BYLAW - Amend 2213 78 (Pearson 7 O'Reilly) - 20001010 - 42210DPearson & O'Reilly THE CORPORATION OF THE TOWN OF AURORA By-law Number 4221-00.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78, as amended. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1) THAT the zoning category applying to the lands known as Lot 1 and Part of Lot 5, Registered Plan 68, shown on Schedule "A" attached hereto and forming part of By-law No. 4221-00 .D, is hereby amended from "Special Mixed Density Residential (R5) Zone" to "Special Mixed Density Residential (R5-26) Exception Zone". 2) THAT Section 14 is hereby amended by adding the following as Section 14.3.25 "Special Mixed Density Residential (R5-26) Exception Zone". 14.3.25 Special Mixed Density Residential (RS-26) Exception Zone The existing building on the lands zoned R5-26 may be used for the following: i) Notwithstanding the provisions of Section 14.1, the ground floor of the existing westerly building on Lot 1 may be used for a drugless practitioner's office. ii) The second floor of the existing westerly building on Lot 1 shall be used for two dwelling units only. iii) The existing easterly building on Lot 1 shall be used for a detached dwelling only. iv) A portion of the rear yard of Part of Lot 5 may be used for a parking area for the uses permitted on Lot I only, subject to a maximum of seven (7) parking spaces. v) The subject lands may be curbed with pre-cast concrete curbing. vi) A driveway may be located 0.0 metres from the existing westerly building on Lot 1. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. The purpose of the amendment is to allow for the use of the existing westerly building ( 16 Mosley Street) for 2 dwelling units on the second floor and a drugless practitioner's office on the ground floor. The other existing building (18 Mosley Street) will be used for a single detached dwelling only and 36 Victoria Street will maintain its use as a single detached dwelling. The by-law permits the use of the rear yard of 36 Victoria Street for a parking area for the uses at 16 & 18 Mosley Street · only. In addition, the by-law recognizes the existing 0.0 metre setback of the driveway from the existing building at 16 Mosley Street and permits pre-cast concrete curbing for the parking area, whereas the by-law currently requires a permanent concrete curb. I also certify that the 20 day appeal period expired on the 6th day of November, 2000, and to this date no notice of appeal of the By- law has been filed by any person in the office of the Clerk.
