Official Plan Amendment No. 19 for the Town of Aurora, consisting of the attached explanatory text and schedules, is hereby adopted. 2. The Clerk is hereby authorized and directed to make application to the Regional Municipality of York for approval of Official Plan Amendment No. 19 for the Town of Aurora. 3. It is for explanatory purposes only and does not form part of the Amendment. 2.0 PURPOSE The purpose of this amendment is to change the land use designation on the subject lands shown on Schedule "A", "B" and "H" attached hereto and forming part of this amendment from "Industrial" to "Commercial Special" and to establish site specific policies to permit the use of the existing building on the lands for business and professional offices, limited retail uses, and limited light industrial and warehousing uses. 3.0 LOCATION The subject lands affected by this amendment are loc.ated in Part of Lot 81, Concession 1 EYS, better described as Lot 1 Registered Plan 107, Lot 109 Registered Plan 246 and Parts 1, 4 & 5, Reference Plan 65R-18213, and are made up of two parcels, one fronting on the north side of Centre Street, the other fronting on the north side of Wellington Street East. 4.0 BASIS OF THE AMENDMENT Council has enacted this amendment in response to the following: 4.1 An application has been made by 919179 Ontario Ltd. to use the exiting building located on the Wellington Street East component of the subject lands for business and professional offices, limited retail uses, and limited light industrial and warehousing uses. 4.2 The subject lands are designated "Industrial" on Schedule "A"-Land Use Plan. An existing three storey industrial building currently occupies the southern parcel of land facing Wellington Street East. Past industrial uses of the existing structure include a feed mill serviced by a rail spur, once known as the Baldwin Mills. The subject lands and building are currently vacant. The present Industrial designation precludes some of the uses being proposed. Part 1 ~ The Preamble Pa e3 4.3 The subject lands are in close proximity to the historic residential and commercial core of the community. As industrially designated lands in accordance with the Official Plan and implementing Zoning By-law, the property appears to be under utilized and less attractive to industrial development given current industrial locational criteria, site limitations imposed by property access and size, and the encroachment of residential uses that tend to constrain and inhibit full industrial usage. 4.4 Rehabilitation of the existing structure and landscaping improvements through the site plan process will add to the enhancement of Wellington Street and strengthen the connections and cohesion between the central core area and development to the west of the Canadian National Railway tracks. 4.5 Access to the lands will be via Centre and Wellington Streets. The subject lands can be serviced by all utilities and the transit system with a storm water management system will be put in place as part of the site plan. PART 2-THE AMENDMENT 1.0 INTRODUCTION All of this part of the document entitled Part 2-The Amendment, consisting of the following text and attached maps, designated Schedules "A" (Land Use Plan), Schedule "B" (Commercial Centres) and Schedule "H" (Site Specific Policy Areas), constitutes Amendment No. 19 to the Official Plan for the Town of Aurora. 2.0 DETAILS OF THE AMENDMENT The Official Plan of the Town of Aurora is hereby amended as follows: Item (1): The area indicated on Schedule "A"-Land Use Plan, attached hereto and forming part of this amendment, being Part of Lot 81, Concession 1 EYS, better described as Lot 1 Registered Plan 107, Lot 109 Registered Plan 246 and Parts 1, 4 & 5, Reference Plan 65R -18213, are hereby redesignated from "Industrial" to "Commercial Special". Item (2): That Schedule "B"-Commercial Centres, attached hereto and forming part of this amendment, is herby amended to designate the subject lands as "Commercial Special". Item (3) That Schedule "H" -Site Specific Policy Areas, attached hereto and forming part of this amendment, is herby amended to include and reference the subject lands as 3.2.7.g. Item ( 4): Section 3.2.7 (Site Specific Policy Areas) is hereby amended by adding the following as Section 3.2.7.g. The following policies apply to the lands designated as"Commercial Special"on Part of Lot 81, Concession 1 EYS, better described as Lot 1 Registered Plan 107, Lot 1 09 Registered Plan 246 and Parts 1, 4 & 5, Reference Plan 65R-18213 as shown on Schedule "A", "B" and "H" attached hereto and forming part of this plan. i) Uses permitted within the existing building located on the subject lands shall be limited to business and professional offices, limited retail uses, and limited light industrial and warehousing uses. The subject uses shall be implemented by way of a site specific zoning by-law that may regulate the nature, size and location of specific uses. ii) Access to the subject lands shall be in accordance with the directives provided by the Region of York Transportation Department and the Aurora Public Works Department. Development of the lands shall not take place until the above agencies are satisfied that safe ingress/egress can be achieved, a matter that may include the upgrading of both Wellington Street East, and Centre Street between Walton Drive and Industrial Parkway North. iii) Implementation and development contemplated for the subject lands shall require the execution of a site plan agreement with the Town. The site plan for the development shall ensure high standards in the design and renovation of the existing building as it may pertain to exterior cladding, fenestration, treatment of outside servicing appurtenances and landscaping.. Such an agreement may address specific and adequate provisions for such matters as: 1. perimeter and parking lot landscaping ii fencing and berm treatment iii access and servicing easements, IV municipal water and sanitary provisions, v vehicular and pedestrian ingress and egress, VI parking and internal circulation, vii stormwater management, vm site treatment of area adjacent to the CNR right-of-way as may be required by the Town or Canadian National Railway, IX design and architectural treatment of the existing building, x screening of refuse bins and rooftop mechanical equipment. iv) The northerly component ofthe subject lands abutting Centre Street shall be restricted for parking purposes only, associated with uses permitted in the existing building fronting Wellington Street East. The site plan agreement shall incorporate the requirement for a restrictive covenant applying to both parcels ofland addressing parking and other issues where required. v) The site plan agreement shall ensure the implementation of effective measures to mitigate the effects of the subject development on abutting residential lands through the use of appropriate fencing, berming and landscaping treatment. Regard shall be had to the location oflighting, garbage receptacles, and other intruding elements.
