BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) THAT the zoning category applying to the lands shown in shading on Schedule "A" attached
hereto and forming part of this By-law is hereby amended from "Office Commercial (C6-1)
Exception Zone" to "Row Dwelling Residential (H)R6-42 Exception Zone".
2) THAT Section 15 is hereby amended by adding the following as Section 15.46: "Row
Dwelling Residential (H)R6-42 Exception Zone".

Notwithstanding the provisions of Section 15.3.1.3, a screen wall and/or fence with
a minimum height of 1.83 metres and a maximum height of 2 metres, shall be
provided on either side of the private outdoor living area to a minimum depth of3.6
metres. All other provisions of Section 15.3 shall apply.
In addition a noise fence shall be provided for the rear amenity areas for the blocks
abutting Wellington Street.
Frontage on Road or Street
Notwithstanding the provisions of Section 6.18 the site shall have frontage to a
public street by means of a right-of-way.
General
In accordance with Section 15.4 hereof
Holding Prefix
Notwithstanding the provisions of Section 15.46 above, while the (H) Holding prefix
is in place, no person shall within the lands zoned (H)R6-42 on Schedule "A"
attached hereto, use any lot or erect, alter or use any buildings or structures for any
purposes except those uses which existed on the date of passing of this by-law.
Furthermore, no extension or enlargement of the uses which existed on the date of
passing of this by-law shall occur, unless an amendment to this by-law is approved
by the Council of the Corporation of the Town of Aurora and comes into full force
and effect.
Removal of Holding Prefix
Prior to the passing of a by-law to remove the (H) Holding prefix from the lands
zoned (H)R6-42 or any part thereof, the Town of Aurora shall be satisfied that a site
plan agreement has been executed between the owner of the lands and the
Corporation of the Town of Aurora, and the relevant provisions of the Official Plan
shall have been complied with.
Upon removal of the (H) Holding prefix from the lands zoned (H)R6-42 pursuant to
Section 36 of the Planning Act, RSO 1990, or a successor thereto, the Provisions
applicable to the said lands shall be as set out in Sections 15.46.1 to 15.46.5.
3) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.

Explanatory Note
Re: Zoning By-law Number 3968-98.D
By-law 3968-98.0 has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora to rezone the
subject lands, being Part 2, Plan 65R-17698 from "Office Commercial (C6-l) Exception Zone"
to "Row Dwelling Residential (H)R6-42 Exception Zone". The purpose of the amendment is to
permit the development of the subject lands for forty four rowhouse condominium units.
Exceptions to the R6 zone standards are as follows: an decrease in the total parcel lot frontage
minimum from 30 metres (98.4 ft.) to 8 metres (26.2 ft.), an decrease in the lot frontage per dwelling
unit from 6.0 metres (19.68 ft) to 5.5. metres (18.0 ft); reductions in the front yard setback from 7.5
metres (24.6 feet) to 4.5 metres (14.8 feet), required rear yard building setback (Wellington Street)
from 7.5 m (24.6 ft) to 6.0 m (21.3 ft), increase in the maximum permitted height from 10 metres
(32.8 ft.) to 11.5 metres (27.7 ft.) and an increase in the maximum permitted lot coverage from 25%
to 35%.

I, Lawrence Allison, hereby certify that the notice for By-law# 3968-98.D of the Corporation of
the Town of Aurora, passed by the Council of the Corporation on the 24th day of February, 1998,
was given on the 9th day of March, 1999, in the manner and form and to the persons prescribed
by Ontario Regulation 199/96, as amended, made by the Lieutenant Governor-in-Council under
subsection (18) of section 34 of The Planning Act (1990). I also certify that the 20 day appeal
period expired on the 29th day of March, 1999, and to this date no notice of appeal of the By-law
has been filed by any person in the office of the Clerk.
