AFFIDAVIT UNDER SECTION 34(22) OF THE PLANNING ACT (1990)
I, Bob Panizza, hereby certify that the notice for By-law #4079-99 .D of the Corporation of the
Town of Aurora, passed by the Council of the Corporation on the 25th day of August, 1999, was
given on the 7th day of August, 1999, in the manner and form and to the persons prescribed by
Ontario Regulation 199/96, as amended, made by the Lieutenant Govemor-in"Council under
subsection (18) of section 34 of The Planning Act (1990). I also certify that the 20 day appeal
period expired on the 27th day of September, 1999, and to this date no notice of appeal of the By-
law has been filed by any person in the office of the Clerk.

BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts
as follows:
1) THAT Section 28.3.5 is hereby amended by deleting the contents of that
section and adding the following:
"The existing two storey building, the two portable classroom building
with enclosed connecting walkway, and the two portable classroom
building with connecting vestibule/washrooms, on the subject lands,
being Part of Lot 80, Concession 1 EYS, shall be used for a
Commercial, Private or Public School for children commencing at the
age of 2.5 years or older, for a period of no longer than three years
from the date of passing of this By-law."
2) No part of this By-law will come into force until the prov1s1ons of the
Planning Act have been complied with, but subject to such provisions the
By-law will take effect from the day of passing hereof.
READ A FIRST AND SECOND TIME THIS 21ST DAY OF JULY 1999.
READ A THIRD TIME AND FINALLY PASSED THIS 25TH DAY OF AUGUST 1999.

Explanatory Note
Re: Zoning By-law Number 4079-99.D
By-law 4079-99.0 has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the
subject lands, being Part of Lot 80, Concession 1 EYS, located at the southwest comer of
Bayview Avenue and Wellington Street East on a temporary basis. On September 25, 1999 the
zoning would revert back to its original "Rural (RU) Zone" from the current "Holding (H)
Zone" and "Institutional (1-5) Exception Zone". The amendment is to permit the continuation
of the current rural use of the eastern portion of the site and the use of the existing two storey
building and two portable classroom buildings on the western portion of the site for a school,
for children commencing at the age of 2.5 years or older, for a period not to exceed three years
from the date of passage of the By-law. After such time, Town Council may choose to permit
the use to be continued or have the lands return to their former permitted use.
