BEING A BY-LAW to
assume certain lands on
Registered Plan M-1310
forming part of Orchard
Heights Boulevard.
',,WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) authorizes the Council of a local municipality to pass by-laws to establish and
lay out lands as public highways;
AND WHEREAS, the municipal Council of the Corporation of the Town of Aurora deems
it necessary and expedient to assume certain lands as public highways;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWN OF AURORA ENACTS AS FOLLOWS:
1. THAT the land described as Part of Block P (1 foot reserve), Plan M-1310,
designated as Part 1 on Reference Plan 65R-5217 and Part 1 on Reference Plan
65R-23263, Town of Aurora, Regional Municipality of York, be and is hereby
assumed as a public highway forming a part of Orchard Heights Boulevard in the
Town of Aurora.
2. THAT the provisions of this By-law shall come into force and effect upon final
passage thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS 10TH DAY OF APRIL, 2001.
READ A THIRD TIME AND FINALLY PASSED THIS 10TH DAY OF APRIL, 2001.

RECOMMENDATIONS
THAT By-law 4278-01. T, being a by-law to assume certain lands described as Part
of Block P on Plan M-1310 forming part of Orchard Heights Boulevard, be provided
three readings.
BACKGROUND
On December 1, 2000, the St. Andrew's Village Shopping Centre located at Orchard
Heights Boulevard and .Yonge Street was sold to Orchard Heights St. Andrews Inc. In
preparation for the sale, the solicitor for the vendor requested a right of way over the Town
owned reserve fronting the shopping centre, in particular, over two (2) driveway accesses
entering the site. Although the entire reserve along the north side of Orchard Heights
Boulevard had already been dedicated on the plan of subdivision as public highway, the
Town had not formally assumed the reserve. In order for the owner to achieve legal public
access over the reserve, the driveway entrances would need to be formally assumed by
the Town.
COMMENTS
The applicant submitted the Reference Plans that legally describe the driveway entrances
to be assumed. Staff confirmed that the subject lands are currently being used as part of
the municipal road and the lands have already been dedicated as public highway on the
related Subdivision Plan.
OPTIONS
If Council chooses not to assume the driveway entrances to the site, the owner will
continue to not have full legal ac;:c::ess over the shopping centre entrances along Orchard
Heights Boulevard.

CONCLUSIONS
The two components required for legal public access over the subject reserve are
assumption and dedication. The reserve has already been dedicated as public highway
on the Plan of Subdivision. The enactment and subsequent registration of the proposed
by-law will fulfil the assumption component, providing full legal public access over the
driveway entrances to the shopping centre along Orchard Heights Boulevard. Accordingly,
Staff are recommending that the lands set out in By-law 4278-01.T be formally assumed
by the Town of Aurora.
FINANCIAL IMPLICATIONS
The applicant has paid for all the costs associated with the required Reference Plans and
registration of the By-law.

Further to our discussions in respect of our client's request for the passing of the appropriate
By-law in respect of the two driveways located at the above property, we enclose herewith
copies of the requisite deposited reference plans. In this regard, you will recall that the original
reference plan 65R-52 I 7 (which showed the two driveway access points thereon) mistakenly
identified the location of the westerly.driveway shown as Part 2 on the Plan. Accordingly, our ·.
client obtained a new reference plan which identifies the correct location of such driveway,
being Part I on 65R-23263.
As a result of the foregoing, the new By-law should reference Part I on Plan 65R-5217 and
Part I on Plan 65R-23263. We have also enclosed a cheque payable to the Minister of Finance
in the amount of $60 for processing fees.
We trust the foregoing is satisfactory for the Town of Aurora to present a By-Jaw for Town
Council's consideration. If you require any further assistance please do not hesitate to contact

NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWN OF AURORA ENACTS AS FOLLOWS:
1. THAT the land described as Part of Block P (1 foot reserve), Plan M-1310,
designated as Part 1 on Reference Plan SSR-5217 and Part 1 on Reference Plan
SSR-23263, Town of Aurora, Regional Municipality of York, be and is hereby
assumed as a public h1ghway forming a part of Orchard Heights Boulevard in the
Town of Aurora.
2. THAT the provisions of this By-law shall come into force and effect upon final
passage thereof and following registration in the appropriate Land Registry
office.

