation· issues respecting Official Plan Amendment No. 48 and Zoning By-law Amendment No. 4469-03.0, both of which were adopted by Council on October 22, 2003 to conform to the Oak Ridges Moraine Conservation Plan. One of the main reasons for this meeting was to deal with the indirect implications of the portion of the Council resolution pertaining to the addition of all features on Schedule "K", to the Official Plan Amendment and the resulting changes to Schedules "B", "C", "D" and "E" of the Zoning By-law Amendment that resulted in the impacts on developments that were in the process of obtaining building permits within the settlement area. These developments which are "in progress" have been impacted by the mapping additions on the above mentioned schedules in a way that may not been envisioned by Council. The developments that are impacted are listed as follows (All these properties are within the Settlement Designation): · 1. 750179 Ontario Ltd. (Brookfield -Kennedy street West) -Registered -All lands zoned, some permits issued. 2. Leonard Lind-Zoned and Town ready to execute the subdivision agreement. 3. Fembrook -Phase one built and occupied. Phase 2 has been zoned needs minor site plan amendment and condo approvals. 4. Ballymore Development Aurora Inc. -Status Phase One and Two Registered with some building permits issued. Phase 3 draft approved and applicants have requested that staff initiate necessary clearances to permit the registration. All phases are zoned. • Page 1 5. Wycliffe-Property designated and zoned many permits have been issued. Under construction with some occupancies just needs condominium approvals for tenure. · 6. Magna Residential Condo -Property zoned and designated just need the vacant land condominium approval. 7. 1351586 Ontario Limited (Vintage) -Subdivision Agreement executed and property zoned, just need registrations. 8. Whitwell -Very small portion in Oak Ridges Moraine that is draft plan approved and zoned. 9. Elder -Designated and Zoned by the OMB, Draft Plan Approved working towards registration. Should it not have been Councils intention to constrain completion of the above mentioned developments, Staff suggest these specific developments be outlined on Schedule "A" to the zoning by-law with the following denotation ''Transitional -not subject to Schedules "B" to "E" inclusive of the by-law. This would allow the building permits to be issued on these sites without being impacted by the key natural heritage features and other constraints in a consistent manner with the transitional policies of the Oak Ridges Moraine Conservation Act. To facilitate the above noted interpretation we suggest that Council send a clarification of the intent of the Council resolution to the Ministry of Municipal Affairs and Housing along with the amendments which are to be forwarded by the Clerk within 15 days of October 22, 2003, which was the date the amendments were passed. The following is the suggested wording for such clarification: "That the Clerk be authorized to forward the following Council clarification and compliance documents reflecting this clarification to the Ministry of Municipal Affairs and Housing: The intention of the Council Resolution dated October 21, 2003 pertaining to the Implementation Phase of the Oak Ridges Moraine Official Plan and Zoning By-law Conformity exercise was not to impact the ability of approved applications to obtain registrations and subsequent building permits.
