BYLAW - Amend 2213 78 (Baldwin Feed Mill) - 20000627 - 419300DBaldwin Feed Mill THE CORPORATION OF THE TOWN OF AURORA By-law Number 4193-00.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1) THAT the zoning category applying to the lands shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Restricted Industrial Ml-A1 Exception Zone" and "Special Mixed Density residential (R5) Zone" to "Central Commercial (C2-12) Exception Zone". 2) That Section 21 is hereby amended by adding the following as Section 21.14 "Central Commercial (C2-12) Exception Zone": 21.14 Notwithstanding any provisions to the contrary, the lands zoned C2-12 shall be construed as being one lot so that the provisions of this by-law shall apply collectively to the lands within this zone, notwithstanding their division into two or more parcels. 21.14.1 Uses Permitted antique shops business and professional offices, excluding medical health centres and commercial clubs, provided the combined floor area of health centres and commercial clubs does not exceed 560 square metres personal service shops restaurants, excluding drive-thru and take-out, provided that the combined floor area of all restaurants does not exceed twenty-seven percent of the total commercial floor area retail stores excluding convenience retail and automotive related uses service shops, light studios warehousing 21.14.2 Zone Requirements 21.14.2.1 Lot Specifications Lot Area (minimum): Lot Frontage (minimum) Wellington Street: Centre Street: 21.14.2.2 Siting Specifications Wellington Street (minimum): Centre Street (minimum): Western Property Line (minimum): Eastern Property Line (minimum): 4400.0 square metres 45.0 metres 35.0 metres 0.0 metres 11.0 metres 11.0 metres 18.0 metres 21.14.2.3 Building Specifications In accordance with Section 21.2.3. 21.14.3 Parking Location The provisions of Section 21.2.4 shall not apply. 21.14.4 Manoeuvring Area and Access Specifications Notwithstanding the provisions of Section 6.26, the minimum manoeuvring area shall be 6.3 metres. Notwithstanding the provisions of Section 6.27 .8, the minimum width of the driveway at the street line shall be 7.5 metres. All other provisions of Sections 6.26 and 6.27.8 shall apply. 21.14.5 Buffer Strip Requirements Notwithstanding the provisions of Section 6.31, the required buffer strip along the western property line, north of Centre Street, shall have a minimum width of5.8 metres. All other provisions of Section 6.31 shall apply. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Explanatory Note Re: Zoning By-law Number 4193-00.D By-law 4193-00.D has the following purpose and effect: To amend the provisions of the "Central Connnercial (C2-12) Exception Zone" within By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, effecting lands identified as East Part Lot 2 Plan 107 (120 Wellington Street East), Part Lot 1 Plan 107, Lot 109 Plan 246, Part 1 Plan 65R-18213 (124 Wellington Street East), Part Lot 1 Plan 107, Part 5 Plan 65R-18213 (124 Centre Street), and Part Lot 102 Plan 246, Part 4 Plan 65R-18213 (128 Centre Street). The amendment is to allow for the renovation of the existing building on the lands to permit the following uses: antique shops, business and professional offices (excluding medical), health centres and connnercial clubs (maximum size 560-m2), personal service shops, restaurants (maximum 27 percent of the building), retail stores (excluding convenience connnercial and automotive related uses), light service shops, studios, and warehousing. Specific lot, siting and building provisions have been incorporated into the by-law to reflect the siting of the existing structure.
