BYLAW - Amend By law 2213 78 (Diamond) - 19970611 - 383097DTHE CORPORATION OF THE TOWN OF AURORA By-law Number 3830-97.» BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. Diamond NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) THAT the zoning category applying to the lands shown in dark outline on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Detached Dwelling Second Density Residential (R2) Zone" and "Special Mixed Density Residential (R5) Zone to "Semi-Detached and Duplex Dwelling Third Density Residential (R3-13) Exception Zone and "Detached Dwelling Second Density Residential (R2-65) Exception Zone". 2) THAT Section 12 is hereby amended by adding the following as Section 12.15 "Semic Detached and Duplex Dwelling Third Density Residential (R3-13) Exception Zone". 12.15.1 12.15.2 12.15.2.1 12.15.2.2 Uses Permitted one semi-detached dwelling per lot Zone Requirements Lot Specifications Lot Area (minimum) per pair of units Lot Frontage (minimum) per pair of units per unit Siting Specifications Front Yard Main Building (minimum) Garage (minimum) 700.0 square metres 13.6 metres 6.8 metres 4.0 metres 5.0 metres (3676-95.D) Notwithstanding any other provisions to the contrary, on a multi-storey dwelling, the wall of the main building located above an attached garage shall not be setback more than 1.5 metres from the front wall of the garage. Rear Yard (minimum) Interior Side Yard (minimum) 15.0 metres 1.2 metres 12.15.2.2.1 Notwithstanding the provisions of Section 6.48.1, the required minimum distance separation between balconies, open-sided roofed porches, uncovered terraces, patios, steps and landings, and the common lot line between attached units shall be nil. Open-sided roofed porches not exceeding one storey in height, with or without foundation, may project 2 metres into a required exterior side yard or front yard, provided no part of the porch, including eaves and steps, is closer than 2 metres to the lot line. Where an open-sided roofed porch, with or without foundation, is located in the exterior side yard, 1 and/or front yard, and/or between the main building and the front lot line in an. interior side yard, the porch and steps shall be excluded from the calculation oflot coverage. 12.15.2.2.2 Notwithstanding the above, the minimum required setback from the common lot line between an attached pair of dwelling units shall be nil for the main building and garage. 12.15.2.2.3 Notwithstanding the above and the provlSlons of Section 6.2, unless otherwise specified, accessory buildings and structures shall be setback a minimum distance of0.6 metres from the common lot line between attached units. 12.15.2.2.4 Notwithstanding the provisions of Section 6.2.6.i, central air conditioners and/or heat pumps shall be permitted in rear yards only, subject to a minimum setback of 4.5 metres from the rear lot line. 12.15.2.3 Building Specifications 12.15.2.4 12.15.2.5 Floor Area (minimum)(per unit) minimum per unit maximum per unit Lot Coverage (maximum) Height (main building)( maximum) 90.0 square metres 205.0 square metres 35.0 percent 8.5 metres Notwithstanding the provisions of Section 6.26 and 6.28.l.i, the minimum required length of a parking space in a front yard shall be 5 metres and the maximum width of a driveway shall be as follows: Single-bay garage Double-bay garage 3.5 metres per unit 5. 7 metres per unit Notwithstanding the above, the maximum driveway width at the property line shall be 3.5 metres. Notwithstanding any provisions to the contrary, a combined total of two double-bay garages may be permitted for all lands zoned "Semi-Detached and Duplex Dwelling Third Density Residential (R3-13) Exception Zone" 3) THAT Section II is hereby amended by adding the following as Section 11.65 "Detached Dwelling Second Density Residential (R2-65) Exception Zone". 11.43.1 11.43.2 11.43.2.1 Uses Permitted In accordance with Section II.! hereof. The purpose of the amendment is to permit the redevelopment of the lands for 10 semi-detached units and one single detached unit.
