AFFIDAVIT UNDER SECTION 34(22) OF THE PLANNING ACT (1990)
I, Bob Panizza, hereby certify that the notice for By-law 4081-99.D of the Corporation of the
Town of Aurora, passed by the Council of the Corporation on the 21st day of July, 1999, was
given on the 4"' day of August, 1999, in the manner and form and to the persons prescribed by
Ontario Regulation 199/96, as amended, made by the Lieutenant Governor-in-Council under
subsection (18) of section 34 of The Planning Act (1990). I also certify that the 20 day appeal
period expired on the 24"' day of August, 1999 and to this date no notice of appeal of the By-law
has been filed by any person in the office of the Clerk.

By-law Number 4081-99.D
BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
I) THAT the zoning category applying to the lands shown in dark outline on Schedule "A"
attached hereto and forming part of this By-law is hereby amended from "Environmental
Protection (E.P.) Zone" to "Environmental Protection (EP-11) Exception Zone".
2) THAT Section 30 is hereby amended by adding the following as Section 30.3.12
"Environmental Protection (EP-11) Exception Zone".
30.3.12.1 Uses Permitted
-one semi-detached dwelling unit per lot
-private home day care
For the purposes of the EP-11 Zone, section 3.17.1 shall not apply.

30.3.12.2.2.1 Notwithstanding the provisions of Section 6.48.1, the required minimum
distance separation between balconies, open-sided roofed porches, uncovered
terraces, patios, steps and landings, and the common lot line between attached
units shall be nil.
30.3.12.2.2.2 Notwithstanding the above, the minimum required setback from the common
lot line between an attached pair of dwelling units shall be nil for the main
building and the garage.
30.3.12.2.3 Building Specifications

Explanatory Note
Re: Zoning By-law 4081-99.D
By-law 4081-99.D has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject
lands, Part of Lots 24 and 25, Registered Plan 9, municipally known as 35 & 37 Tyler Street, from
"Environmental Protection (E.P.) Zone" to "Environmental Protection (EP-11) Exception Zone".
The purpose of the amendment is to allow for the existing building on the lands to be used as a
semi-detached structure. Lot and siting specifications have been defined to limit the building
envelope available to that of the existing structure.
