BEING A BY-LAW to dedicate
certain lands as public
highways on Registered Plan
65M-2389 and Plan 579
forming part of Timpson Drive
and Murray Drive.
WHEREAS, the provisions of section 297 of the Municipal Act, R.S.O. 1990, c.M.45 (as
amended) provide that Council may enact By-laws to establish and lay out lands as public
highways;
AND WHEREAS, the Municipal Council of The Corporation of the Town of Aurora deems it
expedient to dedicate certain lands and reserves as public highways;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
1. THAT the land described as Parcel Reserve-1, Section 65M-2389 being Block 42 on
Registered Plan 65M-2389 in the Town of Aurora, Regional Municipality of York, be and
is hereby dedicated as a public highway forming a part of Timpson Drive in the Town of
Aurora.
2. THAT the land described as the one-foot reserve at the north end of Murray Drive, and
the one-foot reserve at the south end of Murray Drive, on Plan 579 in the Town of Aurora,
Regional Municipality of York, be and are hereby dedicated as a public highway forming
part of Murray Drive in the Town of Aurora.
3. THAT the provisions of this By-law shall come into force and effect upon final passage
thereof and following registration in the appropriate Land Registry office.
READ A FIRST AND SECOND TIME THIS 27TH DAY OF AUGUST, 1997.
READ A THIRD TIME AND FINALLY PASSED THIS 1 TH DAY OF SEPTEMBER, 1997.

which closed on May 30, 1997.
Plan No. 65M-2389 is the Plan of Subdivision immediately to
the north of our Plan 65M-2462. This plan provides access to ou~
lands via Timpson Drive which was dedicated as public highway under
th~ Plan 65M-2389. The same Plan al~o created a 0.30 meter reserve
which was 91·.;1nted to T;he Corporation of the Town of Aurora. 'A
search of Res. -1, Section 65M-2389, indicates that the :said 0. 30
meter reserve has not been dedicated as public highway. 'this
legally denies access to Wellington Street West.
It is therefore necessary that a by~law dedicating Block 42,
Plan 65M-2389, as public highway be registered.

transaction and we understand. that you represent the vendor.
I have had the opportunity of investigating title to the above
premises and without prejudice to my client's rights under· the
Agreement of Purchase and Sale, and reserving my right to submit
such further and other requisitions I may from time to time deem
appropriate, I would at this time submit to you the following

Before closing satisfactory evidence of the
(a) that the vendor has not contravened the provisions of The
Planning Act, R.S.O. 1979 and amendments thereto;
(b) that there are no executions in the hands of the Sheriff
against the vendor;
(c) that there are no unregistered liens,
restrictive covenants or easements or restrictions
of any kind against the property;
(d) compliance with The Family Law Act 1986;
rights of way,
or encumbrances
(e) that there are no arrears of taxes nor penalties for
arrears of realty taxes and/or charges for water, hydro,
electricity, gas or oil with respect to this property. We will be
making the usual searches in the utility. offices for utility
arrears. However, the final readings will not take place until the
closing date and under the provisions of the Public Utilities Act,
outstanding hydro and water accounts form a lien against the
property and may be added as outstanding taxes and collected as tax
arrears. Accordingly, we will require your firm's undertaking to
retain sufficient funds from the proceeds of the sale to pay any
outstanding accounts being the responsibility of your client(s).
(f) that all of the chattels included in the purchase price
herein, and passing to the purchaser on closing have been fully
paid for, and are not subject to any chattel mortgages or
conditional sale contracts.
5. REQUIRED: Before closing, satisfactory evidence that all
buildings on the said lands have been erected in accordance with
the appropriate statutes and by-laws of that town and any other
provincial, municipal or federal governmental authority, having
jurisdiction therein.

6. REQUIRED: Pursuant to Section 116 of the Income Tax Act, I
will require an Affidavit of Residency which is included in the
enclosed Declaration of Possession.
7. REQUIRED: Keys and vacant possession on closing.
8. REQUIRED: An opportunity for the purchasers to perform a
final inspection of the property prior to closing this transaction
to determine if any substantial or other damage has occured to the
property since the date of signing the Agreement of Purchase and
Sale. In this respect I would refer you to RE: Harkness and
Cooney (1983), 131 D.L.R. (3d) 765 and Tonon vs. Lin. The latter
case was decided by Montgomery J. and was reported in "The Lawyers
Weekly", March 8, 1991, page 10.
9. REQUIRED: Direction re funds should funds be payable to a
person or persons other than the vendor herein. Please note, as
there is a charge to have cheques certified, and as this cost is
passed on to our clients, we will not be certifying cheques in
payment of realty commission or other items which do not constitute
a lien on the property/chattels being purchased by my client.
10. I am enclosing a Statutory Declaration with respect to Goods
and Services Tax which when signed we accept in satisfaction of the
vendor's obligation to collect and pay same to the Federal~/, ~
