THE CORPORATION OF THE TOWN OF AURORA
By-law Number 4063-99.D
BEING A BY-IA W to deem
pan of Plan 68 not to. be pa11 of
a Registered Plan of
Subdivision.
WHEREAS Section 50(3) of the Planning Act, R.S.O. 1990, Chap. P.13, as amended, the
"Planning Act" authorizes the Council of a local municipality to pass by-laws to designate part of
any plan of subdivision that has been registered for eight years or more, not to be part of a plan
of subdivision for subdivision control purposes;
AND WHEREAS the municipal Council of the Corporation of the Town of Aurora deems it
necessary, expedient and advisable to pass a By-law in order to adequately control the
development of land in the municipality;
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPORATION OF THE
TOWN OF AURORA ENACTS AS FOLLOWS:
1. THAT the following lands be and are hereby deemed not to form part of a plan of
subdivision for the purposes of Subsection 50(3) of the Planning Act:
Lots 1 , 2 and 3, north side of Metcalfe Street
Lot 3, west side of Wells Street
Trinity Church Lot, east side of Victoria Street
all on Registered Plan 68
Town of Aurora, Regional Municipality of York
2. THAT Staff are required to provide notice of the enactment of this By-law to each owner
of land to which the By-law applies in accordance with the provisions of the Planning Act.
3. THAT the provisions of this By-law shall come into force upon the final passage thereof
and following registration in the proper land Registry Office.

Further to our meeting of July 13, 1999 I wish to confirm that the registration of
this By-law has no impact to Lots 4 and 5 on the West Side of Wells Street on
Plan 68.
The purpose of the By-law is to merge the current holdings of Trinity Anglican
Church in concert with their development application and does not result in the
loss of title to any portion of your current property.
I trust this satisfies your concerns with respect to this By-law. Should you no
longer wish a h rin before Council in accordance with your letter of June 23,

We are in receipt of your notice dated June 4'h, 1999 .;fthe passing of the above referenced By-
law by the Corporation of the Town of Aurora. Please be advised that we request a hearing
pursuant to the provisions of the Planning Act and as so directed in your notice.
The information provided with the notice is insufficient to determine the affect of the By-law
on the use and enjoyment of our property. We are concerned that the By-law may be incorrect
in its description of the lands subject to it. It would be of assistance to us if you would provide
us with a copy ofRegistered Plan 68 with the lands subject to the By-law clearly identified.
In addition to the foregoing we wish to advise that we are concerned about the manner in
which notice was issued. While the letter from Mr. Lonny Knox, Solicitor, accompanying the
notice indicates that it was to be sent by Registered Mail, it came by regular mail.

NOTICE OF THE PASSING OF A BY-LAW
BY THE CORPORATION OF THE TOWN OF AURORA
TAKE NOTICE that the Municipal Council of the Corporation of the Town of Aurora enacted By-
law 4063-99.0 on the 3re day of June, 1999, under Section 50(4) of the Planning Act.
PURSUANT to the Planning Act, this notice is provided to you as a person appearing on the last
revised assessment roll to be the owner of land to which the by-law applies.
TAKE NOTICE that Council of the Corporation of the Town of Aurora shall provide a hearing
in person or by agent to any person to whom this notice is sent, provided such person within
twenty (20) days of the mailing of this notice gives notice to the Municipal Clerk that such person
desires to make representation respecting the amendment or repeal of By-law 4063-99.0.
IN ORDER to obtain a hearing in relation to By-law 4063-99.0, you must file notice with the
Municipal Clerk not later than the 2nd day of July, 1999.
