BEING A BY-LAW to dedicate
certain lands as public
highways on Reference Plan
65R-463 and 65R-20573
forming part of Gurnett Street
and Reuben Street.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) provide that Council may enact By-laws to establish and lay out lands as public
highways;
AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it
expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
1. THAT the land described .as Part of Lots 10 and 11, Plan 1B and Part of Lot 6 (west side
of Victoria Street), Plan 68, designated as Parts 2, 3, 4 and 5 on Reference Plan 65R-463,
in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a
public highway forming a part of Gurnett Street in the Town of Aurora;
2. THAT the land described as Part of Lot 22 and Part of Lot 19, Registered Plan 39,
designated as Part 1 on Reference Plan 65R-20573 in the Town of Aurora, Regional
Municipality of York, be and is hereby dedicated as a public highway forming a part of
Reuben Street in the Town of Aurora;
3. THAT the provisions of this By-law shall come into force and effect upon final passage
thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS I4" DAY OF OCTOBER, I998.
READ A THIRD TIME AND FINALLY PASSED 28'h THIS DAY OF OCTOBER, 1998.

Dedication of certain Lands as Public Highway
Date: October 14, 1 998
On September 16, 1998 the Town received a request from Deane Ewart of Hacker,
Gignac, Rice to dedicate certain lands on Reference Plan 65R-463 as public highway
forming part of Gurnett Street. The appropriate internal departments were circulated
for comments and it was determined that Parts 2, 3, 4 and 5 on Reference Plan 65R-
463 are currently being used as a Municipal road.
Also, in connection with the review of a prior request to purchase property fronting
on Reuben Street (old George Street pool parking lot), Town staff identified that the
Turning Circle at the end of Reuben Street is on Town owned property and was never
formally dedicated as a public road. The survey defining the turning circle was
recently depo.sited and the Town is now in a position to proceed with the dedication
of the lands.
Staff are therefore recommending that By-law 3994-98. T, being a By-law to dedicate
certain lands as public highway forming part of Gurnett Street and Reuben Street be

Further to your request for the Town to dedicate the above-noted lands as public
highway, please be advised that the Corporate Services Department will be
recommending 15
' and 2"d reading of a By-law dedicating the lands for Council's
consideration at the Council Meeting to be held on October 14, 1998, and
subsequently 3'd reading consideration at the October 28, 1998 Council Meeting. The
By-law will include the dedication of Parts 2, 3, 4 and 5 only. Part 1 on the Reference
Plan does not appear to be used as a Municipal roadway at the present time.
Please note that approval of the By-law is contingent upon Council's decision. Once
the By-law has been provided final reading and executed by the Mayor and Clerk, the
Legal Services Division will attend to its registration.
Notification of Council's decision in this regard will be provided to your firm as soon
as possible.

it. The solicitor for the mortgagee has searched the title to the abutting property owned by the
Town and verified that the Town is the owner. The problem is, however, that it appears that
there is no by-law on title dedicating the property as a public highway.
Our client requests that such a by-law be passed as quickly as possible.

It appears ftom an examination of Plan 6SR463 that the Town holds title by virtue of a number
of old deeds. My old seareh of title shows only that the Town was once the owner of our
client's property as weU as a signifJCant number of neighbouring properties.
