BEING A BY-LAW with
respect to an amendment to
Development Charge By-law
3516-94.F.
WHEREAS the Council of the Town of Aurora has passed by-law 3516-94F, being a by-law
to establish development charges for the Town of Aurora pqrsuant to subsection 3(1) of the
Development Charges Act, R.S.O. 1990, c.D.9;
AND WHEREAS the Council of the Town of Aurora desire to amend the said by-law
pursuant to recommendations provided in staff report TR96-13 as revised by a report
prepared by C.N. Watson and Associates Ltd. entitled "Town of Aurora Development
Charge By-law Amendment to Provide a One Year Moratorium on Imposing Charges on
Industrial Additions", dated April 16, 1996;
AND WHEREAS the Council of the Town of Aurora has held at least one public meeting,
has given notice of the meeting and has ensured that sufficient information was made
available, pursuant to subsection 4(1) of the Development Charges Act;
NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora ENACTS
AS FOLLOWS:
1. By-law Number 3516-94F is hereby amended as follows:
(1) Paragraph 1, Definitions (21) through (40), inclusive, to be renumbered (22)
through (41) inclusive;
(2) That the following definition be included in Paragraph 1:
(21) "Industrial" means the land, buildings or structure for the primary purpose of
manufacturing, processing, fabricating or assembly of raw goods, warehousing or
bulk storage of goods and accessory uses but does not include warehouse clubs, or
warehousing or bulk storage of goods associated with a non-residential use;
(3) Paragraph 2, add:
(5) For the period April25, 1996 to April24, 1997, a moratorium on imposing the
non-residential charge provided in Schedule B to this by-law is provided for
additions to existing industrial buildings. This moratorium is further defined as
follows:
(a) the moratorium applies only to additions to existing industrial buildings and
to be limited to a maximum of 50% of the building area as it existed prior
to permit applications for the addition;
. (b) the moratorium is limited to one exemption per building;
(c) the moratorium will be applicable for all industrial addition building permits

issued between April 25, 1996 and April 24, 1997. For applicable building permit
applications received by the Town prior to March 1, 1997, the moratorium is extended to
July 24, 1997 by which time a building permit must be issued.
2. This by-law will come into force on the 25th day of April, 1996.
