BEING A BY-LAW to dedicate
certain lands as public
highways on Reference Plan
65R-767, 65R-6284, Registered
Plan 65M-2747, and Part of
Lot 75, Con. I, E. Y.S. forming
part of Kennedy Street,
Vandorf Road, and Engelhard
Drive.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) provide that Council may enact By-laws to establish and lay out lands as public
highways;
AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it
expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
1. THAT the land described as PARCEL STREETS-!, SECTION 65M-2747, being Block
50 (Street Widening) on Registered Plan 65M-2747, in the Town of Aurora, Regional
Municipality of York, be and is hereby dedicated as a public highway forming a part of
Kennedy Street in the Town of Aurora.
2. THAT the land described as Part of Lot 75, Concession I, E.Y.S.; Premising that the
North 74 o 00' East of the Northerly Limit of said Lot (being the Southerly limit of the
allowance for road between Lots 75 and 76) is astronomic, and referring all bearings
herein thereto; Commencing in the Northerly limit of said Lot 1g62.00 feet measured
South 74° 00' West thereon from the North-easterly angle thereof; Thence South 74° 00'
West, along the said Northerly limit, 500.00 feet; Thence South go zg• 30" East 10.09 feet
to an iron stake planted; Thence North 74° 00' East 500.00 feet to an iron stake planted;
Thence North go zg• 30" West 10.09 feet to the place of commencement; Containing by
Admeasuremenat an Area of 0.115 acres; in the Town of Aurora, Regional Municipality
of York, (formerly in the geographic Township of Whitchurch), be and is hereby dedicated
as a public highway forming a part of Vandorf Road in the Town of Aurora.
3. THAT the land described as Part of Lot 75, Concession I, E.Y.S.; Premising that the
North 74° 00' East of the Nqrtherly Limit of said Lot (being the Southerly limit of the
allowance for road between Lots 75 and 76) is astronomic, and referring all bearings
herein thereto, Commencing in the Northerly limit of said Lot 2362.00 feet measured
South 74° 00' West thereon from the North-easterly angle thereof; Thence South 74° 00'
West, along the said Northerly limit, 100.00 feet; Thence South go zg• 30" East 10.09 feet
to an iron stake planted; Thence North 74° 00' East 100.00 feet to an iron stake planted;
Thence North go zg• 30" West 10.09 feet to the place of commencement; Containing by
Admeasuremenat an Area of 0.023 acres; All As Shown outlined in distinguishing colour
on a print of a plan of survey by John C. Moore, O.L.S. dated the 25th day of March,
1965; in the Town of Aurora, Regional Municipality of York, (formerly in the geographic
Township of Whitchurch), be and is hereby dedicated as a public hlghway forming a part
of V andorf Road in the Town of Aurora.
4. THAT the land described as Part of Lots 74 and 75, Concession I, E.Y.S., designated as
Part 4 on Reference Plan 65R-767, in the Town of Aurora, Regional Municipality of York,
(formerly in the geographic Township of Whitchurch), be and is hereby dedicated as a
public highway forming a part of Vandorf Sideroad in the Town of Aurora.

thereof and following registration in the appropriate Land Registry office.

Dedication of Certain Lands as Public Highway
Date: December 16, 1998
In connection with the recent assumption of the Plan of Subdivision for Milestone
(Plan 65M-2747), Staff discovered that certain lands were conveyed to the Town for
a road widening as part of the Subdivision Agreement. The land is currently being
used as part of the Municipal road and should therefore be formally dedicated as
public highway.
Also, the Town received a Solicitor's request to dedicate certain lands on Vandorf
Road as public highway. Staff reviewed the request and determined that the lands
were conveyed to the Town through a Committee of Adjustment decision for consent
and are currently being used as part of a Municipal road.
In connection with a Solicitor's request to dedicate certain lands on Engelhard Drive
as public highway, Staff discovered that By-law 2649-84 to dedicate the subject
lands had already been enacted but was never registered. Since the legal description
for the lands set out in this by-law were not in proper format for registration, Staff
have included the revised legal description and the repeal of By-law 2649-84 into By-
law 4011-98.T.
Accordingly, Staff are hereby recommending that By-law 4011-98.T be provided 1•'
and 2"d reading at the December 16, 1998 Council Meeting, and subsequently 3'd
reading at the January 13, 1999 Council Meeting.

Municipality of York DO SOLEMNLY DECLARE, that
1. I have examined instruments numbers 11870B, 8048B and 130911
which are deeds from Charles Teasdale to The Municipal
Corporation of the Township of Whitchurch and to The Municipal
Corporation of the Town of Aurora.
2. These deeds were given by the Teasdales to The Corporation of
the Township of Whitchurch and to The Municipal Corporation of
the Town of Aurora in response to conditions in Committee of
Adjustment Decisions wherein the Teasdales severed parts of
Lots 74 and 75, Concession 1, Township of Whitchurch (now Town
of Aurora) Regional Municipality of York.
3. I understand that on completion of these severances and
fulfilment of the conditions that the severed parts of the
lots were conveyed by the Teasdales to various purchasers.
4. To the best of my knowledge and belief the lands conveyed to
The Township of Whitchurch and to the Town of Aurora have been
used for road purposes.
AND I make this solemn Declaration conscientiously believing it to
be true and knowing that it is of the same force and effect as if

We are the solicitors for7517l2 Ontario Ltd., the owner of the above noted premises. Our client
is arranging a mortgage over the said property and has been made aware of a potential title issue
with respect to the access to the property.· We enclose for your review and action an ellcerpt
from the letter received from the solicitors for the lender. As you can see from this letter,
apparently the land fronting the building has never been dedicated as a road and thus our client's
property appears to be "landlocked''. Please advise how quickly you can remedy this problem.

3. Instrument No. LT34666 is a Notice of a Subdivision Agreement between
Alliance Building Corporation Limited and The Corporation of the Town of
Aurora registered on the 20m day of January, 1981.
REQUIRED: Prior to the advance of funds under this transaction, production
and registration of a good and valid Release of this Agreement. In the event that
this is not available, we shall require satisfactory evidence from the
Municipality that the terms and conditions of the Agreement have been complied
with to date and sufficient deposits received to ensure compliance with any
ongoing works.
4. Our search of title indicates that the portion of Engelhard~·· which fronts the
property and extend south to Vandorf Road, being parts to 36 1 elusive on
Plan 65R-6284, a copy of which Plan is enclosed with the opy of this
letter for your reference, has never been dedicated as a road by The Corporation
of the Town of Aurora, the present registered owner of these parts. A copy of
Plan 65R-6882 is also enclosed.
Apparently, what is shown on this Plan as Parts 2, 12, 15, 18 and 32 were
previously closed and stopped up by By-Law 2598-83, with a view that a new
road would be provided along Parts 32 to 36 inclusive. As this re-routed
access remains undedicated, the lands appear to be "landlocked" with no access.
