BYLAW - Dedicate Certain Lands As Public Highways - 19990210 - 402899TTHE CORPORATION OF THE TOWN OF AURORA By-law Number 4028-99. T BEING A BY-LAW to dedicate certain lands as public highways on Registered Plan 39 and Expropriation Plan No. 269023 forming part of Reuben Street and St. John's Sideroad. WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as amended) provide that Council may enact By-laws to establish and Jay out lands as public highways; AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it expedient to dedicate certain lands and reserves as public highways; NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS AS FOLLOWS: 1. THAT the land described as Part of Lots 19 and 22, Registered Plan 39, designated as Part 1 on Reference Plan 65R-20573, in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a public highway forming a part of Reuben Street in the Town of Aurora. 2. THAT the land described as Part of Lot 86, Concession I, WYS, designated as Part 7 on Expropriation Plan No. 269023, in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a public highway forming a part of St. John's Sideroad in the Town of Aurora. 3. THAT the provisions of this By-law shall come into force and effect upon final passage thereof and following registration in the appropriate Land Registry office. NE CORNER ST. JOHN'S SIDEROAD & BATHURST STREET -~ 0 Ballymore is the owner of approximately 38 acres north of St. John's Sideroad and east of Bathurst Street in Aurora. A parcel of land was expropriated from the property by the Town prior to Ballymore purchasing the property. At the time of closing of the Ballymore purchase, the expropriated lands had not been dedicated as Public Highway by the Town. Please see attached letter from the Legal Department of York Region. Please advise the undersigned of the current status. If the Town has not yet enacted the required bylaw, we would respectfully ask you to do so as soon as possible.
