BEING A BY-LAW to adopt Official Plan Amendment No. 45
The Council of the Corporation of the Town of Aurora, under Section 17 (22) of the
Planning Act, RSO 1990 Chapter P. 13 as amended, hereby enacts as follows:
1. Official Plan Amendment No. 45 for the Town of Aurora, consisting of the
attached explanatory text and schedules, is hereby adopted.
2. The Clerk is hereby authorized and directed to make application to the Regional
Municipality of York for approval of Official Plan Amendment No. 45 for the Town
of Aurora.
3. This By-law shall come into force and take effect on the day of the final passage
thereof.
READ A FIRST, SECOND AND THIRD TIME THIS 1ih DAY OF NOVEMBER, 2002.

PART 1 THE PREAMBLE
1.0 INTRODUCTION
This part of the Amendment entitled Part 1-The Preamble, introduces the
Amendment and describes the context and planning process leading to the
documents preparation. It is for explanatory purposes only and does not form part of
the Amendment.
2.0 PURPOSE
The purpose of this amendment is to establish site specific policies to permit the
continued "Suburban Residential" use of the subject lands shown on Schedule "A",
attached hereto and forming part of this amendment, and to permit the creation of
one additional residential lot by consent for severance.
3.0 LOCATION
The subject lands affected by this amendment are located between Bathurst Street
and Wellington Heights on the south side of Aurora Heights Drive. The legal
description is as follows Part of Lots 81 and 82, Concession 1 WYS, and municipally
known as 15395 and 15405 Bathurst Street.
4.0 BASIS OF THE AMENDMENT
Council has enacted this amendment in response to the following:
4.1 The subject lands, consisting of two parcels approximately 0.302 ha ( 0.745
acres) arid 0.260 ha ( 0.642 acres) respectively, are residential parcels
containing existing dwellings that predated the current Official Plan.
4.2 The proposed division of the subject lands to create one additional residential
lot fronting Wellington Heights Court, represents infilling within the context of the
surrounding developed residential area and completes the visual streetscape
character at this prominent corner location with Aurora Heights Drive.
4.3 The proposed development will result in the creation of an additional lot
providing a lot area of 0.200 ha (0.5 acres), and the remaining two lots will be
marginally less than the minimum lot area requirements of 0.200 ha (0.5 ac) for
"suburban residential" lots. The proposal appears to be consistent with the
existing residential built fabric of this neighbourhood. The proposal 1s m
keeping with the "Suburban Residential" policies and provisions of the Aurora
Official Plan.
PART 2 THE AMENDMENT
1.0 INTRODUCTION
All of this part of the document entitled Part 2-The Amendment, consisting of the
following text and attached map, designated Schedule "A" ( Land Use Plan),
constitutes Amendment No. 45 to the Official Plan for the Town of Aurora.
2.0 DETAILS OF THE AMENDMENT
The Official Plan of the Town of Aurora is hereby amended as follows:
Section 3.1.2 SUBURBAN AND ESTATE RESIDENTIAL POLICIES is hereby
amended by adding the following as Section 3.1.4. t:
(t) The following policies apply to the lands designated "Suburban Residential" on
Part 1, Plan 65R-1533 and Block 30, Plan 65M-2395 & Part of Lot 82,
Concession 1, WYS as shown on Schedules "A" and "H" attached and forming
part of this plan.
i) The lands are designated as "Suburban Residential" and shall permit three
(3) lots, which shall have a minimum lot area of 0.167 hectares ( 0.413
acres). The proposed home shall be complimentary to the existing homes in
the area and shall ensure high standards in the conceptual design of the
building, massing, sitting and exterior access. To implement this
requirement the Town will retain an urban design review consultant at the
land owner's expense.
ii) Site grading/servicing, stormwater management, tree removal and building
location shall comply with the Oak Ridges Moraine Conservation Plan.
3.0 IMPLEMENTATION AND INTERPRETATION
3.1 The implementation and interpretation of this Amendment shall be in
accordance with the respective policies of the Aurora Official Plan, Zoning By-
law, Subdivision, Site Plan Agreements and the Oak Ridges Moraine
Conservation Plan.
