BYLAW - Amend 2213 78 (Glenowen) - 199901205 - 323790(Glenowen) BY-~ NUMBER 3237-90 OF THE CORPORATION OF THE TCWN OF AURORA BEING A BY-~ to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NCM THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. That the ·zoning category applying to the lands shown in shading on Schedule 1 A 1 attached hereto and fonning part of this By-law is hereby amended from "Central Conrnercial (C2) Zone" to "Central Cormnercial (C2-9) Exception Zone". 2. That Section 21 is hereby amended by adding the following as Section 21.11 "Central Corrmercial (C2-9) Exception Zone". "The lands shown zoned 1 C2-9 1 on Schedule 1 A 1 shall be used for business and professional offices excluding medical, and for retail stores excluding convenience retail, service shops, personal and dwelling units above the first storey, provided the following: i) The canbined ccmnercial floor area of the existing structure and floor space addition shall not exceed 880 square metres, exclusive of the enclosed parking level; ii) The retail use shall be restricted to the existing heritage structure and to the first level above the enclosed parking area; iii) Notwithstanding the provisions of Sections 6.26 and Section 21.2.4, the minimum required parking shall be 33 spaces, 31 of which shall be enclosed; iv) Notwithstanding the provisions of Section 6.26, the minimum required . maneuvering area shall be 6. 7 metres; v) Notwithstanding the provisions of Section 19.2, the required number of loading spaces shall be nil; vi) Notwithstanding the provisions of Section 21.2.2, the minimum required rear yard shall be 4. 2 metres; vii) Notwithstanding the provisions of Section 6.31, no buffer strip shall be required along property lines adjacent to residential zones or uses. The minimum setback from the portion of the eastern property line abutting the residential zone shall be 1.2 metres with the exception of the enclosed parking area which shall be nil. The maximum extent of the eastern wall o:f the parking level shall be 2 .15 metres above grade. 2. No part of this By-law will came into force until the provisions of the Planning Act have been canplied with, but subject to such provisions the By-law will take effect from the day of passing thereof. TO BY-LAW No. :!Jd 31-fry .. ··-··--· ---····------.. -. -----=---· .. -.-====··=·· -::: ... -:::: .. =· ============== Explanatory Note Re: Zoning By-law 3Z31-1o 000173 By-law has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands being Lot 137 Registered Plan 246, known rmmicipally as 38 Wellington Street East from "Central Commercial (C2) Zone" to "Central Corturercial (C2-9) Exception Zone". The amendment is to pennit the developnent of the site for a 2 storey office/ccmnercial building, including the retention of the front portion of the existing heritage structure on the site. Site specific exceptions to the standard by-law provisions include a restriction of the pennitted uses to business and professional offices, excluding medical, retail stores excluding convenience retail; personal service shops and dwelling units above the first storey; a limitation in the combined commercial floor area of the existing structure and addition to 880 square metres (9,472.5 square feet), exclusive of the enclosed parking level; a restriction of retail use· to the existing structure and the first level above the enclosed parking area; reductions of the minimum required parking from 37 to 33 spaces, 31 of which shall be enclosed, the minimum required manoeuvering area from 7.4 to 6. 7 metres (24.3 to 22.0 feet) and the required number of loading spaces from one to nil. The amending by-law also requires a minimum rear yard setback of 4. 2 metres ( 13. 8 feet) from Centre Street, a minimum setback of 1. 2 metres ( 3. 9 feet) from the portion of the eastern property line abutting the residential zone, with the exception of the enclosed parking area which shall be nil, and that the maximum extent of the eastern wall of the parking level be 2.15 metres (7.05 feet) above grade.
