BYLAW - Amend 3680 96.P (Taxi) - 20000912 - 420700P. -----------·----~-'~'~-~--·----~~ THE CORPORATION OF THE TOWN OF AURORA By-law Number 4207-00.P BEING A BY-LAW to amend the Town of Aurora Taxicab By-law 3680-96.P. WHEREAS Section 232 of the Municipal Act, R.S.O. 1990, Chap. 302, as amended authorizes a local municipality to enact by-laws for the licensing and regulating and governing of cab owners, drivers and brokers; AND WHEREAS the municipal Council ofthe Corporation of the Town of Aurora enacted By- law 3680-96.P, as amended, being the By-law to license, regulate and govern taxicab owners, drivers and brokers; AND WHEREAS the municipal Council of the Corporation of the Town of Aurora deems it necessary and expedient to amend By-law 3680-96.P, as amended; NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT Part I Subsection 1.(2) be amended by deleting the clause" ... other than taxicabs owned by the dispatcher, their immediate family or their employer;" 2. THAT Part III Section 9. be amended by " ... transfer of a license ... " being deleted and " a new vehicle" being inserted; 3. THAT Part III Section 14. be amended by" ... sublicensed ... " being deleted and" ... sub- leased ... " being inserted; 4. THAT Part III Section 19. be amended by "dispatched," being inserted between " ... may and hold ... "; 5. THAT Part III Section 20. be repealed; 6. THAT Part III Subsection 21.(5) be added as follows: The applicant has been driving a taxicab in Town for a minimum of one (1) year if their entrance was subsequent to the passing of this By-law; 7. THAT Part III Subsection 23.(2) be amended by " ... 30 days ... " being deleted and ... 90 days ... " being inserted; 8. THAT Part III Subsection 23.(3) be amended by" ... dated within 90 days of the application date ... " being inserted after" ... copy ... "; 9. THAT Part III Subsection 23.(6) be amended by" ... 30days ... THAT Part III Subsection 23.(9) be added as follows: The applicant scores at least 75% on both the geography and By-law components of the taxi test. 11. THAT Part III Subsection 27.(6) be added as follows: Be accompanied bi-annually with a completed and approved medical certificate, a police comment letter and a Driver's Abstract from the Ministry of Transportation, all dated within 90 days of the application. THAT Part III Section 32. be repealed; 14. THAT Part III Section 49. be amended by deleting" ... between SAM and 5PM Monday to Friday inclusive ... " and inserting" ... when the offices are open, ... "; 15. THAT Part III Subsection 57.(3) be repealed; 16. THAT Part III Subsection 58.(6) and (8) be repealed; 17. THAT Part IV Subsection 59.(8) be amended by deleting the word" ... owner. .. "; 18. THAT Part VI Subsection 65.(4) (I) be added as follows: Pay the applicable fee as provided for in Schedule "A"; 19. THAT Part VI Subsection 65.(5) be repealed; 20. THAT Part VI Section 70. be repealed; 21. THAT Part VI Section 72. be amended by" ... or lessee ... " being deleted; 22. THAT Part VII Section 76.(17) be amended by deleting all but the first sentence of the section and inserting" ... all property and money left in a taxicab shall be delivered forthwith to the nearest police station ... "; 23. THAT Part VII Subsection 43.(31) be repealed; 24. THAT Part VII Section 77. be amended by inserting " ... approved ... " before " ... certificate ... "; 25. THAT Part VIII Subsection 81.(6) be amended by " ... three ... " being deleted and " ... twelve ... " being inserted; 26. THAT Part VIII Subsection 81.(7) be amended by" .. .if any ... " being deleted; 27. THAT Part VIII Subsection 82.(7) be amended by deleting" .. .lessee or sub-lessee ... "; 28. THAT Part VII Subsection 82.(10) be amended by adding the following: Have, possess or use a scanner. 29. THAT Part XII Section 95. be repealed and the following inserted: Every person who contravenes a provision of this By-law is guilty of an offence and upon conviction is liable to a fme not exceeding five thousand dollars ($5,000.00) exclusive of costs, pursuant to the provisions of the Provincial Offences Act as amended. 30. THAT Schedule "A" be repealed and Schedule "A" as attached to this By-law is subsituted therefore; 31. THAT Schedule "A" attached hereto shall form part of this By-law; 32. THAT Part VII Section 43. be renumber to be Section 77.; 33. THAT from Part VII Section 77. and onward, the By-law be renumbered incrementally by one (1). By-law No. 4207"00.P Page3 THAT the provisions of this By-law shall come into force and take effect upon the third reading of this By-law.
