BEING A BY-LAW to adopt Official Plan Amendment No. 36
The Council of the Corporation of the Town of Aurora, under Section 17 (6) of the
Planning Act, RSO 1990 Chapter P. 13 as amended, hereby enacts as follows:
1. Official Plan Amendment No. 36 for the Town of Aurora, consisting of the
attached explanatory text and schedules, is hereby adopted.
2. The Clerk is hereby authorized and directed to make application to the Regional
Municipality of York for exemption of Official Plan Amendment No. 36 for the
Town of Aurora from Regional approval.
3. This By-law shall come into force and take effect on the day of the final passage
thereof.

I, Bob Panizza, hereby certify that Official Plan Amendment No. 36 for the Town of Aurora
Planning Area was adopted by By-law No. 4214-00.D, passed by the Council of the Corporation
of the Town of Aurora on the 12th day of September, 2000. I also certify that by letter dated July
26 2000, the Regional Municipality of York, exempted Official Plan Amendment No. 36 from
Regional approval pursuant to Subsections (9) and (10) of Section 17 of the Planning Act (1990).
A Notice of Adoption was circulated in the form and to the persons prescribed by Ontario
Regulation 198/96, as amended, made by the Lieutenant Governor-in-Council under Subsection
(23) of Section 17 of The Planning Act (1990).

PART 1: THE PREAMBLE
1.0 INTRODUCTION
This part of the Amendment entitled Part 1: The Preamble, introduces the Amendment and
describes the context and planning process leading to the document's preparation. It is for
explanatory purposes only and does not form part of the Amendment.
2.0 PURPOSE
The purpose of this amendment is to amend the provisions ofthe existing land use designation
on the subject lands shown on Schedule "A", attached hereto and forming part of this amendment,
to allow the use of the lands for the development of a freestanding office complex and ancillary
uses.
3.0 LOCATION
The subject lands affected by this amendment are located at the southwest corner of St. John's
Sideroad and Earl Stewart Drive, better described as Lots 5, 6 and Part of Lot 7 on Registered
Plan 65M-2873. The subject lands are bounded on the north by St. John's Sideroad, on the east
by Earl Stewart Drive, on the south by Isaacson Crescent, and on the west by the Ontario Hydro
Corridor.
4.0 BASIS OF THE AMENDMENT
Council has enacted this amendment in response to the following:
4.1 The subject property is designated "Prestige Industrial" and "Major Open Space Specific"
in the Aurora East Industrial Estates Secondary Plan. This Secondary Plan forms part of
the Town of Aurora Official Plan, as set out in Section 3.3.2a.

4.2 The "Prestige Industrial" classification ofland is specifically described in Section 2.2.1 to
the above mentioned Aurora East Industrial Estates Secondary Plan, and provides that:
"The predominate use ofland in the designated area shall be manufacturing, assembling,
fabrication, processing, warehousing, trade schools, daycare centres, wholesaling and
the internal storage of goods. Offices which are in conjunction with one of the above
mentioned uses shall be permitted, provided that the floor areas and building size do not
attract from the character of the industrial area."
4.3 The Aurora Estate Industrial Estates Secondary Plan shows a small portion ofthe subject
lands as within an open space designation. This designation is no longer relevant since
previous industrial subdivision approvals and subsequent residential development approvals
(Bayview Wellington North) have led to detail design work which reconfigured and reduced
the open space area. As well, all of the subject lands previously designated open space have
since been rezoned to "Prestige Industrial".
4.4 A rezoning application has been filed with the Town of Aurora to allow for the development
of the subject lands for a 6-storey office building complex, including ancillary uses and
related parking and landscaping. The office complex, which is contemplated, is not being
developed in conjunction with any intended industrial uses, but is intended to be
freestanding, and contain predominately office uses.
4.5 While the Aurora Official Plan contains policies that provide for freestanding office
buildings in the Prestige Industrial area, these provisions do not specifically permit the
intended use on the subject land. Consequently an amendment is deemed appropriate prior
to the adoption the implementing zoning by-law.
· 4.6 The development of the subject lands is intended to be regulated through the zoning by-law,
which will establish specific uses permitted on the property, together with the appropriate
standards pertaining to siting and building specifications to regulate the built form. In
addition, site plan approval will be required prior to development.

PART 2: THE AMENDMENT
1.0 INTRODUCTION
All of this part of the document entitled Part 2: The Amendment, consisting of the following text
and attached map, designated Schedule "A" (Land Use Plan), and Schedule "H" (Site Specific
Policy Areas) constitutes Amendment No. 36 to the Official Plan for the Town of Aurora.
2.0 DETAILS OF THE AMENDMENT
The Official Plan of the Town of Aurora is hereby amended as follows:
Item (1): Schedule "A"-Land Use Plan is amended by changing the land use designation from
"Major Open Space Specific" to "Prestige Industrial" as shown on Schedule "A"
attached hereto, and forming part of this amendment.
Item (2): Section 3.3.2 of the Town Official Plan entitled Site Specific Policy Areas is hereby
amended by adding a Section d) as follows:
"d) The lands designated as Prestige Industrial in Lots 5, 6 and Part of Lot 7 on
Plan 65M-2873 and bounded by St. John's Sideroad, Earl Stewart Drive,
Isaacson Crescent, and the Ontario Hydro Corridor may be used for a
freestanding office complex."
Item (3):Schedule "H" -Site Specific Policy Areas is amended to include and reference the
subject lands as 3.3.2.d.

3.0 IMPLEMENTATION AND INTERPRETATION
3.1 The implementation and interpretation of this Amendment shall be in accordance with the
respective policies of the Aurora Official Plan, Zoning By-law, and Site Plan Agreements.
EXPLANATORY NOTE
Re: Official Plan Amendment Number 36
Amendment No. 36 affects the parcel of land bounded on the north side by St. Jolm's Sideroad,
on the east by Earl Stewart Drive, on the south by Isaacson Crescent, and on the west by the
Ontario Hydro Corridor. The property is described as Lots 5, 6 and Part of Lot 7 on Registered
Plan 65M-2873.
The owner of the subject lands wishes to develop the site for an office complex. Amendment
Number 36 re-designates a small portion of the lands from "Major Open Space Specific" to
"Prestige Industrial" and permits the use of the lands for an office complex, whereas the previous
policies permitted industrial and accessory office uses.
