BYLAW - Real Estate Procedures - 20010508 - 425501ATHE CORPORATION OF THE TOWN OF AURORA By-law Number 4255-01.A BEING A BY-LAW to provide procedures with respect to the sale of municipal/and. WHEREAS the provisions of the Municipal Act, R.S.O. 1990, c.M.45 (as amended, the "Municipal Act"), authorize Council to dispose of municipal land. NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS AS FOLLOWS: 1.0 In this By-law, the following terms shall have the following meanings: (a) "Corporation" shall mean the Corporation of the Town of Aurora; and (b) "Sale" shall include any conveyance or transfer of real property, including a lease of real property where such lease has a term in excess of 21 years; and (c) "Surplus land" shall mean any real property of the Corporation that is not required for the purposes of the Corporation. 2.0 Before the sale of any real property, Council shall declare the real property to be surplus land in open meeting by by-law or by resolution. 3.0 Before the sale of any real property Council shall obtain at least one appraisal, unless an appraisal is not required pursuant to the Municipal Act or the regulations enacted thereunder. 4.0 Before the sale of any real property council shall provide notice of the proposed sale by: (a) causing a notice to be placed in at least one local newspaper for not less than one issue per week for a period of two weeks; or {b) some alternate form of public notice as Council shall, by resolution in open meeting, deem appropriate. 5.0 Council shall adhere to the requirements of Administrative Procedure No. 55 respecting real estate sale, purchase and leases, except where Council, by resolution, deems it to be in the municipal interest to waive or dispense with the requirements of the said Administrative Procedure. - 2 - 6.0 The provisions of this By-Jaw do not apply to a sale pursuant to subsection 210.1 (2) of the Municipal Act. 7.0 THAT By-law 3613-95.A be and is hereby repealed. 8.0 The provisions of this By-Jaw shall come into force and effect upon third reading thereof.
