By-law Number 4348-02.0
BEING A BY-LAW to adopt Official Plan Amendment No. 43
The Council of the Corporation of the Town of Aurora, under Section 17 (6) of
the Planning Act, RSO 1990 Chapter P. 13 as amended, hereby enacts as
follows:
1. Official Plan Amendment No. 43 for the Town of Aurora, consisting of the
attached explanatory text and schedules, is hereby adopted.
2. The Clerk is hereby authorized and directed to make such application on
behalf of the Corporation and to execute under the Corporate Seal such
documents as may be required for the above purposes.
3. This By-law shall come into force and take effect on the day of the final
passage thereof.

from Regional approval. In this regard, the Town of Aurora is the
signing authority.

The Amendment No. 43 to the Official Plan for the Town of Aurora Planning Area which
was adopted by the Council of the Corporation of the Town of Aurora is hereby
approved under Sections 17 and 21 of the Planning Act, R.S.O, 1990.

PART 1 -THE PREAMBLE
1.0 INTRODUCTION
This part of the Amendment entitled Part 1 -The Preamble, introduces the Amendment
and describes the context and planning process leading to the document's preparation.
It is for explanatory purposes only and does not form part of the Amendment.
2.0 PURPOSE
The purpose of this Amendment is to change the land use designation on the subject
lands shown on Schedules "A," "B" and "H", attached hereto and forming part of this
amendment, from "Urban Residential" to "Commercial" and more specifically, from "Site
Specific Policy Area "3.1.4.e", which permits the lands to be used for medium density
residential, made up of predominately triplexes, fourplexes, townhouses and other
building forms up to 3 storeys to "Commercial Special -Site Specific Policy Area
"3.2.7.1", which permits the use of the lands for a 95 seat restaurant and bed and
breakfast facility with a maximum of 4 rooms.
3.0 LOCATION
The subject lands affected by this amendment are located in Part of Lot 85, Concession
1, E.Y.S., more specifically known as Lot 3, Registered Plan 461.
4.0 BASIS OF THE AMENDMENT
Council has enacted this amendment in response to the following:
4.1. An application has been submitted to the Town to convert the subject lands from
a single family residence to a restaurant and bed and breakfast. The existing
historic building, known as "The Red House," dates to 1830 and is one of the
oldest homes in the Aurora area. The Official Plan has long recognized "The
Red House" as a significant heritage resource worthy of preservation.

4.2 The Official Plan not only requires the preservation of the integrity and structure
of the historic building, but also specifically speaks to the preservation of the
site's natural elements. The use of the subject lands for a restaurant and bed
and breakfast provides for the opportunity to meet these policy objectives.

PART 2 -THE AMENDMENT
1.0 INTRODUCTION
All of this part of the document entitled Part 2 -The Amendment, consisting of the
following text and attached maps, designated Schedule "A" (Land Use Plan), Schedule
"B" (Commercial Centres) and Schedule "H" (Site Specific Policy Areas), constitutes
Amendment No. 43 to the Official Plan for the Town of Aurora.
2.0 DETAILS OF THE AMENDMENT
The Official Plan of the town of Aurora is hereby amended as follows:

The area indicated on Schedule "A"-Land Use Plan, attached hereto and
forming part of this amendment, being Part of Lot 85, Concession 1,
E.Y.S., better described as Lot 3, Registered Plan 461, are hereby
redesignated from "Urban Residential to "Special Commercial."
That Schedule "B" -Commercial Centres, is hereby amended to include
and reference the subject lands as "Special Commercial," as shown on
Schedule "B" attached hereto and forming part of this amendment.
That Schedule "H" -Site Specific Policy Areas, is hereby amended by
deleting the reference to "3.1.4.e.", as it applies to the subject lands only,
and by referencing the subject lands as "3.2.7.1," as shown on Schedule
"H" attached hereto and forming part of this amendment.
Section 3.1.4 (Residential, Housing: Urban, Suburban, Estate Residential,
Supply, Site Specific Policy Areas) is hereby amended by deleting Section
"3.1.4.e" as it applies to the subject lands.
Section 3.1.4 (Residential, Housing: Urban, Suburban, Estate Residential,
Supply, Site Specific Policy Areas) is hereby amended by deleting Section
"3.1.4.e.i"

Item (6): Section 3.2.7 (Commercial Centres: Convenience, Community, Historic
Core, Campus, Service, Regional, Site Specific Policy Areas) is hereby
amended by adding the following Section as "3.2.7.1:"
The following policies apply to the lands designated "Commercial Special" on Part of
Lot 85, Concession 1, E.Y.S., better described as Lot 3, Registered Plan 461 as shown
on Schedules "A," "B" and "H," attached hereto and forming part of this plan.
i) The lands may be used for a restaurant containing a maximum of 95 seats and
bed and breakfast facility with a maximum of 4 rooms. To ensure compatibility
with the surrounding residential area, an outdoor patio, take-out restaurant and
drive-thru restaurant shall be prohibited by this policy and in the implementing
Zoning By-law. Given the prominence of the site in relation to neighbouring
properties and beyond, special regard shall be had to the location and screening
of garbage enclosures, as well as any other mechanical equipment such as
heating or air conditioning units.
ii) The site plan shall ensure to the greatest extent possible the preservation of the
integrity and structure of the historic building. Specifically, architectural and
historical aspects of the property will be maintained and where appropriate
enhanced. The site's natural features, including existing mature vegetation, shall
also be preserved to the greatest extent possible and additional landscaping
shall be encouraged to further enhance the rural and historical character.
Building additions to the historic structure shall be limited to a 30 square metre
enclosed patio and a 85 square metre addition, which shall be architecturally
compatible with the existing structure. In order to ensure this, the site plan
application will be reviewed by the Town of Aurora Local Architectural
Conservation Advisory Committee. It is the intention of the Town that the historic
structure will be designated under the Ontario Heritage Act, and that a clause be
included in the site plan agreement to implement the designation.
iii) The site shall only be accessed via Yonge Street, other than the use of a single
access along Old Yonge Street for emergency purposes and for pedestrian
access.

iv) Prior to site plan approval, the Lake Simcoe Region Conservation Authority and
the Town of Aurora shall be satisfied with the proposed drainage and stormwater
management measures.
3.0 IMPLEMENTATION AND INTERPRETATION
3.1 The implementation and interpretation of this Amendment shall be in accordance
with the respective policies of the Aurora Official Plan, Zoning By-law, and Site
Plan Agreements.

The purpose of this amendment is to change the land use designation from "Urban
Residential" to "Commercial Special" to permit the conversion of the existing dwelling
on site to a restaurant containing a maximum of 95 seats and bed and breakfast facility
