BYLAW - Exempt Certain Lots on Plan 107 From Part Lot Control - 19961009 - 376696DBY-LAW NUMBER 3766-96.D OF THE CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW to exempt certain lots on Registered Plan 107 in Aurora, from the Part Lot Control provisions as provided in subsection 50 (5) of the Planning Act, R.S.O. 1990, c.P.l3 (as amended). (Diamond) WHEREAS subsection 50(7) of the Planning Act, R.S.O. 1990, c.P.l3 (as amended) provides that the Council of a local Municipality may by by-law provide that the part lot control provisions as provided in subsection 50(5) of the said Act do not apply to the land that is within a registered plan of subdivision; AND WHEREAS the Council of the Corporation of the Town of Aurora considers it desirable to enact a by-law pursuant to the said Act exempting the lands hereinafter described from the said part lot control provisions; NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. Subsection 50(5) of the Planning Act, R.S.O. 1990, c.P.l3 (as amended) shall not apply to the following lands: 2. 3. Lots 7 and 8 South of Centre Street West of the Railroad on Registered Plan 107 Town of Aurora Regional Municipality of York This By-law shall take effect upon the approval of the Council ofthe Town of Aurora, and the registration of the By-law in the proper land registry office. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Although the Planning Act does provide that the by-law expires at the time period specified in the by-law, the Land Registrar has its own rules on how to remove these documents from title. The Land Registrar is requesting production and registration of an Application to Amend the Register deleting the said by-law and they specifically require the Application to contain the signature(s) of the appropriate Town officials. Therefore, would you kindly arrange to have the enclosed Application executed by the appropriate parties and return two executed copies to me for registration.
