BEING A BY-LAW to
dedicate certain lands as
public highway on Reference
Plan 65R-22507 forming part
of Willis Drive.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) authorizes the Council of a local municipality to pass by-laws to establish and lay out
lands as public highways;
AND WHEREAS, the municipal Council of the Corporation of the Town of Aurora deems it
necessary and expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWN OF AURORA ENACTS AS FOLLOWS:
1. THAT the land described as Block 58 Reserve, Plan 65M-3219, designated as Part 5 on
Reference Plan 65R-22507, Town of Aurora, Regional Municipality of York, be and is
hereby dedicated as a public highway forming a part of Willis Drive in the Town of
Aurora.
2. THAT the provisions of this By-law shall come into force and effect upon final passage
thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS 13TH DAY OF JUNE, 2000.
READ A THIRD TIME AND FINALLY PASSED THIS 13TH DAY OF JUNE, 2000.

RECOMMENDATIONS
THAT By-law 4178-00. T be enacted to dedicate certain lands as public highway on
Reference Plan 65R-22507 forming part of Willis Drive.
BACKGROUND
In 1999, the owners of 14591 Bathurst Street, located just north of Henderson Drive,
submitted a consent application to the Town's Committee of Adjustment respecting the
severance of their land (B-13-99-Tolfo). The proposed application included access to the
newly severed lot via Willis Drive. The Town currently owns a reserve along this portion
of Willis Drive that the developer of the subdivision conveyed in compliance with the
Subdivision Agreement for this area. The consent application was subsequently approved
and the dedication of the Town's reserve was one of the conditions imposed by the
Committee. In order to fullfil! the condition, the consultants for the owners are requesting
that the subject lands be dedicated as public highway so that access to the newly severed
lot cari be formally achieved.
COMMENliS
The application, including the proposed access via Willis Drive has already been approved
and the dedication of the Town's reserve is one of the conditions set out in the Committee
of Adjustment's decision.
OPTIONS
If Council chooses not to dedicate the lands as a public highway, the. owners of the newly
severed lot will not have legal access to their property via Willis Drive.

CONCLUSIONS
Since the subject land will be used as part of a Municipal road, Staff are recommending
that the land be formally dedicated as public highway through the adoption and registration
of the related By-law.

We are the planning consultants for Tiziana and Louis Tolfo, the owners of the above captioned
lands.
Condition Number 8, of approved Severance Application B-13-99, requires the removal of the
existing 0.3 metre reserve along the Willis Drive frontage of the severed lot, to allow access to
that lot. Accordingly, we would respectfully request thatthis matter be brought before Council
at the earliest opportunity, for approval of the appropriate By-law, to dedicate the 0.3 metre
reserve as public highway.
To assist you in this matter, we have enclosed a copy of Reference Plan 65R-22507, which
shows the 0.3 metre reserve as Part 5. We have also enclosed a copy of PIN 03658-0536 (LT)
which clearly indicates that the Town is the owner of this reserve. In addition, please find
enclosed a cheque for $50.00 representing the required processing/registration fee.
Could you please provide us with a copy of the By-law, o-nce approved by Council. We would
also appreciate it, if you could advise Bonnie Hant, of the Town, when this matter is complete,
that Condition No. 8 for Application B-13-99 has been satisfied .