Further to your request ofNovember 29, 2000, please be advised that Legal Services has reviewed
the PIN for the one foot reserve described as Block P on Plan M -1310 which runs the length of the
shopping centre along the north side of Orchard Heights Drive from Y onge Street. There appears
to be no evidence that the Town has ever enacted or registered a by-law to dedicate Parts 1 or 2 on
Plan 65R-5217 as public highway. However, the entire Block P was dedicated as public highway
on the Plan of Subdivision M -1310. Although the lands are already dedicated and conveyed to the
Town, it may be necessary to formally assume the driveway portions of the reserve, being Part I on
Plan 65R-5217 and Part 1 on the draft R-Plan provided.
To address this situation, we are prepared to submit the appropriate assumption by-law for Council's
consideration once a copy of the deposited Reference Plan has been provided. For your information,
the deadline for submission to the next Council Meeting is December 8, 2000 .. Since we will be
registering the by-law after its enactment,. we will also require your cheque payable to the Minister
of Finance in the amount of$60.00 for registration costs.

Further to our telephone conversation this morning, we act on behalf of Brookfield Homes
Ltd., the registered owner of the St. Andrew's Village Shopping Centre. Our client has
entered into an Agreement of Purchase and Sale to sel11he shopping centre to 1363656
Ontario Limited (Orchard Heights St. Andrews Inc.). The transaction is scheduled to close
on December 1, 2000.
Last Friday, an issue was raised by the Purchaser with respect to the location of one of the
driveways which provides access from the shopping centre to Orchard Heights Blvd. As
you are aware, the south side of the site is bounded by a one-foot reserve owned by the
Town. When ·the shopping centre was first developed in the early 1980's, a right-of-way
was granted to the then owners over Part 2 Plan 65R-52!7. Tills was at that time the
intended location for a driveway. The driveway was constructed in that location. Later,
the subsequent owner of the property, Coscan Development Corporation, applied for and
received site plan approval for an addition to the shopping centre, which approval also
contemplated ~elocating the subject driveway further to the west. A site plan agreement
was entered into on February 19, 1988 between Coscan and the Town. Among the

drawings referenced in that agreement, is a Grading Plan prepared by Marshall Macklin
Monaghan dated March 24, 1987 and revised June, 1987, which is Grading Plan Number
10-87011-1. This grading plan shows the original driveway (over Part 2 Plan 65R-5217)
to be relocated to the west. The addition has been built and the driveway was relocated in
accordance with the·site plan agreement.
Unfortunately, at that time no one sought to move the right-of-way over the one foot
reserve further to the west to line up with the new driveway location.
In order that this transaction can proceed as scheduled, we are writing to ask you to report
to Town Council at its meeting of December·I9, 2000 ur order to obtain the necessary
authorization for a By-law which would allow a new right-of-way to be granted in the
current correct location (shown as :Part l-en the attached draft reference plan prepared by
Vladimir Krcmar Ltd.). With the registration of the new right-of-way, the old right-of-way
can be surrendered. In the interim, I also understand that you will be asking the Clerk to
provide us with a letter granting the owner a licence to use the existing driveway, effective
immediately, until the Council meeting is held and the correct right-of-way can be granted.
For your convenience I enclose a copy of the 1988 site plan agreement and extracts from
the 1987 MMM Grading Plan, Plan 65R-5217 showing the old Part 1 and a draft reference
plan issued earlier today showing the new Part 1. Full size complete copies of these
Reference Plans will accompany the original of this letter which will be delivered to you
by courier tomorrow.
