BYLAW - Amend By law 2213 78 - 19980826 - 397698D15 Machell Street THE CORPORATION OF THE TOWN OF AURORA By-law Number 3976-98.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) THAT the zoning category applying to the lands shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Central Commercial (C2) Zone" to "Special Mixed Density Residential (R5-24) Exception Zone". 2) THAT Section 14 is hereby amended by adding the following as Section 14.3.23: "Special Mixed Density Residential (R5-24) Exception Zone". 14.3.23.1 14.3.23.2 14.3.23.1 14.3.23.2 Uses Permitted -one semi-detached dwelling per lot Zone Requirements Lot Specifications Lot Area per pair of units (minimum): Lot Frontage (minimum): -per pair of units -per unit Siting Specifications Front Yard (minimum): -Main Building -Garage Rear Yard (minimum) Interior Side Yard (minimum): 650.0 square metres 20.0 metres 9.0 metres 6.0 metres 6.0 metres 7.5 metres 3.0 metres 14.3.23.2.1 Notwithstanding the above, the required setback from the common lot line between an attached pair of dwelling units shall be nil for the main building and garage. 14.3.23.2.2 Notwithstanding the above and the provisions of Section 6.2, accessory buildings and structures shall be setback a minimum distance of 0.6 metres from the common lot line between attached units. 14.3.23.2.3 Notwithstanding the provisions of Section 6.48, the required minimum distance separation between balconies, open-sided roofed porches, uncovered terraces, patios, steps and landings, and the common lot line between attached units shall be nil. No encroachment greater than 1.2 metres shall be permitted into an interior side yard. 14.3.23.3 Building Specifications In accordance with Section 12.2.3. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. OF ,_ lif r= (I) SCHEDULE "A" TO BY-LAW NO. 3976-98.0 Explanatory Note Re: Zoning By-law Number 3976-98.D By-law 3976-98.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora to rezone the subject .lands, being Lot 4, Registered Plan 36 and municipally known as 15 Machell Avenue, from "Central Commercial (C2) Zone" to "Special Mixed Density Residential (RS-24) Exception Zone". The purpose of the amendment is to permit the development of the subject lands for a semi-detached building. The proposed standards are in keeping with those applied to a units constructed within a semi-detached zoning designation. Site specific exceptions for lot specifications, siting specifications and building specifications have developed in order to accommodate the site plan as approved by the municipality.
