BEING A BY-LAW to dedicate certain
lands as public highways on Reference
Plans 65R-21100, 65R-21186, 65R-16435,
65R-21487, and 65R-19033 forming part
of Centre Street, Temperance Street and
Renville Crescent.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) provide that Council may enact By-laws to establish and lay out lands as public
highways;
AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it
expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
1. THAT the land described as Part of Lot 6 (first range south of Centre Street, east of
railway), Registered Plan 107, designated as Parts 1 and 2 on Reference Plan 65R-21100,
in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a
public highway forming a part of Centre Street in the Town of Aurora.
2. THAT the land described as Part of Lot 2 (first range south of Centre Street, west of
railway), Registered Plan 107, designated as Parts 4 and 5 on Reference Plan 65R-21186,
in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a
public highway forming a part of Centre Street in the Town of Aurora.
3. THAT the land described as Part of Lot 109, Registered Plan 246 and Part of Lot 1 (first
range south of Centre Street, west of railway), Registered Plan 107 and Part of Lot 1
(second range nortb of Centre Street, west of railway), Registered Plan 107, designated
as Parts 3 and 6 on Reference Plan 65R-21186, in the Town of Aurora, Regional
Municipality of York, be and is hereby dedicated as a public highway forming a part of
Centre Street in the Town of Aurora.
4. THAT the land described as Part of Lot 48, Registered Plan 246, designated as Part 2 on
Reference Plan 65R-16435, in the Town of Aurora, Regional Municipality of York, be and
is hereby dedicated as a public highway forming a part of Temperance Street in the Town
of Aurora.
5. THAT the land described as Part of Lot 23, Registered Plan 9, designated as Part 6 on
Reference Plan 65R-21487, in the Town of Aurora, Regional Municipality of York, be and
is hereby dedicated as a public highway forming a part of Temperance Street in the Town
of Aurora.
6. THAT the land described as Part of Lot 75, Concession I, E.Y.S., designated as Part 2 on
Reference Plan 65R-19033, in the Town of Aurora, Regional Municipality of York (in the
geographic Township of Whitchurch), be and is hereby dedicated as a public highway
forming a part of Benville Crescent in the Town of Aurora.
7. THAT the provisions of this By-law shaH come into force and effect upon final passage
thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS 8TH DAY OF SEPTEMBER, 1999.
TIME AND FINALLY PASSED THIS 22ND DAY OF SEPTEMBER, 1999.

vehicles, machinery, eqUipment, materials and supplies, shill have the right of free unimpeded
access to the Servient Lands at all times and for all p.uposes and things necessary for or incidental
to the exercise and enjoymem of the rights hereby gr.uned.
It Is understood and agreed by and between the Transferor and the Tran!lferee herein thlt the
burden of this indenture and of all covenants herein contained shall run with and burden the
Servient Lands and ail those having an interest therein from time to time and that the benefit of
thls indenture tDd of all tbe covenants herein cODllined shill run with and benefit the dominant
lani~. beinB 1 system of Municipal works and servkes, including bur nor limited to a sys~m of
worb and stro'ices located in and upon highways adjacent to the Servient l..ands, and being siruate
in the Town of Aurora, Rr:Jion of York. togc!hc:r with tbc lands and structures appunenant tbefelO
and upon all those ha.vU!g an interest therCin from.timc to time, and that this indrnNre shall be
binding upon and enure to the benefit of the Transferor aDd the Transferee and their respective
successOrs and aniens.
The Transferor, for Itself, its S'JC.Ct$SOts and its m~ns hereby covenants that uoJcsS given
pennisslon in writing in advance by the Transferee, ii will not Use or permit the use of the
Servient Lands, except as a driveway or Janeway ml that it will not pennit any buildings,
structures, ftnee!, trees or obstructions to be situate on the Servient Lands and that it will not
pennit the Servient Lands to be paved with concrete, or change the grade or elevations of the
Servient Lands, or do or permit anything to be done to the Servient Lands wbieh may injure or
damage the Services.
Provided that !he Transferee, in exercising the rights hereby created; shall take sUeh actions as
are neeessazy in ll'.c opinion of lhe Transferee to restore the elevation and-surfue conditions of
tlu! Servient Lands, but sN.II not be liable for damageJ occasioned thereby, except for the
negligent performance of such restontion.
The-Transferor, for itself, its sueecuors and assigns, hereby covenants and ;~;grces with T~feree
its sUccessors and assigns, that the Transferee, its successors and assigns,. shall aM may peaeeably
hold and enjoy the rights, privileges and easements hereby gnnted without hindrance, motesbition
or interruption on the part of the Transferor, its successors aOd assigns or of any pe!'Son.-rum or
corporation claiming by, through, under or in mat fer the Transferor, its successors and assigns.
Notwithstanding any rule of la.W·Or equily, :11 Services shall be deemed to be a'nd shill remtin the
property of the Transferee, even though such Services.may become annexed or affixed to the
Servient Lands •
