BYLAW - Rezoning (Minto) - 20020528 - 434202DTHE CORPORATION OF THE TOWN OF AURORA By-law Number 4342-02.D BEING A BY-LAW to amend By-law 2213-78 WHEREAS it is deemed advisable to amend By-law Number 2213-78, NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS AS FOLLOWS: 1) THAT the zoning categories applying to the lands shown in dark outline on Schedule "A" attached hereto and forming part of this By-law are hereby amended from "Rural (RU) Zone" to "Detached Dwelling Second Density Residential Holding (H)R2-73 Exception Zone", "Detached Dwelling Second Density Residential Holding (H)R2-74 Exception Zone", "Row Dwelling Residential Holding (H)R6-48 Exception Zone", and "Major Open Space (0-6) Exception Zone", "Major Open Space (0-9) Exception Zone", "Institutional (1- 15) Exception Zone", and "Institutional (1-16) Exception Zone". 2) THAT Section 28 is hereby amended by adding the following as Section 28.14 "Institutional (1-15) Exception Zone" as follows: Notwithstanding the permitted uses of Section 28.1, the lands shown zoned 1- 15 on Schedule "A" shall only be used for the following: 28.14.1 28.14.1.1 USES PERMITTED - a separate elementary school in accordance with .the provisions of Section 28.2. - a public park in accordance with the provisions of Section 31.2. 3) THAT Section 28 is hereby amended by adding the following as Section 28.15 "Institutional (1-16) Exception Zone" as follows: Notwithstanding the permitted uses of Sections 28.1, the lands shown zoned 1- 16 on Schedule "A" shall only be used for the following: 28.15.1 28.15.1.1 USES PERMITTED a secondary school in accordance with the provisions of Section 28.2. - a public park in accordance with the provisions of Section 31.2. 4) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. READ A FIRST, SECOND AND THIRD TIME THIS 281h DAY OF MAY, 2002. -2- Explanatory Note Re: Zoning By-law Number 4342-02.0 By-law No. 4342-02.0 is to have the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands known as Part of Lot 23, Concession Two E.Y.S. (15,625 Bayview Avenue) from "Rural Zone" to "Detached Dwelling Second Density Residential Holding (H)R2-73 Exception Zone", "Detached Dwelling Second Density Residential Holding (H)R2-74 Exception Zone", "Row Dwelling Residential Holding (H)R6-48 Exception Zone", "Major Open Space (0-6) Exception Zone", "Major Open Space (0-9) Exception Zone", "Institutional (1-15) Exception Zone", and "Institutional (1-16) Exception Zone". The purpose of the amendment is to allow for the development of the lands for a residential plan of subdivision (File D12-01-4A). The (H)R2-73 Exception Zone and the (H)R2-74 Exception Zone permit single detached dwellings on lots with minimum lot frontages of 13.7 metres and 9.75 metres respectively. The (H)R6-48 Exception Zone permits townhouse dwellings with a minimum lot frontage of 6.0 metres. A "Holding (H)" provision has been applied to each of the residential zones, which has the effect of preventing any development of these lands until certain terms and conditions have been met such as confirmation that there is adequate water, sanitary, storm and/or transportation services and facilities available, that all required agreements have been executed and can be registered on title, that all necessary approvals have been received from all other relevant agencies and/or government bodies, and that there is compliance with the relevant policies of Official Plan Amendment No. 30. The 0-9 Exception Zone permits a public park and/or buildings or structures intended for erosion control and the 0-6 Zone permits only conservation and wildlife areas. · The 1-15 Exception Zone permits a separate elementary school and the 1-16 Exception Zone permits a secondary school. If the York Region District School Board confirms in the future that a secondary school is not required, the lands may be used for a park.
