BEING A BY-LAW to provide for
licensing,regulating and
governing of persons who carry
on the business of leasing
mobile signs.
WHEREAS the provisions of section 210 paragraph 147 of the Municipal Act, R.S.O.
1990, c. M.45 (as amended) provide a municipal council with the authority to license,
regulate and govern persons who carry on the business of leasing mobile signs.
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora
ENACTS AS FOLLOWS:
Definitions
1.1 "Corporation" means the Corporation of the Town of Aurora.
1.2 "Clerk" means the Clerk of the Corporation.
1.3 "Licence" means a licence that has been issued by the Clerk to a person with
respect to the business of leasing mobile signs pursuant to this By-Law and
"Licence" does not include a licence that has been revoked by the Clerk.
1.4 "Mobile Sign" means a "Sign, Trailers" as that term is defined in By-Law 3400-92
(as amended).
1.5 "Person" includes a natural individual, a corporation, a partnership, an
association, a receiver, a trustee in bankruptcy and a mortgagee in possession.
1.6 "Town" means the area within the geographic boundaries of the Town of Aurora.
General Prohibitions
2.1 No person shall carry on the business of leasing mobile signs in the Town or
locate or permit the location of their mobile signs in the Town without being in
possession of a current and valid licence pursuant to this By-Law.
2.2 No person shall carry on the business of leasing mobile signs in the Town or
locate or permit the location of their mobile signs in the Town except in
accordance with the provisions of this By-Law.
2.3 No person shall carry on the business of leasing mobile signs in the Town or
locate or permit the location of their mobile signs in the Town unless such
person has obtained and abides by the terms and conditions of the permits for
such mobile signs issued pursuant to By-Law 3400-92, the Sign By-Law (as
amended).
2.4 No person shall knowingly provide false information to the Corporation in
application for a licence or knowingly fail to correct inaccurate information with
respect to a licence application.
Licence Requirements and Conditions
3.1 Every person who applies for a licence shall provide to the Clerk in a form that is
satisfactory to the Clerk the following information.
(a) The name and address of the applicant and the location where the
applicant's mobile signs are stored; and
(b) Such other information as may be required by By-Law 3400-92 (as
amended) or is necessary in the opinion of the Clerk for the proper
consideration of applications and for the proper administration of licences
to be issued pursuant to this By-law.
3.2 It shall be a condition of any licence issued pursuant to this By-Law that the
applicant conform with the terms and conditions relating to the permits for
specific mobile signs issued to the applicant pursuant to By-Law 3400-92, the
Sign By-law (as amended) and breach of such terms or conditions shall
constitute grounds for revocation or refusal to renew or re-issue a licence
pursuant to this By-Law.
3.3 The fee for issuance of a licence pursuant to this By-Law shall be the fee set
forth in Schedule "A" attached hereto and forming part of this By-Law.
3.4 A licence issued under this by-law shall expire on January 31st each year.
Penalty
4.1 Any person who contravenes any provision of this By-law is guilty of an offence
and, upon conviction, is liable to the maximum penalty pursuant to the
provisions of the Provincial Offences Act, R.S.O. 1990, c. P.33 (as amended).
Application
5.1 This By-Law shall be applicable in all parts of the Town and shall come into
force and effect upon final reading hereof.
Repeal
6.1 By-law No. 3447-93 is hereby repealed.

The annual fee for any person carrying on the business of leasing mobile signs is
$165.00.
