BEING A BY-LAW to dedicate
certain lands as public ·
highways on Reference Plan
65R-17716 within the Bayview
Wellington Centre.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) provide that Council may enact By-laws to establish and lay out lands as public
highways;
AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it
expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
I. THAT the lands designated as Part of Lots 81 and 82, Concession 1, being Part 1 on Plan
65R-17716, formerly in the geographic Township of Whitchurch, County of York, now
in the Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a
public highway forming a part of Civic Square Gate in the Town of Aurora.
2. THAT the lands designated as Part of Lot 82, Concession 1, being Part 2 on Plan 65R-
17716, formerly in the geographic Township of Whitchurch, County of York, now in the
Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a public
highway forming a part of Exley Drive in the Town of Aurora.
3. THAT the lands designated as Part of Lot 83, Concession 1, being Part 3 on Plan 65R-
17716, formerly in the geographic Township of Whitchurch, County of York, now in the
Town of Aurora, Regional Municipality of York, be and is hereby dedicated as a public
highway forming a part of Hollidge Boulevard in the Town of Aurora.
4. THAT the provisions of this By-law shall come into force and effect upon final
passage thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS lOth DAY OF January, 1996.
READ A THIRD TIME AND FINALLY PASSED THIS 24th DAY OF January, 1996.

Upon review of Plan 65M-3073, it was determined that access to the subject property
could be provided through the following lands forming part of Hollidge Boulevard:
Part Lot 83, Concession I, E.Y.S.
being Part 3 on Reference Plan 65R-17716
Town of Aurora, Regional Municipality of York
These lands were dedicated as public highway by Town of Aurora By-law 3695-96.T
which was registered on February 14, 1996 as Registration No. 673098.

I am the solicitor for the purchasers of the aforesaid property
which transaction is to close on the above noted date.
My title search reveals that access from this condominium is
obtained by travelling south on John West Way firstly over that portion of
the said street located on Plan 65M-3073 and then over the portion of that
street which is designated from north to south as Parts 8, 7 and ll on Plan
65R-13645 until one reaches Wellington Street which is a concession road.
The said Part 8 is located at the southerly boundary of Plan 65M-3073 and
consists of about a one foot strip extending across John West Way analogous
to a one foot reserve. The said Part 8 is owned by the Town of Aurora but
no bylaw has ever been passed dedicating the same as a public roadway. In
effect, the condominium property is landlocked.
Please advise as to the following:
1. Has such a dedicating bylaw been passed and, if so, will it be
registered on title prior to my closing?
2. If such passage and registration will not occur prior to my closing,
will the Town of Aurora provide me with a letter giving my clients, their
successors and assigns, written permission to pass over the said Part 8, Plan
65R-13645 until it is dedicated as a public roadway and, if so, please send
me such a letter.
