BYLAW - Rezoning (Sharp Fashions) - 20020114 - 432802D(A. Ahmed/Sharp Fash.) THE CORPORATION OF THE TOWN OF AURORA By-law Number 4328-02.0 BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78, as amended. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as. follows: 1. THAT the zoning category applying to the lands known as Part of Lots 7 & 8, Plan 9 as shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Central Commercial (C2) Zone" to "Central Commercial (C2-13) Exception Zone", more particularly described on Schedule "A" attached hereto and forming part of this by-law. 2. THAT Section 21 is hereby amended by adding the following as Section 21.15 "Central Commercial (C2-13) Exception Zone". 21.15 Central Commercial (C2-13) Exception Zone 21.15.1 21.15.2 Notwithstanding any other provisions of By-law No. 2213-78 as amended, to the contrary, the following special provisions shall apply to the [ands known as Part of Lots 7 & 8, Plan 9, as shown on Schedule "A" to By-law No. 4328-02.0: Uses Permitted The lands shown zoned C2-13 on Schedule "A" and more particularly described on Schedule "A" shall be used in accordance with the following provisions: -business and professional offices -service shops, light -personal service shops -travel agencies -retail stores -dry cleaners distribution stations or depots -studios - a day care centre - a maximum of 32 dwelling units, which shall be located above the first storey Zone Requirements For the purposes of the C2-13 Zone, the following development standards shall apply: 21.15.2.1 Lot Specifications Lot Area (minimum) Lot Frontage (minimum) 1400.0 square metres 40.0 metres -2- 21.15.2.2 Siting Specifications Front Yard -Main Building Wall Exterior Side Yard (minimum) -Main Building Wall -Parking Garage Wall Interior Side Yard (minimum) -Main Building Wall -Parking Garage Wall Rear Yard (minimum) -Main Building Wall -Parking Garage Wall 21.15.2.3 Building Specifications Gross Floor Area (maximum) Height (maximum): Floor Area Per Unit (minimum): Bachelor 1 Bedroom 2 Bedroom 3 Bedroom 21.15.3 Amenity Area 0.0 metres 0.0 metres 13.0 metres 0.0 metres 0.0 metres 6.0 metres 1.5 metres 4200 square metres 15.0 metres 40.0 square metres 50.0 square metres 65.0 square metres 75.0 square metres Notwithstanding the provisions of Section 7.2, a minimum of 220.0 square metres of amenity area shall be provided in accordance with the following: 21.15.4 Loading Interior Exterior 120.0 square metres 100.0 square metres Notwithstanding the provisions of Section 19.2, the number of loading spaces shall be nil. 21.15.5 The provisions of Section 6.13.5 and 6.13.6 shall not apply. 3. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. I I I I 1 I I ( 1 I I SCHEDULE "A" TO BY-LAW NO. 4328-02.0 \ . ,, Explanatory Note Re: Zoning By-law No.4328-02.D By-law Number 4328-02.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands being Part of Lots 7 & 8, Plan 9, municipally known as 15160 Yonge Street and 5 Tyler Street from "Central Commercial (C2) Zone" to "Central Commercial (C2-13) Exception Zone". The amendment would permit the redevelopment of the lands for a five storey mixed use building incorporating commercial uses on the ground floor and 32 residential apartment units above. ·Permitted commercial uses within the ground floor units include business and professional offices, light service shops, personal service shops, travel agencies, retail stores, dry cleaners distribution stations or depots, studios, and a day care centre. The By-law also incorporates site specific lot, siting, and building specifications, in conjunction with specific amenity area and loading space provisions. AND TAKE NOTICE that any individual, corporation or public body may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Corporation of the Town of Aurora not later than 4:30p.m. on the lOth day of February, 2003, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection accompanied by the prescribed fee in the amount of $125.00, made payable to the Minister of Finance. * A notice of appeal may not be filed by an unincorporated association or group.
