AFFIDAVIT UNDER SECTION 34(22) OF THE PLANNING ACT (1990)
I, Lawrence Allison, hereby certify that the notice for By-law #3796-98.D of the Corporation of
the Town of Aurora, passed by the Council of the Corporation on the 23"' day of July, 1998, was
given on the 5th day of August, 1998, in the manner and form and to the persons prescribed by
Ontario Regulation 199/96, as amended, made by the Lieutenant Governor-in-Council under
subsection (18) of section 34 of The Planning Act (1990). I also certify that the 20 day appeal
period expired on the 25th day of August, 1998, and to this date no notice of appeal of the By-law
has been filed by any person in the office of the Clerk.

BEING A BY-LAW to amend
By-law No. 2213-78
WHEREAS it is deemed advisable to amend by-law number 2213-78.

NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
I. That Schedule "A" is hereby amended by changing the zoning category on the lands shown
in dark outline on Schedule "A" attached hereto, and forming part of this By-law from
"Environmental Protection (E.P.) Zone" to "Third Density Apartment Residential (RA3-9)
Exception Zone" and "Environmental Protection (E.P.) Zone".
2. That Section 18 is hereby amended by adding the following as Section 18.11 "Row Dwelling
Residential (RA3-9) Exception Zone".
The lands zoned RA3-9 on Schedule "A" shall only be used in accordance with the following
provisions.
18.11.1 Uses Permitted
The lands zoned RA3-9 on Schedule "A" shall be used only for an apartment
building having a maximum of 66 units and a medium density rowhouse complex
having a maximum of 12 units.
18.11.2 Zone Requirements
Notwithstanding the provisions of Section 3.78, for the lands zoned RA3-9, the
property boundary abutting Brookland Avenue or a reserve abutting Brookland
Drive, shall be deemed to be the front lot line.

18.11.2.3 Building Specifications
In accordance with Section 18.2.3 with the exception that the maximum building
height for a rowhouse shall be 8.0 metres.
18.11.3 Amenity Area
Notwithstanding the provisions of Section 7.2, a minimum of 1000.0 square
metres of amenity area shall be provided. For each rowhouse unit that directly
abuts an interior side yard, there shall exist a private outdoor living area having
a width equal to the width of the dwelling unit, and a minimum depth (from the
wall of the dwelling unit) of 6.0 metres.
Notwithstanding the provisions of Section 15.3.1.3, a screen wall and/or fence
with a minimum height of 1.83 metres and a maximum height of2 metres, shall
be provided on either side of those private outdoor living areas directly abutting
an interior side yard to a minimum depth of3.6 metres. All other provisions of
Section 15.3 shall apply.
18.11.4 Parking
Notwithstanding the provisions of Section 6.26.1, the minimum number of
parking spaces shall be 105 of which 14 may be in tandem. For all tandem
spaces, the manoeuvring space shall be nil.
3. No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.

By-law 3796-98.D has the following purpose and effect:
To amend By-law 22 I 3-78, tlie Zoning By-law in effect in the Town of Aurora to rezone the subject
lands. Block B, Plan 550, municipally known as 15 Brookland Avenue, from "Environmental
Protection (E.P.) Zone" to "Third Density Apartment Residential (RA3-9) Exception Zone" and
"Environmental Protection (E.P.) Zone". The amendment is to permit the construction of a twelve
rowhouse units to the rear of the existing apartment building.
