BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation ofthe Town of Aurora enacts as follows:
I) THAT Section 23.C "Residential Commercial (C7) Exception Zone" is hereby amended by
replacing the contents of this section with the following:

The following provisions shall apply to all Residential Commercial (C7) Zones.
Uses Permitted
a) Main Floor
banks or financial establishments
business and professional offices, excluding medical
restaurants
dry cleaner's distribution depots
personal service shops
travel agencies
retail stores excluding supermarkets and warehouse drugstores
private clubs and health centres
day care centres
data processing centres
The commercial floor area of the uses listed above shall not exceed 750
square metres.
b) Upper Floors
Notwithstanding the provisions of Sections 6.13.5 and 6.13.6, the upper
floors shall be used for a maximum of 68 dwelling units in accordance
with Section 7.4.

A minimum nil landscape strip shall be provided adjacent to Wellington Street
East, Centre Street and Industrial Parkway North.
Parking
A minimum of 123 parking spaces shall be provided.
Loading
Notwithstanding the provisions of Section 19 .2, the required number of loading
spaces shall be nil.
Accessory Structures
Notwithstanding the provisions of Section 6.2, a padmount transformer in the
required exterior side yard adjacent to Centre Street shall have a minimum setback
of 1.0 metres. Children's play equipment may be permitted in the required rear
yard provided it is set back a minimum of 1.2 metres from all property lines.
Yard and Setback Encroachments Permitted
Retaining walls shall be permitted to encroach the full extent of the required yard
setbacks. First floor canopies shall be permitted to encroach the full extent of the
required yard setbacks for commercial units only.
Below Grade Setbacks
Not applicable.
Amenity Area
Notwithstanding the provisions of Section 7.2, a minimum of 1,450 square metres
of outdoor amenity space shall be located on the rooftop, and a minimum of ISO
square metres of outdoor amenity space shall be located within a parkette area at
grade.
General
The provisions of Sections 7.8 and 24.4 shall not apply.
23.C.12 Holding Prefix
Notwithstanding the provisions of Section 23.C.l above, while the "(H)" Holding
prefix is in place, ao person shall within the lands zoned (H)C7 on Schedule "A"
attached hereto, use any lot or erect, alter or use any buildings or structures for
any purposes except those uses which existed on the date of passing of this by-
law. Furthermore, no extension or enlargement of the uses which existed on the
date of passing of this by-law shall occur, unless an amendment to this by-law is
approved by the Council of the Corporation of the Town of Aurora and comes
into full force and effect.
Removal of Holding Prefix
Prior to the passing of a by-law to remove the "(H)" Holding prefix from the lands
zoned (H)C7 or any part thereof, the Town of Aurora shall be satisfied that a site
plan agreement and other agreement(s) concerning the phasing or servicing of the
lands have been executed between the owner of the lands and the Corporation of
the Town of Aurora.
2) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.

Explanatory Note
Re: Zoning By-law Number 4038-99.D
By-law 4038-99.0 has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to amend the
provisions of the C7 zone resulting in a relocation of the building envelope from a location generally
abutting Centre Street to Wellington Street East!Indusrial Parkway North. Additionally, the parking
space adjustment has been altered to account for a decrease in total building area and a loss of three
parking spaces resulting from the closure of Duggan Lane.
