BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) THAT Section 23.5.1 "Shopping Centre Commercial (C4-5) Exception Zone" is hereby
amended by replacing the contents of this section with the following:

medical and dental laboratories

one apartment suite per shopping centre for caretaker accommodation in
accordance with the provisions of Section 7.4
Notwithstanding any provisions to the contrary, for the purposes of the C4-5 zone,
the following definition shall apply:
Restaurant, Drive-Thru:
means a premises, with or without seating, used for the preparation and serving of
food and beverages to the public, which includes order or window service to the
public while in motor vehicles which motor vehicles approach in designated lanes.

In accordance with Section 6.49 hereof, with the exception that the minimum width
of the landscape strip abutting Wellington Street East and John West Way shall be
a minimum of3.0 metres; all other lot lines shall be a minimum of 1.5 metres.

In accordance with Section 6.49 hereof.
2) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.

Explanatory Note
Re: Zoning By-law Number 4050-99.D
By-law 4050-99.D has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to add drive-thru
restaurants as an additional permitted use for 296, 300 and 304 Wellington Street East. Additionally,
the By-law will permit the loading spaces to face the street, reduction in the minimum rear yard
setback from 7.5 metres to 4.0 metres, reduction in the minimum setback from Wellington Street
from 15.0 metres to 3.0 metres, and reduction in the minimum side yard landscape strip from 3.0
metres to 1.5 metres.

I, Bob Panizza, hereby certify that the notice for By-law #4050-99 .D of the Corporation of the
Town of Aurora, passed by the Council of the Corporation on the 25th day of August, 1999, was
given on the 31st day of August, 1999, in the manner and form and to the persons prescribed by
Ontario Regulation 199/96, as amended, made by the Lieutenant Governor-in-Council under
subsection (18) of section 34 of The Planning Act (1990). I also certify that the 20 day appeal
period expired on the 20th day of September, 1999, and to this date no notice of appeal of the By-
law has been filed by any person in the office of the Clerk.
